In said advertisement itself, it is clearly stated<br \/>\n\tthat 50 per cent shops shall be allotted to local educationally<br \/>\n\tunemployed and 50 per cent shall be allotted to Local Swasahay Juth<br \/>\n\tand hence only local educationally unemployed candidates\/local<br \/>\n\tswasahay juth shall be entitled to make application. According to<br \/>\n\tpetitioner, in said advertisement, it is also clearly stated that<br \/>\n\tfirst priority shall be given to Women Swasahay Juth is not<br \/>\n\tavailable, then, the application for educationally unemployed<br \/>\n\tcandidates shall be considered as second priority and if<br \/>\n\teducationally unemployed candidates are not available, application<br \/>\n\tfor cooperative societies shall be considered in accordance with<br \/>\n\tprevailing rules and regulations as third category. Thus, on non<br \/>\n\tavailability of women swasahay juth, respondent no.2 was duty bound<br \/>\n\tto consider applications of petitioner being educationally<br \/>\n\tunemployed candidate.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tpetitioner states that the petitioner being a local candidate and<br \/>\n\teducationally unemployed having requisite qualification and<br \/>\n\tfulfilling required criteria mentioned in the advertisement, made an<br \/>\n\tapplication for allotment of fair price shop for village Sankarda<br \/>\n\t(Vadodara Rural) (General Swasahay Juth) Sr. NO.3 in advertisement<br \/>\n\tin category of educationally unemployed candidate as mentioned in<br \/>\n\tadvertisement since in the advertisement itself, respondent No.2 has<br \/>\n\tstated that 50 per cent shops shall be allotted to candidate<br \/>\n\tbelonging to educationally unemployed candidate. According to<br \/>\n\tpetitioner, since no application was received from swasahay Juth,<br \/>\n\tDistrict Supply and Customer Protection Advisory Committee in its<br \/>\n\tmeeting held on 6.2.2010, resolved and decided to issue fresh<br \/>\n\tadvertisement. According to petitioner, since no application was<br \/>\n\treceived from Swasahay Juth, respondent No.2 on the basis of<br \/>\n\tdecision of District Supply and Customer Protection Advisory<br \/>\n\tCommittee in its meeting held on 6.2.2010 resolved and decided to<br \/>\n\tissue fresh advertisement, respondent no.2 rejected application of<br \/>\n\tpetitioner vide order dated 16.4.2010 holding that advertisement was<br \/>\n\tissued for Women Swasahay Juth and no candidate is available from<br \/>\n\tsaid category and hence it was decided to issue fresh advertisement<br \/>\n\tand hence application of petitioner for allotment of fair price shop<br \/>\n\tis rejected. Against said decision of respondent no.2 dated<br \/>\n\t16.4.2010, petitioner preferred an appeal before respondent no.3<br \/>\n\tbeing appeal no. 38\/2010 wherein petitioner submitted written<br \/>\n\targuments before respondent no.3 stating that petitioner is local<br \/>\n\tresident, educationally unemployed and as per advertisement itself,<br \/>\n\tif candidate from women swasahay is not available, then, case of<br \/>\n\teducationally unemployed candidate is required to be considered as<br \/>\n\tsecond priority and hence the decision to issue fresh advertisement<br \/>\n\ton the ground that no candidate from Swasahay Juth is available is<br \/>\n\tillegal and same would be wastage of time and public money and would<br \/>\n\tbe unnecessary burden on State Exchequer, as per the advertisement<br \/>\n\titself, case of petitioner being educationally unemployed, is<br \/>\n\trequired to be considered. However, respondent no.3 rejected<br \/>\n\trevision application preferred by petitioner holding that<br \/>\n\tadvertisement was issued for General Swasahay Juth and not for<br \/>\n\teducationally unemployed candidate and hence respondent no.2 has<br \/>\n\trightly rejected application of the petitioner being educationally<br \/>\n\tunemployed candidate. Therefore, against said decision of respondent<br \/>\n\tno.2 and 3 as referred to above, petitioner has filed this petition<br \/>\n\tbefore this Court.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tthis case, learned advocate Mr. Dave submitted mainly that<br \/>\n\tadvertisement which was issued, page 22 where Fair Price Shop is to<br \/>\n\tbe opened in each village, 50 per cent from local unemployed<br \/>\n\teducated candidate and remaining 50 per cent fair price shop for<br \/>\n\tlocal swasahay juth, therefore, applications were invited from both<br \/>\n\tcategories. Priority was to be given to women swasahay juth and in<br \/>\n\tcase if local swasahay juth candidate is not available, then, it<br \/>\n\twill be given to educated unemployed local candidate where it has<br \/>\n\tbeen decided that in respect to Sankarda Taluka District Baroda, no<br \/>\n\tapplication is received from Local Samanya Swasahay Juth category<br \/>\n\tand priority is to be given to women swasahay juth and, therefore,<br \/>\n\tit has been unanimously decided by all the committee members  to<br \/>\n\tre-advertise for allotment of fair price shop. On that basis<br \/>\n\tapplication made by petitioner has been rejected by respondent no.2.<br \/>\n\tNotification has been issued by Collector, Baroda on 20th<br \/>\n\tJuly, 2009 inviting application for fair price shop[ for village<br \/>\n\tSankarda. In Statement-1 at item No.3 of advertisement, against<br \/>\n\tvillage Sankarda, category of Samanya Swasahay Juth has been<br \/>\n\tmentioned. Except that category, no other category is entitled to<br \/>\n\tmake application and, therefore, respondent no.2 rejected claim of<br \/>\n\tpetitioner. Therefore, petitioner being aggrieved by decision of<br \/>\n\trespondent no.2 District Collector, Baroda dated 16th<br \/>\n\tApril, 2010 approached Revisional Authority by filing revision<br \/>\n\tapplication no. 38 of 2010 who decided it on 24th June,<br \/>\n\t2010 considering Government Resolution dated 21.8.2006 and also<br \/>\n\tconsidered notification dated 20th July, 2009 where in<br \/>\n\tStatement I, item no.3, against village Sankarda, category of<br \/>\n\tSamanya Swasahay Juth has been mentioned, means it has been reserved<br \/>\n\tfor Samanya Swasahay Juth Category, therefore, local educated<br \/>\n\tunemployed candidate is not entitled to make such application in<br \/>\n\trespect to village Sankarda as per notification dated 20th<br \/>\n\tJuly, 2009 and, therefore, on that basis, revision application which<br \/>\n\thas been made by petitioner has been rejected by respondent no.3.<br \/>\n\tPage 23 notification which has been issued in respect to area except<br \/>\n\tin Baroda Municipal Corporation in Statement-I. Against village<br \/>\n\tSankarda, category specified is Samanya Swasahay Juth. Grievance<br \/>\n\traised by petitioner that petitioner is entitled for consideration<br \/>\n\ton the ground that petitioner being local educated unemployed<br \/>\n\tcandidate because 50 per cent : 50 per cent has been bifurcated.<br \/>\n\tHowever, this fact is found from record to be incorrect because<br \/>\n\tspecific notification has been issued wherein in statement-I page<br \/>\n\t23, village Sankarda is meant for General Swasahay Juth and it has<br \/>\n\tnot been made applicable to any local educated unemployed<br \/>\n\tcandidate and, therefore, according to my opinion, contention raised<br \/>\n\tby learned advocate Mr. Dave for petitioner cannot be accepted<br \/>\n\tsimply on the ground that advertisement is specified for General<br \/>\n\tSwasahay Juth in respect to village Sankarda and petitioner is not<br \/>\n\tcovered by said category and, therefore, District Collector, Baroda<br \/>\n\thas rightly passed order dated 16.4.2010 and revision application<br \/>\n\tpreferred by petitioner against said order has been rightly rejected<br \/>\n\tby revisional authority respondent no.3 by order dated 24.6.2010 and<br \/>\n\ttherefore, no interference is necessary because petitioner is not<br \/>\n\tentitled to make such application in respect to village Sankarda as<br \/>\n\tit has been specified for General Swasahay Juth and  it is not meant<br \/>\n\tfor local educated unemployed candidate and, therefore, no error has<br \/>\n\tbeen committed by respondent no.2 and 3 in deciding matter and,<br \/>\n\ttherefore, there is no substance in this petition and hence this<br \/>\n\tpetition is dismissed.\n<\/p>\n<p id=\"p_5\">(H.K.\n<\/p>\n<p id=\"p_6\">Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Patel vs District on 25 October, 2010 Author: H.K.Rathod,&amp;Nbsp;
