The facts leadinghito  as\nhereunder:  it it 'V V\n\n'1' he petitioner  of a Motor\nvehicle   He made an\napplicatiohgfour to surrender the\nVehicle  otjthe tax payable on the\nvehicledduje to he permit granted to the bus\n\nwasjvalid frorn__V_g1'Zl\u00ab--5'--l.'2.().01 to 31-5-2008. The vehicle in\n\na question was Covered under the tourist permit. He had\n\n tlie~v'.,v.tai\u00a7\"\".upto 11-10-2003. From 1--1l--2003 he\n\nsoughtviexernption from paying tax by surrendering the\n\n 'veh_iele\"' by declaring the place of garage as KGN Garage\n\n New T imber Yard, Mysore Road, Bangalore.\n\n\\\u00bb'\u00a7\/\n\n\n\nAccording to the appellant the vehicle required\n\nreconstruction of body on account of its usage. _4Ini'-Qrd_er\n\nto construct a body building he sought for   ' \n\nthe authorities to remove the vehicle frorh\"K(i'}l\\l'V\"Garage \"'\n\nto M\/ s Azad Coach Builders, Ke1;';geI:'i_',i Sangaloire\ufb01 \n\non the application of the pei:,i'ti=oner\"'the.per1nis'sion;was=.l'\n\ngranted on 7-5-2004\u00bb,  Though\nsuch permission was   was some\ndifference of' apyxjelllant and M \/ s\nAzad Coach  'a.g_ai_n:\".apVproached the RTO on\n15~5~:2':0l04-. to its original place of\ngarage'li.e..'_KL'}vlv\\l  Yard, Mysore Road.\n\nSuch perlI'i';iisSi0V1f1'V--_\\>ifas'granted to the appellant by the\n\n    ---------- \n<\/pre>\n
 ._  3.:”V’\u00a3iVCi\u00a7”C”}arage, Bangalore was inspected by the<\/p>\n
  on 31~5\u00ab~200-4. Then it was noticed that the<\/p>\n
2 “vel1_icle”‘ was not in the place of venue where it was<\/p>\n

required to be stationed. Therefore, a showwcause<\/p>\n
notice was issued on 238-2004.\n<\/p>\n
4. The appellant after receipt of  <\/p>\n
notice sent a reply stating that”‘”he.is”__<\/p>\n
vehicle on road and due to <\/p>\n
the vehicle was not found”‘-in’-KGl\\l Gar’age. herleforelll<\/p>\n
he requested the.   thelvvproeeedings.
\nBeing not satisfied    the appellant,
\nthe respondentVphad:=A__leiried  1-11-2003 to
\n3l–10\u00ab2OC\u00a7\u00e9_   questioned by the
\nappelianltv it  _  before the Joint
\nCommissioner  before the learned single<\/p>\n

  _ 5V,V’The:”m_ain contention of the appellant before us<\/p>\n
{:1 thiat  demanded by the respondent along with<\/p>\n
 the penalty from 1\u00ab11–2003 to 31-10-2000 is illegal.<\/p>\n

  lpetitioner had obtained permission initially to park the<\/p>\n

M\/ s Azad Coach Builders  7   <\/p>\n
sought for permission to re_–_sh-i:f_t the  from M\/s<\/p>\n
Azad Coach Buildersdtos  on 156-2004.-<\/p>\n
Contendirig that ,1_the:.\u00a2eha~;ielvzas_  KGN garage
\nas per  _grant.edf\u00a2'  respondent with
\neffectgvifromii;S–\u00a7if2'0O4V,A"the'appellant towed the vehicle
\nfrom   Coach Builders and again<\/p>\n
based ontthe ,pjerin3_i'ss–i'on granted shifted the vehicle<\/p>\n
 "  0 froth l'..;fil,:\/s~vAzari"VCoach Builders to KGN Garage the levy<\/p>\n
 *c.i0'_r.sp\u00a2na1ty from 141-2003 to 31-10-2000 is<\/p>\n
  'according to him if the authorities had not<\/p>\n
 Agraritedi' permission to remove the vehicle from KGN<\/p>\n
 Garage to M \/ s Azad Coach Builders and from M\/ s Azad<\/p>\n
 .. V___\u00a7'.'30ach Builders to KGN Garage again as per the<\/p>\n

have been justified in demanding the appe11an4t,to.._:p.ay<\/p>\n
the tax and penalty with effect from 1-1.<\/p>\n

from KGN garage to NUS  <\/p>\n
7-5-2004 when the vehiclei-had beerr<\/p>\n

\npermitted the  from M\/s
\nAzad Coach    onwards, if the
\nvehicle'   garage subsequent to
\n15–5\u00bb$:Z004'_,  oould levy tax and penalty<\/p>\n
only _frorn0"}; 5v#'5=2'00?~3=_0onwards and not prior to the said<\/p>\n
 date; o~\u00bbsupport'"his arguments he further contends<\/p>\n
  "veihirgle was not stationed at KGN garage as<\/p>\n
piermitt.ed0':–.earIier and when further the vehicle was<\/p>\n
 gstationed at M\/s Azad Coach Builders as per the<\/p>\n

 .. __.not have granted permission to shift the vehicle from<\/p>\n

The very fact that the permission has been grante:d.on<\/p>\n
155-2004 to shift the vehicle from M\/s  <\/p>\n
Builders to KGN garage the cause of_."ae'ti.on. l'fo1f*_t11_e "<\/p>\n
respondent to levy tax and perialtyfwoulcl <\/p>\n
from 156-2004 and not prilsyre-:9 that   <\/p>\n
7. Per contra’  learned counsel
\nfor the Respondents  is violation of
\nthe terms     granted, the
\n and penalty and
\ntherefore__   to dismiss the appeal.\n<\/p>\n
To support   he has referred to the<\/p>\n
 of Court in the ease of Jerome Crasta<\/p>\n
 it  Transport Officer, ILR 1991 Kar 3212.<\/p>\n
 ._   heard the learned counsel for the parties<\/p>\n
the only point to be considered by this court is Whether<\/p>\n
  V. Athielearned single Judge as well the Joint Commissioner<\/p>\n

for Transport and the RTO were justified in levying the<\/p>\n
tax and penalty from 1- 1 1-2008 or not’?<\/p>\n

permission is granted The KGN<\/p>\n

vehicle  Thvelrelfore in the absence of
\nany ir1aterial’._–Vto_ ueven prior to 155-2004 the
\nVehicle ‘waslynotV._parke’d\u00ab–.e’ither in KGN Garage as per the<\/p>\n
pergrriissiondlof .t_he”R’lV”-C) or in M \/ s Azad Coach Builders,<\/p>\n
 the  cannot levy penalty or demand tax from<\/p>\n

permission was granted, the authorities by’…<\/p>\n
advantage of their mistake, cannot  .<\/p>\n

has not been considered by the l’earriAedV sin.gle_yJud\u00bbge..a5s<\/p>\n

d  It-.andj'..the vehicle was intercepted by the RTO, but in the<\/p>\n
 .,,_ir1stant case the facts are entirely different. In the<\/p>\n

circumstances, we have to hold that an error is<\/p>\n
committed in calling upon the petitioner to pay <\/p>\n
1-11-2003 to 15-4-2006.\n<\/p>\n
