           Vide impugned judgment and order dated November<\/p>\n
06, 2003, the learned Sessions Judge, Jodhpur, in Sessions Case<\/p>\n
No. 72\/2003, convicted appellant Bhanwar Sigh alias Bhanwariya<\/p>\n
by caste Rajput R\/o village Newara, Police Station, Mathaniya,<\/p>\n
district Jodhpur, for the offence under Section 302<\/a> of the Indian<\/p>\n
Penal Code and awarded sentence of life imprisonment with a<\/p>\n
fine of Rs.500\/- and in default of payment of fine further to<\/p>\n
undergo rigorous imprisonment for one month.                     The appellant-<\/p>\n
accused, by way of this jail appeal, has challenged the conviction<\/p>\n
recorded and sentence awarded by the learned Sessions Judge in<\/p>\n
the aforesaid Sessions Case.\n<\/p>\n
           The facts of the case, in succinct, are that on<\/p>\n
03.3.2003, at 8:14 AM, one Mahendra Singh (PW 14) lodged an<\/p>\n
FIR with the Police Station, Mathaniya, district Jodhpur, stating<\/p>\n
therein that in Gram Panchayat, Newara, about 25 to 30 years

\n                     (Bhanwar Singh alias Bhanwariya Vs. State of Rajasthan)<\/p>\n
                                     2<\/span><\/p>\n
ago, one person named as Sumera Ram came and started<\/p>\n
residing there.   He was getting disablement pension from the<\/p>\n
State Government and also used to beg breads and other<\/p>\n
eatable items from the villagers. A night before lodging of the<\/p>\n
FIR, one unknown person caused death of Sumera Ram by<\/p>\n
causing injuries to him. Deceased Sumera Ram 60 years old and<\/p>\n
was dump.     On the aforesaid report, a criminal case under<\/p>\n
Section 302<\/a> IPC was registered as FIR No.29 dated 10.3.2003<\/p>\n
and   the investigation     ensued.               During the course             of<\/p>\n
investigation, the investigating officer recorded the statements of<\/p>\n
witnesses, arrested the appellant-accused and in pursuance of<\/p>\n
the information furnished by the appellant under Section 27<\/a> of<\/p>\n
the Indian Evidence Act and at the instance of the appellant, a<\/p>\n
stone was    recovered; the post-mortem on the dead-body of<\/p>\n
Sumera Ram was conducted and after investigation, the police<\/p>\n
filed Challan in the Court of the learned Sessions Judge. The<\/p>\n
learned Sessions Judge, after trial, recorded the conviction of the<\/p>\n
appellant-accused under Section 302<\/a> IPC and awarded him the<\/p>\n
sentence as afore-stated.\n<\/p>\n
            We have heard learned counsel for the appellant-<\/p>\n
accused and the learned Public Prosecutor for the State.<\/p>\n
            The   counsel    for    the     appellant       urges      that    the<\/p>\n
prosecution story hinges on threee sets of evidence against the<\/p>\n
appellant: firstly, the evidence regarding last seen of the<\/p>\n
appellant with the deceased is led by the prosecution is that of<\/p>\n
Smt. Radha, who saw appellant with deceased Sumera Ram in<\/p>\n
the Guwadi near his residence in the night;                         secondly is

                                       3<\/span><\/p>\n
regarding extra-judicial confession made by the appellant before<\/p>\n
PW 6 Chain Singh; and the third set of evidence is regarding<\/p>\n
recovery   of    Rs.37\/-   from      the     appellant       in   pursuance      to<\/p>\n
information recorded under Section 27<\/a> of the Indian Evidence<\/p>\n
Act.\n<\/p>\n
              According to him, so far as PW 3 Smt. Radha is<\/p>\n
concerned, she has only stated             that she had seen appellant-<\/p>\n
accused Bhanwar Singh in the night before the date of<\/p>\n
occurrence of the offence while he was running near the “Patwar<\/p>\n
Bhawan.”       Learned counsel for the appellant urged that PW 3<\/p>\n
Smt. Radha is not an eye witness of the occurrence of the<\/p>\n
offence and as per her statement, she had only seen the<\/p>\n
appellant-accused while he was running near the “Patwar<\/p>\n
Bhawan.”\n<\/p>\n
              Regarding the second set of evidence, the main<\/p>\n
contention of the learned counsel for the appellant is that as per<\/p>\n
the cross-examination of PW 6 Chain Singh, he informed to the<\/p>\n
police regarding the extra-judicial confession made by the<\/p>\n
appellant before him one day after the date of making such<\/p>\n
confession.      He further contends that the conduct of this<\/p>\n
witness , viz. PW 6 Chain Singh, cannot be said to be normal in<\/p>\n
as much as that no such undue delay can be caused in normal<\/p>\n
course.\n<\/p>\n
              Regarding the third set of evidence, the contention of<\/p>\n
the learned counsel for the appellant is that no good and<\/p>\n
sufficient motive has been established by the prosecution<\/p>\n
regarding commission of offence by the appellant and there is no

evidence on record to establish this fact that the appellant has<\/p>\n
committed this offence to grab Rs.200\/- from the deceased.<\/p>\n
               Per contra, the learned Public Prosecutor urged that<\/p>\n
the conviction recorded and the sentence awarded by the<\/p>\n
learned Sessions Judge is based on cogent reasons and is<\/p>\n
established on sound appreciation, scanning and evaluation of<\/p>\n
the evidence on record.\n<\/p>\n
               We have given our thoughtful consideration to the<\/p>\n
arguments advanced by the learned counsel for the parties and<\/p>\n
scanned, evaluated and analysed the evidence on record.<\/p>\n
               PW 3 Smt. Radha, who is said to be an witness, who<\/p>\n
claims to have seen the appellant running near the “Patwar<\/p>\n
Bhawan”, does not connect the appellant with the crime alleged<\/p>\n
to have been committed by him.                She has stated only to this<\/p>\n
effect that she had seen the appellant in the cote (Gawadi),<\/p>\n
while he was running from alleged place of incident.<\/p>\n
               So far as the statement of PW 6 Chain Singh is<\/p>\n
concerned, in his cross-examination, he has stated that after<\/p>\n
making the extra-judicial confession by the appellant before him,<\/p>\n
he kept mum for a day and on the second day, he informed to<\/p>\n
the police regarding the same.             This statement of PW 6 Chain<\/p>\n
Singh is wholly contrary to the natural human conduct because<\/p>\n
there was no reason for him to keep mum for a day for such a<\/p>\n
heinous offence and that too when the offence was committed in<\/p>\n
his village.    More so, generally the extra-judicial confession is<\/p>\n
made by an accused before a person, with whom he reposes<\/p>\n
utmost faith or expects some benefit by making such statement,

                                     5<\/span><\/p>\n
but in the instant case, there is no such evidence in this regard.<\/p>\n
Thus, the statement of PW 6 Chain Singh cannot be relied on.<\/p>\n
              So far as the third set of evidence regarding<\/p>\n
grabbing of Rs.200\/- by the appellant from the deceased is<\/p>\n
concerned,    there is not even an iota of evidence on record<\/p>\n
regarding any such motive; on the other hand, there is evidence<\/p>\n
on record that the amount of pension being kept with some<\/p>\n
other person of the village.             The learned Sessions Judge,<\/p>\n
Jodhpur, while relying on the evidence of the aforesaid two<\/p>\n
witnesses, viz. PW 3 Smt. Radha and PW 6 Chain Singh, as also<\/p>\n
the evidence of the investigating officer regarding the recovery<\/p>\n
of money received through pension remaining with some other<\/p>\n
person in the village.\n<\/p>\n
             Apart from this, the learned Sessions Judge has not<\/p>\n
appreciated cross-examination of PW 10 Dr. Raja Ram Sharma,<\/p>\n
wherein he stated that while conducting the autopsy on the<\/p>\n
corps of the deceased, he recorded the details of the injuries on<\/p>\n
the dead-body of the deceased on a separate paper and after<\/p>\n
preparation of the post-mortem report, he destroyed that paper.<\/p>\n
This part of the conduct of PW 10 Dr. Raja Ram Sharma is very<\/p>\n
important and on the basis of this evidence, the cause of death<\/p>\n
of the deceased due to injuries caused on the head by a stone,<\/p>\n
cannot be regarded as reliable as the entire post-mortem report<\/p>\n
becomes doubtful.\n<\/p>\n
             Resultantly, on the basis of the discussions made<\/p>\n
here-in-above, we are of the considered view that the conviction<\/p>\n
recorded and the sentence awarded by the learned Sessions
\n                        D.B. Criminal (Jail) Appeal No.1343\/2003
\n                      (Bhanwar Singh alias Bhanwariya Vs. State of Rajasthan)<\/p>\n
                                      6<\/span><\/p>\n
Judge, Jodhpur against the appellant-accused, vide impugned<\/p>\n
judgment and order dated 06.11.2003 passed in Sessions Case<\/p>\n
No.72\/2003, cannot be sustained and deserve to be quashed<\/p>\n
and set aside.\n<\/p>\n
            Hence, the impugned judgment and order dated<\/p>\n
November 06, 2003 passed by the learned Sessions Judge,<\/p>\n
Jodhpur in Sessions Case No. 72\/2003, are set aside and<\/p>\n
appellant-accused Bhanwar Singh alias Bhanwariya S\/o Rewant<\/p>\n
Singh Rajput R\/o Newara, Police Station, Mathaniya, district<\/p>\n
Jodhpur, is acquitted of the charges levelled against him. He is<\/p>\n
in jail and be set at liberty if not required in any other case.<\/p>\n
