Justice K.HEMA\n\n Dated :02\/01\/2008\n\n O R D E R\n                              J.B.KOSHY &amp; K.HEMA, JJ.\n\n                               --------------------------------------\n\n                                M.F.A.No.166 OF 2002\n\n                                -------------------------------------\n\n                                Dated 2nd January, 2008\n\n\n                                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">Ko<br \/>\n      shy,J.\n<\/p>\n<p id=\"p_1\">                  Respondents   herein   claimed   that   12   acres   in   Nilambur<\/p>\n<p>amsom desom, Edakkara Village of Ernad Taluk of Malappuram  District<\/p>\n<p>lying  in   Survey   No.1350   is  not  private   forest   and   Forest   Department  is<\/p>\n<p>disturbing their possession.   According to the appellants, the above land<\/p>\n<p>is   a   vested   forest   under   Section   3(1)   of   the   Kerala   Private   Forests<\/p>\n<p>(Vesting and Assignment) Act, 1971 (in short `the Act&#8217;).  It is also stated<\/p>\n<p>that it is part of a large extent of land.  Originally, it was given to Gwalior<\/p>\n<p>Rayons     for   bamboo   cultivation.     It   is   the   case   of   the   claimants<\/p>\n<p>(respondents) that the land was cultivated even at their father&#8217;s time till<\/p>\n<p>1985.         Thereafter,   forest   authorities   prevented  them  from   cultivation.\n<\/p>\n<p id=\"p_2\">Section 3(1) of the Kerala Private Forests (Vesting and Assignment) Act<\/p>\n<p>shows that all  private   forests  in Kerala  are automatically  vested    in  the<\/p>\n<p>Government from the appointed date, i.e., 10.5.1971.  Therefore,  to vest<\/p>\n<p>the   land,   it   should   be   a   private   forest   as   defined   under   the   Act.     The<\/p>\n<p>Forest   Tribunal   in   the   impugned   order   has   taken   pain   to   consider<\/p>\n<p>whether  this land was  demarcated  by  the  Government  as private  forest<\/p>\n<p>and   notified   by   Exts.B1   and   B4   (signed   by     two   different   officers)   and<\/p>\n<p>found that it was not proved that this property  was already demarcated.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MFA.166\/2002                                2<\/span><\/p>\n<p id=\"p_3\">If   the   land   is   a   private   forest,   it   is   automatically   vested   in   the<\/p>\n<p>Government   under   Section   3(1)   of   the   Act   whether   it   is   demarcated<\/p>\n<p>and notified as vested forest.   But, for vesting, it should be a private<\/p>\n<p>forest as defined under the Act.\n<\/p>\n<p id=\"p_4\">              2. Admittedly, the area in question is situated in erstwhile<\/p>\n<p>Malabar   District   in   Madras   State.     A   private   forest   is   defined   under<\/p>\n<p>section 2(f) of the Act as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              &#8220;2.(f) &#8220;private forest&#8221; means-<\/p>\n<p>           (1)   in   relation  to  the  Malabar   district   referred  to<\/p>\n<p>                 in   sub-section   (2)   of   <a href=\"\/doc\/1651675\/\" id=\"a_1\">Section   5<\/a>   of   the   State<\/p>\n<p>                 Reorganisation   Act,   1956   <a href=\"\/doc\/110162683\/\" id=\"a_1\">(Central   Act<\/a>   37   of<\/p>\n<p>                 1956)-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                (i)   any land to which the Madras Preservation<\/p>\n<p>                     of   Private   Forests   Act,   1949   (Madras   Act<\/p>\n<p>                     XXVII   of   1949),   applied   immediately<\/p>\n<p>                     before the appointed day excluding-<\/p>\n<p>               (A)   lands   which   are   gardens   or   nilams   as<\/p>\n<p>                     defined   in   the   Kerala   Land   Reforms   Act,<\/p>\n<p>                     1963 (1  of 1964);\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>\n                (B)   lands   which   are   used   principally   for   the<\/p>\n<p>                      cultivation   of   tea,   coffee,   cocoa,   rubber,<\/p>\n<p>                      cardamom or cinnamon and lands used for<\/p>\n<p>                      any purpose ancillary to the cultivation of<\/p>\n<p>                      such   crops   or   for   the   preparation   of   the<\/p>\n<p>                      same for the market.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\">\n<\/blockquote>\n<p id=\"p_5\">Therefore, to become a private forest, it should be proved that it is a<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MFA.166\/2002                                 3<\/span><\/p>\n<p>land   covered   by   the   Madras   Preservation   of   Private   Forests   Act<\/p>\n<p>(Madras  Act  XXVI   of  1949).     Now,   we  will   come  to   the   definition  of<\/p>\n<p>`forest&#8217; under the above Act.  Section 1(2) of the Madras Preservation<\/p>\n<p>of Private Forests Act, 1949 provides that it applies to private forests<\/p>\n<p>in   the   districts   of   Malabar   and   South   Kanara   having   a   contiguous<\/p>\n<p>area exceeding 100 acres and `forest&#8217; is defined under <a href=\"\/doc\/51403592\/\" id=\"a_2\">section 2(a)<\/a> as<\/p>\n<p>follows:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>            &#8220;2. (a) `forest&#8217; includes waste or communal land<\/p>\n<p>            containing   trees   and   shrubs,   pasture   land   and<\/p>\n<p>            any   other   class   of   land   declared   by   the   (State)<\/p>\n<p>            Government to be a  forest by notification in the<\/p>\n<p>            (Kerala Government Gazette).<\/p>\n<p>                Explanation.- For the purposes of this clause,<\/p>\n<p>            `communal   land&#8217;   means   any   land   of   the<\/p>\n<p>            description   mentioned   in   sub-clause   (a)   or   sub-<\/p>\n<p>            clause   (b)   of   clause   (16)   of   Section   3   of   the<\/p>\n<p>            Madras Estates Land Act, 1908 (Madras Act 1 of<\/p>\n<p>            1908);&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\">\n<\/blockquote>\n<p id=\"p_6\">So,   to  be  a  forest,  it  should   be  declared  by   the  Government  to  be  a<\/p>\n<p>forest  by   notification  either  by  the  erstwhile  Madras  Government  or<\/p>\n<p>by   the   Kerala   Government.     Admittedly,   no   such   notification   was<\/p>\n<p>published.  In the appeal memorandum even though it was stated that<\/p>\n<p>in   1949   there   is   such   a   notification,       it   is   not   produced   so   far.\n<\/p>\n<p id=\"p_7\">Tribunal   also   found   that   except   10   year   old   bamboo   clusters,   there<\/p>\n<p>was no other forest trees in the area.   There were four wells also and<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">MFA.166\/2002                                      4<\/span><\/p>\n<p>the boundaries include property of one Abdullah and some parambas<\/p>\n<p>and it is not continuous to any forest area notified under M.P.P.F Act .\n<\/p>\n<p id=\"p_8\">In the absence of any notification as mentioned under <a href=\"\/doc\/51403592\/\" id=\"a_3\">section 2(a)<\/a>, it<\/p>\n<p>cannot   be   a   forest   owned   by   private   parties   and   covered   under   the<\/p>\n<p>Madras   Preservation   of  Private  Forests   Act.       Therefore,  there  is  no<\/p>\n<p>automatic   vesting   under   <a href=\"\/doc\/30194904\/\" id=\"a_4\">section   3(1)<\/a>.     Since   the   land   is   not<\/p>\n<p>automatically   vested   under   <a href=\"\/doc\/30194904\/\" id=\"a_5\">section   3(1)<\/a>,   the   Act   itself   is   not<\/p>\n<p>applicable.   In view of the above, the Tribunal held that interference<\/p>\n<p>by   the   Forest   department   was   not   correct.
