Naima Akhtar @ Rumi, Wife of Imteyaz Ali, Resident of Mohalla Aliganj Road No. 12,\n         PS Chandauti, District Gaya. ---- Opposite Parties.\n                                                -----------\n<\/pre>\n<p id=\"p_1\">3        14.9.2011                      Heard the parties.\n<\/p>\n<p id=\"p_1\">                                        The petitioners are aggrieved by order dated 27.4.2005<\/p>\n<p>                          taking cognizance in Complaint Case No. C- 359 of 2005 under<\/p>\n<p>                          <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections 323<\/a> and <a href=\"\/doc\/538436\/\" id=\"a_1\">498A<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">                                        Learned counsel for the petitioners submits that petitioner<\/p>\n<p>                          no. 2 Aisha Khatoon was married to the complainant Naima Akhtar @<\/p>\n<p>                          Rumi&#8217;s brother. It is said that Aisha Khatoon had filed a case earlier<\/p>\n<p>                          under <a href=\"\/doc\/538436\/\" id=\"a_3\">Section 498A<\/a> against the family members of opposite party no.<\/p>\n<p id=\"p_3\">                          2. The submission is that the present is a counter blast to the earlier<\/p>\n<p>                          case under the dowry Act.\n<\/p>\n<p id=\"p_4\">                                        This Court is not inclined to consider quashing the order<\/p>\n<p>                          of cognizance dated 27.4.2005 on the grounds urged on behalf of the<\/p>\n<p>                          petitioners as both the complaints are distinct, because of the fact that<\/p>\n<p>                          the allegations are with respect to offences under <a href=\"\/doc\/538436\/\" id=\"a_4\">Section 498A<\/a> of the<\/p>\n<p>                          Indian Penal Code which would not warrant quashing of the order of<\/p>\n<p>                          cognizance.\n<\/p>\n<p id=\"p_5\">                                        This application is dismissed.\n<\/p>\n<p id=\"p_6\">\n<pre id=\"pre_1\">          Sanjay                                                    (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ahmadi Khatoon &amp; Ors vs State Of Bihar &amp; Anr on 14 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
