RAMKUMAR, J.\n                     ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n                    B.A. No. 6467 OF 2010\n               ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n             Dated: 18th day of October, 2010\n\n                              ORDER\n<\/pre>\n<p id=\"p_1\">      The petitioner, who is the sole accused in Crime<\/p>\n<p>No.926\/2010 of Venjaramoodu Police Station for an offence<\/p>\n<p>punishable under <a href=\"\/doc\/1101188\/\" id=\"a_1\">Section 379<\/a> I.P.C., seeks anticipatory bail.<\/p>\n<p id=\"p_1\">      2.   The learned Public Prosecutor opposed the application.<\/p>\n<p id=\"p_2\">      3.    Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature.   But at the same time, I am inclined to permit the<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for bail<\/p>\n<p>considered by the Magistrate having jurisdiction. Accordingly, the<\/p>\n<p>petitioner shall surrender before the investigating officer on<\/p>\n<p>01\/11\/2010 or on 02\/11\/2010 for the purpose of interrogation<\/p>\n<p>and recovery of incriminating material, if any.
