Justice ANTONY DOMINIC\n\n Dated :29\/02\/2008\n\n O R D E R\n                          ANTONY  DOMINIC, J.\n\n                          =======================\n\n                            W.P.(C) No. 7127   of 2008(W)\n\n                          =======================\n\n\n                   Dated this the   29th  day of February, 2008\n\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The   complaint   of   the   writ   petitioners   is   that   the   Motor<\/p>\n<p>Vehicles   Tax   in   respect   of   the   vehicles   owned   by   them   is   not<\/p>\n<p>accepted   by   the   Taxation   Officer   for     the   reason   that   the<\/p>\n<p>petitioner has not produced certificate as required under Section<\/p>\n<p>8(A) of the Motor Transport Workers Welfare Fund Act of having<\/p>\n<p>discharged their dues under the Motor Transport Workers Welfare<\/p>\n<p>Fund   Scheme.     Based     on   the   Government   clarification   that<\/p>\n<p>Educational   institutions   are   not   Motor   Transport   Undertakings,<\/p>\n<p>this  Court  has   already rendered  judgment  in  the  case  of  Toc&#8217;H<\/p>\n<p>Public   School   v.   District   Executive   Officer  (1992(1)   KLT<\/p>\n<p>S.N. Case NO.49)  that it is not   the requirement of educational<\/p>\n<p>institutions to make payment of the welfare fund dues.  Following<\/p>\n<p>the aforesaid judgment, this Court also has disposed of a batch of<\/p>\n<p>writ petitions including W.P.(C) No.1208\/08.   Adopting the same<\/p>\n<p>reasoning   as     adopted   in   the   aforesaid   cases,   I   dispose   of   this<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> W.P.(C) No. 7127\/2008\/W               -2-<\/span><\/p>\n<p>writ petition also directing that the Motor Vehicles Tax tendered<\/p>\n<p>by the petitioners herein will be accepted by the Taxation Officer<\/p>\n<p>without insisting on certificate as specified under Section 8(A) of<\/p>\n<p>the Motor Transport Workers Welfare Fund Act.<\/p>\n<p id=\"p_1\">        Writ petition is disposed of as above.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">                                                       Sd\/-\n<\/p>\n<p id=\"p_4\">                                                 ANTONY  DOMINIC,<\/p>\n<p>                                                  JUDGE<\/p>\n<p>jp<\/p>\n<p>                                                  \/TRUE COPY\/<\/p>\n<p>                                                  P.A.
