The Assistant Engineer, Minor Irrigation Subdivision, Jamui.\n                                                -----------\n<\/pre>\n<p id=\"p_1\">02.   15.10.2011                Petitioner is before this Court seeking a direction<\/p>\n<p>                   upon the respondent authorities to adjust him in the regular<\/p>\n<p>                   establishment forthwith as he has been working as a Chaukidar<\/p>\n<p>                   in the work charge establishment in North Irrigation Scheme,<\/p>\n<p>                   Chhatarpur under the Minor Irrigation Department at Jhajha.<\/p>\n<p>                   Petitioner entered into service in the work charge establishment<\/p>\n<p>                   as far back as on 7.12.1984. Before that he has even worked on<\/p>\n<p>                   daily wages from May, 1969.\n<\/p>\n<p id=\"p_1\">                                There is a circular of the State Government that all<\/p>\n<p>                   such persons who have worked              in the work charge<\/p>\n<p>                   establishment for 5 years are entitled for regularization and<\/p>\n<p>                   taking cue from the same there are materials to show contained<\/p>\n<p>                   in Annexures 9, 10, 11 and 12 that due recommendations have<\/p>\n<p>                   been made at the local level for regularizing the service of the<\/p>\n<p>                   petitioner   but no decision till date has been taken by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>      competent authority including people at the level of the State<\/p>\n<p>      Government in the Minor Irrigation Department.<\/p>\n<p id=\"p_2\">                  Taking the above facts into consideration the writ<\/p>\n<p>      application is disposed of with a direction upon the Principal<\/p>\n<p>      Secretary, Minor Water Resources Department, Government of<\/p>\n<p>      Bihar, Patna that taking cognizance of the recommendations<\/p>\n<p>      which is emanated from the field and other superior authorities ,<\/p>\n<p>      a decision on the status of the petitioner ought to be taken<\/p>\n<p>      preferably within a period of three months from the date of<\/p>\n<p>      production of a copy of this order.\n<\/p>\n<p id=\"p_3\">\n<pre id=\"pre_1\">rkp                                          ( Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Gyan Prakas Singh vs The State Of Bihar &amp; Ors on 15 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.13721 of 2011 Gyan Prakas Singh S\/O Late Bhagwat Singh R\/O Vill.- Patsando , P.S. and Distt.- Jamui Versus 1.
