No.946 of 2008\n                            SHARWAN KUMAR\n                                Versus\n                         MOSTT. SHANTI KUWAR\n                             -----------\n<\/pre>\n<p id=\"p_1\">2   3\/7\/2008             Heard counsel for the petitioner.<\/p>\n<p id=\"p_1\">                             Petitioner seems to be aggrieved by the<\/p>\n<p>                order dated 17.5.2008, whereby and whereunder, the<\/p>\n<p>                executing          court    has       directed          for     delivery       of<\/p>\n<p>                possession.\n<\/p>\n<p id=\"p_2\">                             Counsel       for    the      petitioner          submits       that<\/p>\n<p>                true it is, that there was compromise on the basis<\/p>\n<p>                of which the eviction suit, Title Suit No. 23 of<\/p>\n<p>                2007     was       disposed       of,        but    then        delivery       of<\/p>\n<p>                possession could not be effected on the basis of<\/p>\n<p>                such compromise decree and for this purpose he has<\/p>\n<p>                relied upon a decision in the case of &#8216;Viveka Nand<\/p>\n<p>                Bhawan       Vs.    Satendra       Prasad&#8217;         reported         in     A.I.R.<\/p>\n<p>                1996 S.C.1985.\n<\/p>\n<p id=\"p_3\">                             In     the     opinion          of      this          Court     such<\/p>\n<p>                submission of the counsel for the petitioner is<\/p>\n<p>                absolutely misconceived, in as much as, the Apex<\/p>\n<p>                Court    in       that    particular case               having noted          the<\/p>\n<p>                facts    of       the    case    and       the     terms      of    compromise<\/p>\n<p>                decree had found that there was a clear provision<\/p>\n<p>                in     the     compromise          petition          itself          that     the<\/p>\n<p>                defendants          were    tobe       evicted          after       expiry     of<\/p>\n<p>                period       of    ten     years       and       that    too       through     an<\/p>\n<p>                appropriate         action       in    court of          law, this          Court<\/p>\n<p>                fails    to        understand         as    to     how     the      facts     and<\/p>\n<p>                consequential ratio of the aforementioned judgment<\/p>\n<p>                will be applicable in the present case where there<\/p>\n<p>                was no such condition imposed in the decree.<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p id=\"p_4\">                       Be that as it may, once the petitioner had<\/p>\n<p>              entered into compromise on 27.4.2007 that not only<\/p>\n<p>              he will pay arrears of rent but would also give<\/p>\n<p>              vacant possession of the shop in question in Title<\/p>\n<p>              Suit No. 23 of 2007, it does not lie in the mouth<\/p>\n<p>              of the petitioner to make any prayer and oppose<\/p>\n<p>              delivery of possession.\n<\/p>\n<p id=\"p_5\">                       The     grievance        of   the   petitioner   that<\/p>\n<p>              certain amount was advanced and that has not been<\/p>\n<p>              refunded by the landlord-opposite party also is<\/p>\n<p>              misconceived and it has been fairly admitted by<\/p>\n<p>              the   counsel   for    the petitioner        that a   separate<\/p>\n<p>              money suit for this purpose being Money Suit No.<\/p>\n<p>              13 of 2007 is still pending.\n<\/p>\n<p id=\"p_6\">                       In that view of the matter, this Court<\/p>\n<p>              does not find any error in the impugned order.<\/p>\n<p>              Accordingly, this civil revision application being<\/p>\n<p>              devoid of merit, is dismissed.\n<\/p>\n<p id=\"p_7\">                       The court below is directed to ensure that<\/p>\n<p>              the delivery of possession be effected within a<\/p>\n<p>              period   of    one   month   of    receipt\/production     of   a<\/p>\n<p>              copy of this order.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">                                                ( Mihir Kumar Jha, J.)<\/p>\n<p>Abhay Kumar\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sharwan Kumar vs Mostt.
