Justice ANTONY DOMINIC\n\n Dated :01\/12\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ================\n                W.P.(C) NO. 34447 OF 2009 (A)\n                =====================\n\n          Dated this the 1st day of December, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Petitioner was appointed as a Contingent Employee in the<\/p>\n<p>sanitation section of the Kozhikode Corporation. Subsequently,<\/p>\n<p>he was deployed for tapal work on working arrangement. There<\/p>\n<p>appears to have been some complaints about the working<\/p>\n<p>arrangement thus made.        However, in a meeting that was<\/p>\n<p>convened by the Mayor, it was decided to continue the working<\/p>\n<p>arrangement. Ext.P1 is the minutes of the meeting.<\/p>\n<p id=\"p_1\">     2.     Later, by Ext.P2, the petitioner was transferred from<\/p>\n<p>Circle No.13 where he was engaged for tapal work to Circle No.10<\/p>\n<p>for sanitation work. This order was challenged before this Court in<\/p>\n<p>WP(C) No.30681\/09. Though the writ petition was dismissed, in<\/p>\n<p>WA No.2468\/09 filed by him, petitioner was given freedom to<\/p>\n<p>represent against the transfer. Accordingly, he submitted Ext.P6<\/p>\n<p>representation, where he also stated that he is a cardiac patient<\/p>\n<p>and that, for that reason as well, he should be retained in the<\/p>\n<p>tapal section.    However, the request was rejected by Ext.P7,<\/p>\n<p>where it is stated that the appointment of the petitioner was in<\/p>\n<p>sanitation section and therefore he is bound to do sanitation work<\/p>\n<p>WPC 34447\/09                      :2 :\n<\/p>\n<p id=\"p_2\">\n<p>as well. It is challenging this order, the writ petition is filed. Learned<\/p>\n<p>counsel for the petitioner contended that petitioner having been<\/p>\n<p>assigned for work in the tapal section, could not have been<\/p>\n<p>deployed again for sanitation work.\n<\/p>\n<p id=\"p_3\">      3.     On the materials available, I am not able to accept this<\/p>\n<p>plea. Evidently, appointment of the petitioner was in sanitation<\/p>\n<p>section.     He was assigned to do tapal work only on working<\/p>\n<p>arrangement.        Although it may have been decided by the<\/p>\n<p>Corporation to continue the working arrangement, still it is always<\/p>\n<p>open to the Corporation to require the petitioner to discharge<\/p>\n<p>sanitation work depending upon the exigencies of work. This<\/p>\n<p>precisely is what has been done in this case. Therefore, the<\/p>\n<p>conclusions in the order rejecting the representation as evidenced<\/p>\n<p>by Ext.P7 cannot be interfered with.\n<\/p>\n<p id=\"p_4\">      4.     Be that as it may, if according to the petitioner, due to<\/p>\n<p>his poor health condition, he is unable to discharge the duties<\/p>\n<p>assigned to sanitation work, it is open to the petitioner to pursue his<\/p>\n<p>claim for a convenient posting, in which event, that shall be dealt<\/p>\n<p>with in accordance with law.\n<\/p>\n<p id=\"p_5\">      Writ petition is disposed of as above.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">                                           ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.
