While assailing the     order,<br \/>\nMr.Bambhania, learned Solicitor for the petitioners has<br \/>\nargued that the learned Tribunal has committed an error<br \/>\nin appreciating the facts as well as various provisions<br \/>\nof law and has erred in declaring only 61 square metres<br \/>\nof land as excess land instead of 831 square metres as<br \/>\ndeclared by the Competent Authority.\n<\/p>\n<p id=\"p_8\">2.Mr.Joshi for respondent No.2 has argued that<br \/>\nthere is gross delay in filing this petition.         The<br \/>\nimpugned order has been passed on 22.12.1993 whereas the<br \/>\npresent petition is filed on 8.1.1996 and thus this<br \/>\npetition suffers from inordinate delay, laches        and<br \/>\nacquiescence.   On merits also, he supports the impugned<br \/>\norder contending that various provisions of law have been<br \/>\nappreciated by the Tribunal in proper perspective and<br \/>\ngiving effect to the intention of the legislation.\n<\/p>\n<p id=\"p_9\">3.Admittedly, the impugned order is passed on<br \/>\n22.12.1993.   Mr.Bambhania for the petitioners has not<br \/>\nexplained the circumstances under which gross delay has<br \/>\nbeen caused.    As a cardinal rule, delay frustrates the<br \/>\nvery object therefore it would be unreasonable, unjust<br \/>\nand illegal to entertain the petition after inordinate<br \/>\ndelay. A mere glance at the dates of events reflects<br \/>\nthat all throughout the petitioners have been negligent<br \/>\nin pursuing this matter. In this case, by virtue of the<br \/>\norder passed by the Tribunal, some rights have already<br \/>\nbeen vested in the respondent and by entertaining this<br \/>\napplication after substantial delay would amount to<br \/>\nuprooting the respondent qua the rights which have<br \/>\nalready been vested.\n<\/p>\n<p id=\"p_10\">4.While considering the question of holding, the<br \/>\nCompetent Authority has held existence of construction on<br \/>\nthe land in question as is evident from its order dated<br \/>\n13.11.1992 but has conveniently overlooked the provisions<br \/>\nof Section 2 (g) regarding land appurtenant for which the<br \/>\nholder is entitled to get exemption. Had this question<br \/>\nbeen considered, probably fate of the matter would have<br \/>\nbeen otherwise and the Competent Authority would not have<br \/>\nbeen at pain to declare 831 square metres of land as<br \/>\nexcess land.\n<\/p>\n<p id=\"p_11\">5.I have gone through the impugned order and is<br \/>\ncompletely in consonance with various provisions of law.<br \/>\nThe learned Tribunal has also considered the question of<br \/>\n exemption available to the landholder under Section 2 (g)<br \/>\nof the Act. While considering the question, the Tribunal<br \/>\nhas also kept in mind location of the land, that is,<br \/>\nadjacent to national highway. It cannot be gainsaid that<br \/>\nwhen the land is situated just adjacent to national<br \/>\nhighway then a particular portion of the land has to be<br \/>\nkept open while making construction and the land which<br \/>\naccording to law is required to be kept open cannot be<br \/>\nconsidered as holding\/vacant land of the petitioner.<br \/>\nThus, the learned Tribunal has rightly given deduction<br \/>\nfor 860 square metres of land not falling within the<br \/>\ndefinition of &#8216;vacant land&#8217; qua the land bearing survey<br \/>\nNo.265.\n<\/p>\n<p id=\"p_12\">6.Similarly, the Competent Authority has also given<br \/>\ndeduction for 500 square metres of land under Section 2\n<\/p>\n<p id=\"p_13\">(g) of the Act in relation to existing construction in<br \/>\naccordance    with plans duly sanctioned by the Gram<br \/>\nPanchayat, Isanpur. Thus, on overall consideration of<br \/>\nfacts, the learned Tribunal has declared only 61 square<br \/>\nmetres of land as excess land. In my view, the learned<br \/>\nTribunal has not committed any error of law or illegality<br \/>\nwarranting interference by this court in exercise of writ<br \/>\njurisdiction.\n<\/p>\n<p id=\"p_14\">7.In the result, this petition being devoid of<br \/>\nmerits requires rejection.  Accordingly, petition is<br \/>\ndismissed. Rule is discharged.
