BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nseeking 21 days&#8217; Temporary Bail so as to perform Post Death Rituals<br \/>\non the sad demise of his mother, who died on 1st March<br \/>\n2011, as per the Death Certificate enclosed.\n<\/p>\n<p id=\"p_1\">2.0\tOn<br \/>\nthe last occasion i.e. on 28th April 2011, the learned<br \/>\nAdditional Public Prosecutor was asked to confront the brother of the<br \/>\napplicant &#8211; convict, who has stated in his Statement that, &#8216;his<br \/>\nmother died about three months back&#8217;.\n<\/p>\n<p id=\"p_2\">2.1\tLearned<br \/>\nAdditional Public Prosecutor Mr. Pandya produced a Statement of the<br \/>\nbrother of the convict recorded on 30th April 2011,<br \/>\nwherein, he has reiterated that, &#8216;his mother died about three<br \/>\nmonths back&#8217;.  It is also stated in the Statement that after the<br \/>\ndeath, 12th day ritual is completed but so far as &#8216;Ful<br \/>\nPadhramani&#8217; is concerned, the same is scheduled on 7th May<br \/>\n2011 at Pranchi Pipala, Taluka: Sutrapada, wherein, the presence of<br \/>\nthe present applicant &#8211; convict is required.\n<\/p>\n<p id=\"p_3\">2.2\tFrom<br \/>\nthe Jail Remarks, it is noticed that in the month of March 2011, he<br \/>\nwas granted bail for a period of 03 days with Police Escort.\n<\/p>\n<p id=\"p_4\">3.0\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis allowed.  The applicant &#8211; convict is ordered to be released on<br \/>\nTemporary Bail for a period of 01 week from the date of<br \/>\nhis release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p id=\"p_5\">3.1\tAs,<br \/>\nin the year 2006, when the applicant &#8211; convict was granted<br \/>\nParole for 10 days he absconded for 784 days and was lodged back in<br \/>\njail only on 23rd March 2008, besides, one of his<br \/>\nco-accused being Sanjay Pundik is also absconding after being<br \/>\nreleased on furlough, it is directed that the applicant &#8211;<br \/>\nconvict shall mark his presence at the nearest Police Station<br \/>\nevery day.\n<\/p>\n<p id=\"p_6\">3.2\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p id=\"p_7\">3.3\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p id=\"p_8\">[<br \/>\nRavi R.
