No.5238\/2010\n23\/07\/2010\n      Shri D.K.Tripathi, Advocate for the applicant.\n      Shri S.K.Kashyap, Public Prosecutor for the\nrespondent-State.<\/pre>\n<p id=\"p_1\">      Heard on IA No.11148\/2010, an application for<br \/>\nurgent hearing.\n<\/p>\n<p id=\"p_1\">      Since the case diary is available, the application<br \/>\nis allowed.\n<\/p>\n<p id=\"p_2\">      Also heard both the parties.\n<\/p>\n<p id=\"p_3\">      Applicant is in custody in connection with Crime<br \/>\nNo.122\/2009 registered at Police Station Devendra<br \/>\nNagar District Panna for the offence punishable under<br \/>\n<a href=\"\/doc\/1599401\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/1243353\/\" id=\"a_1\">342<\/a>, <a href=\"\/doc\/594493\/\" id=\"a_2\">294<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_3\">506-B<\/a>, <a href=\"\/doc\/764237\/\" id=\"a_4\">394<\/a>, <a href=\"\/doc\/1183069\/\" id=\"a_5\">386<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_6\">397of<\/a> IPC<br \/>\nand <a href=\"\/doc\/73862\/\" id=\"a_7\">Sections 25<\/a>\/<a href=\"\/doc\/244673\/\" id=\"a_8\">27<\/a> of the Arms Act, since 27\/3\/2010.\n<\/p>\n<p id=\"p_4\">      Learned counsel for the applicant submits that<br \/>\nthere is no criminal past shown against the present<br \/>\napplicant. He is a reputed citizen of the locality. It is<br \/>\npossible that his tractor-trolley was used in the<br \/>\nincident, but his name was falsely implicated by the<br \/>\ncomplainant party. No property looted is seized from<br \/>\nthe   present   applicant.   He   is   in   custody   since<br \/>\n27\/3\/2010.\n<\/p>\n<p id=\"p_5\">      Learned public prosecutor for the State opposes<br \/>\nthe application mainly on the ground that tractor-<br \/>\ntrolley used in creation of obstruction of the way of the<br \/>\ncomplainant etc. was of the present applicant and the<br \/>\napplicant was present at the time of incident.\n<\/p>\n<p id=\"p_6\">      After hearing aforesaid arguments and looking to<br \/>\n          the facts and circumstances of the case particularly<br \/>\n         the   custody      period   of   the      applicant,     without<br \/>\n         expressing any view on the merits of the case, I am of<br \/>\n         the opinion that this is a fit case in which bail may be<br \/>\n         granted to the applicant Vimla @ Vimal Panday @<br \/>\n         Awadesh Pandey.\n<\/p>\n<p id=\"p_7\">               Therefore,     the    application     of     the   present<br \/>\n         applicant under <a href=\"\/doc\/1290514\/\" id=\"a_9\">Section 439<\/a> Cr.P.C is hereby allowed.<br \/>\n         He be released on bail on furnishing a bond in sum of<br \/>\n         Rs.30,000\/- (Rupees thirty thousand) with one surety<br \/>\n         bond of the same amount to the satisfaction of the<br \/>\n         Chief Judicial Magistrate, Panna, to appear before the<br \/>\n         committal Court and the trial Court on the dates given<br \/>\n         by the concerned Courts.\n<\/p>\n<p id=\"p_8\">               Certified copy as per rules.\n<\/p>\n<p id=\"p_9\">                                                          (N.K.Gupta)<br \/>\n                                                             Judge<\/p>\n<p>Ansari\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Vimala @ Vimal Pandey @ Awdhesh &#8230; vs The State Of Madhya Pradesh on 23 July, 2010 M.Cr.C.
