Kodekar, learned APP, wavies service of rule on behalf of<br \/>\nthe respondent State.\n<\/p>\n<p id=\"p_2\">2.\tPresent<br \/>\napplication is filed by the applicant-original accused Bhachu Karsan<br \/>\nKoli after submission of the charge-sheet for releasing him on bail<br \/>\nin connection with complaint being I. C.R. No. 20 of 2008 registered<br \/>\nwith Rapar Police Station, District Kutch for the offences punishable<br \/>\nunder <a href=\"\/doc\/1436241\/\" id=\"a_1\">Sections 420<\/a>, <a href=\"\/doc\/1317063\/\" id=\"a_1\">465<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_2\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_3\">471<\/a>, <a href=\"\/doc\/112749\/\" id=\"a_4\">114<\/a> of IPC. It appears that the<br \/>\nalleged date of of offence 21.9.2007 and the complaint has been<br \/>\nlodged on 23.3.2008 after the complainant lost in the RTS<br \/>\nproceedings, the complaint came to be lodged. It appears  that there<br \/>\nwere two power of attorney with respect to different lands and with<br \/>\nrespect to another land and the power of attorney petitioner is<br \/>\nalready granted anticipatory bail as well as the regular bail.\n<\/p>\n<p id=\"p_3\">3.\tConsidering<br \/>\nthe above and more particularly, when the complaint was not filed<br \/>\nimmediately and complaint came to be filed only after the complainant<br \/>\nlost in RTS proceedings and considering the fact that the<br \/>\ninvestigation is already over and the charge-sheet is already filed,<br \/>\nthe applicant deserves to be released on bail. Applicant is ordered<br \/>\nto be released on bail in connection with Crime Register I. C.R. No.<br \/>\n20 of 2008 registered with Rapar Police Station, District Kutch for<br \/>\nthe offences punishable under <a href=\"\/doc\/1436241\/\" id=\"a_5\">Sections 420<\/a>, <a href=\"\/doc\/1317063\/\" id=\"a_6\">465<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_7\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_8\">471<\/a>, <a href=\"\/doc\/112749\/\" id=\"a_9\">114<\/a> of IPC<br \/>\non his executing a bond of Rs.5,000\/- (Rupees Five Thousand only)<br \/>\nwith one surety of the like amount to the satisfaction of the lower<br \/>\nCourt and subject to the conditions that applicant  shall :\n<\/p>\n<p id=\"p_4\">(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty:\n<\/p>\n<p id=\"p_5\">(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p id=\"p_6\">(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p id=\"p_7\">(d)\tmark<br \/>\ntheir presence before concerned Police Station on 1st and 7th<br \/>\nday of every English calendar month between 11.00 a.m. and 2.00 p.m.<br \/>\nfor a period of 6 (six) months.\n<\/p>\n<p id=\"p_8\">(e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p id=\"p_9\">(f)\tfurnish<br \/>\naddress of their residence at the time of execution of the bond and<br \/>\nshall not change their residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p id=\"p_10\">(g)\tsurrender<br \/>\ntheir  passport, if any, to the lower Court within a week.\n<\/p>\n<p id=\"p_11\">4.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_12\">5.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_13\">6.\t\tRule<br \/>\nis made absolute.
