RAVIKUMAR, J\n           - - - - - - - - - - - - -- - - - - - - - - - - - - - - -\n                   W.P.(C)No. 20667 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n          Dated this the 12th day of October, 2010\n\n\n                           J U D G M E N T\n<\/pre>\n<p>           The petitioner is a widow of one Sri. N. Abdul<\/p>\n<p>Jabbar, who was the registered owner of a stage carriage<\/p>\n<p>bearing registration No. KL-11\/K-6696. The said vehicle is<\/p>\n<p>covered with a regular permit. On the death of Sri.N. Abdul<\/p>\n<p>Jabbar, the petitioner has submitted Exts.P3 and P4<\/p>\n<p>applications respectively for transfer of permit and for<\/p>\n<p>transfer of ownership of the vehicle.                Ext.P1 is the death<\/p>\n<p>certificate of the said Sri.N.Abdul Jabbar.                  Ext.P2 is the<\/p>\n<p>certificate issued by the concerned village officer showing the<\/p>\n<p>relationship of the petitioner with the deceased. Exts.P5 to P7<\/p>\n<p>are the No Objection Certificates issued by the children of the<\/p>\n<p>deceased expressing their consent for transfer of permit and<\/p>\n<p>ownership in the name of the petitioner. The grievance of the<\/p>\n<p>petitioner is that despite the receipt of the said documents no<\/p>\n<p>action has so far been taken to effect the transfer of ownership<\/p>\n<p>as also the transfer of permit, in respect of the aforesaid<\/p>\n<p>vehicle, in the name of the petitioner. It is further contended<\/p>\n<p>WPC.20667\/2010<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>that the respondents are insisting the petitioner for production<\/p>\n<p>of legal heirship certificate. Based on Ext.P8 judgment of this<\/p>\n<p>Court in WP(C)No. 16409\/2010, it is contended that production<\/p>\n<p>of legal heirship certificate is not mandatory for the purpose of<\/p>\n<p>deciding transfer of ownership and permit.        In short, when<\/p>\n<p>other documents showing relationship are available, there is no<\/p>\n<p>need to insist for production of legal heirship certificate.<\/p>\n<p>      2. I have heard the learned counsel for the petitioner as<\/p>\n<p>also the learned Government Pleader.\n<\/p>\n<p>      3.    The learned Government Pleader submitted that<\/p>\n<p>though an application for temporary permit has been received,<\/p>\n<p>the respondents have not yet received a proper application for<\/p>\n<p>transfer of ownership and permit from the petitioner.        That<\/p>\n<p>apart, it is submitted that on 9.7.2010 a hearing was scheduled.<\/p>\n<p>However, the petitioner and other legal heirs did not attend the<\/p>\n<p>same.\n<\/p>\n<p>      4. The learned counsel for the petitioner submits that in<\/p>\n<p>case, the respondents fix any date for appearance of the<\/p>\n<p>petitioner as also the other legal heirs, they would appear<\/p>\n<p>before the said authority. It is prayed that the respondents may<\/p>\n<p>be directed not to insist for production of legal heirship<\/p>\n<p>certificate as a condition for consideration of the applications.<\/p>\n<p>WPC.20667\/2010<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>In the circumstances, this Writ Petition is disposed of on the<\/p>\n<p>following lines:-\n<\/p>\n<p>      It will be open to the petitioner to make proper<\/p>\n<p>applications for transfer of permit and transfer of ownership in<\/p>\n<p>respect of the aforesaid vehicle. On receipt of such application<\/p>\n<p>the respondents shall fix a date for hearing the petitioner and<\/p>\n<p>the other legal heirs and the respondents shall not insist for<\/p>\n<p>production of legal heirship certificate for consideration of the<\/p>\n<p>applications for transfer of permit and ownership in case, the<\/p>\n<p>petitioner produces such other documents proving her<\/p>\n<p>entitlement to claim transfer of permit and ownership of the<\/p>\n<p>vehicle and appropriate application for transfer of permit and<\/p>\n<p>ownership. The second respondent shall consider the request<\/p>\n<p>of the petitioner for transfer of ownership and permit         in<\/p>\n<p>accordance with law expeditiously, at any rate, within a period<\/p>\n<p>of two months from the date of receipt of a copy of this<\/p>\n<p>judgment provided the petitioner satisfies the above conditions.<\/p>\n<p>                                              Sd\/-<\/p>\n<pre>\n                                    (C.T.
