Malhotra, Sr.Adv., Rajiv Nanda, Arvind Kumar Sharma,<br \/>\nMs. Sushma Suri, Advs. with him for the appellants.<br \/>\nMs. Sarla Chandra, Adv. for the Respondents.\n<\/p>\n<p id=\"p_2\">\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered:<br \/>\n     NANAVATI . J.\n<\/p>\n<p id=\"p_3\">     Delay condoned.\n<\/p>\n<p id=\"p_4\">     Special leave granted.\n<\/p>\n<p id=\"p_5\">     We have heard learned counsel for the parties.<br \/>\n     The only  question which  arises for  consideration  in<br \/>\nthese appeals is whether the Central Administrative Tribunal<br \/>\nwas right  in allowing\tthe application\t of the\t respondents<br \/>\ndirecting the  appellants to step up their pay so as to make<br \/>\nit at  par with\t the pay of B.C. Mishra who was their junior<br \/>\nbut getting a  higher pay.\n<\/p>\n<p id=\"p_6\">     It is  held by  the Tribunal  that the  respondents and<br \/>\nMishra belonged\t to the same cadre and their pay scales were<br \/>\nalso the  same in  the lower posts and,\t therefore, they are<br \/>\nentitled to  the benefit  of stepping  up .  But,  what\t the<br \/>\nTribunal has  failed  to  take\tinto  consideration  is\t the<br \/>\nCircular dated\t4.11.1993 issued by the Government of India,<br \/>\nDepartment of  Personnel &amp;   Training which clearly provides<br \/>\nthat the  anomaly for granting benefit of stepping up of pay<br \/>\nshould be  directly  as\t a  result  of\tthe  application  of<br \/>\nfundamental rule  22-C and  that if a junior officer draws a<br \/>\nhigher pay  in the  lower post\teither\tbecause\t of  advance<br \/>\nincrements or  on any  other account  then the\tprovision of<br \/>\nstepping up  would not\tapply in  such a  case. Moreover  in<br \/>\nparagraph 2(c) of the Circular it is, further, provided that<br \/>\nif a  senior joins  the higher\tpost, later than the junior,<br \/>\nfor whatsoever\treason, whereby\t he draws  less pay than the<br \/>\njunior, in  such a  case senior cannot, claim stepping up of<br \/>\npay at per with the junior.\n<\/p>\n<p id=\"p_7\">     In this case what had happened was that the respondents<br \/>\nand Mishra  were appointed  as typists\tclerks on  different<br \/>\ndates but   were  promoted to  the post of Welfare Inspector<br \/>\nGrade\t-III on\t the same date. Mishra was promoted to Grade<br \/>\nII earlier  than the  respondents on  ad hoc  basis. He\t was<br \/>\npromoted as Welfare Inspector Grade II on 1.2.1981 on ad hoc<br \/>\nbasis and worked continuously on the higher post upto 1.1.84<br \/>\non which  date the  two respondents and Mishra were promoted<br \/>\nas Welfare  Inspectors Grade  II on  regular basis.  At that<br \/>\ntime he\t was getting  a\t higher\t pay  than  the\t respondents<br \/>\nbecause of  his earlier\t ad hoc\t promotion. Mishra was again<br \/>\npromoted as  Welfare Inspector\tGrade I\t on ad hoc basis and<br \/>\nworked on  that post  continuously from\t 28.7.86 to 13.1.93.<br \/>\nOn 13.1.93 the respondents and Mishra were promoted to Grade<br \/>\nI on  regular basis.  On that date also Mishra was getting a<br \/>\nhigher pay  because of\this  ad\t hoc  promotion\t as  Welfare<br \/>\nInspector Grade\t I. It was for that reason that Mishra, even<br \/>\nthough\twas   a\t junior,  was  getting\tmore  pay  than\t the<br \/>\nrespondents. In\t view of these facts, the Circular governing<br \/>\nstepping up  of pay  issued by the Railway Board and the law<br \/>\nlaid down  by this Court in Union of India &amp; Others Vs. O.P.<br \/>\nSaxena (   1997\t  (6)\tSCC   360 ) the respondents were not<br \/>\nentitled to  the benefit  of stepping up. The Tribunal, thus<br \/>\ncommitted  an\terror  in   granting  that  benefit  to\t the<br \/>\nrespondents.
