Mitra, CPIO.\n\n      The matter was heard on     :        26.9.2011 (Matter was heard through video\n                                                      conferencing.)\n\n                                           ORDER\n<\/pre>\n<p id=\"p_1\">      Three second appeals filed by Shri Pramod Kumar Verma, the Appellant,<br \/>\nwere heard together.      Through the aforementioned 3 RTI applications the<br \/>\nAppellant had asked for information regarding labourer dismissed from service<br \/>\ni.e. grounds for such dismissal, disbursement of CMPF and gratuity to such<br \/>\ndismissed labourer, if not disbursed the reasons for non disbursement CMPF and<br \/>\ngratuity etc. The information requested for the past 20 years.\n<\/p>\n<p id=\"p_1\">      The matter was earlier heard on 13.5.2010 in which the decision of the<br \/>\nCommission was as follows:-\n<\/p>\n<p id=\"p_2\">      &#8220;It is fairly obvious that if the information which appellant has mentioned is<br \/>\nheld by the public authority at a central point, it should be made available to the<br \/>\nappellant. Otherwise, there seems to be some substance in the respondents&#8217;<br \/>\nplea that given the time period for which the information is requested and, its<br \/>\nwide scope, would make it difficult as well as expensive to compile.\n<\/p>\n<p id=\"p_3\">        In the alternative, appellant should consider limiting the scope of his<br \/>\nenquiry for the public authority to attempt to provide him the answers.\n<\/p>\n<p id=\"p_4\">       In view of the conflicting positions taken by the appellant and the<br \/>\nrespondents, it is necessary that the matter is resolved through a discussion<br \/>\nbetween the officers of the public authority and the appellant which could be best<br \/>\ndone at the level of the Appellate Authority, who is closest to the point where<br \/>\ninformation is held and he knows both the difficulty and the cost of collecting and<br \/>\ncollating either the whole or a part of the information.\n<\/p>\n<p id=\"p_5\">       Accordingly, matter is remitted back to the Appellate Authority with the<br \/>\ndirection that, within four weeks of the receipt of this order, he will hold a hearing<br \/>\nwith the appellant and either all or some of the important holders of the<br \/>\ninformation and decide the best manner of meeting the appellant&#8217;s requests.&#8221;\n<\/p>\n<p id=\"p_6\">       In compliance with the aforementioned directions of the Commission, the<br \/>\nFAA vide his decision dated 18.6.2010 has held that since the information<br \/>\nrequested for is of the past 20 years and the information is not held by the<br \/>\nRespondent in the manner in which it has been requested, <a href=\"\/doc\/1322680\/\" id=\"a_1\">section 7(9)<\/a> of the<br \/>\nRTI Act is attracted. The FAA has reiterated that if the Appellant were to ask for<br \/>\nspecific information, information could be provided to him. However, the FAA<br \/>\nexpressed his inability to obtain such specific request for information from the<br \/>\nAppellant since he was not present during the hearing conducted by the FAA.<br \/>\nThe FAA vide this order has again advised the Appellant to make a specific<br \/>\nrequest within 10 days of passing of his order. The CPIO, HQ was also directed<br \/>\nby the FAA to provide the requisite information to the Appellant within 15 days of<br \/>\nreceipt of such specific request by the Appellant.\n<\/p>\n<p id=\"p_7\">       During the hearing the Appellant stated that there is no reason for him to<br \/>\nmake such a request since all the information is available with the Respondent.<br \/>\nThe Respondent on the other hand reiterate that the information requested by<br \/>\n the Appellant is spread over 20 years and all the information would have to be<br \/>\ncollected from Area Officers leading to disproportionate diversion of the<br \/>\nresources of the Public Authority.\n<\/p>\n<p id=\"p_8\">      After hearing the contentions of the parties, the Commission observes that<br \/>\nthe Appellant is seeking information for over 20 years including payment of<br \/>\nCMPF and gratuity etc., which, as per the Respondent is not readily available<br \/>\nwith them in the manner in which the information has been requested. The<br \/>\nAppellant also failed to appear for the hearing conducted by the FAA, upon the<br \/>\nmatter remitted back to him by the Commission to conduct the hearing. The<br \/>\nappellant instead of making specific request has reiterated his request for<br \/>\ninformation spanning a period of 20 years.
