The said<\/pre>\n
claim petition had come up for consideration before the<\/p>\n
Tribunal on 13.1.2006.\n<\/p>\n
3. The Tribunal, after hearing the   <\/p>\n
on both sides and after consideririg ~:t\u00ab_orall” and 7.<\/p>\n
documentary evidence available’ –. on. record , iallowiedv i the<\/p>\n
claim petition in part anVd.,lp:.awarde(i_ lcolmplenslation ot
\nRs.2,10,000\/w withliinterelst bf?\/<,ivlA'p.er  from the<\/p>\n
date of petition  deposit. Being<\/p>\n
dissatisfied of compensation awarded
\nby  appellants have presented this<\/p>\n
appeal on t1'1e..___._gr~ound that the said compensation<\/p>\n
' .-laWarvded_"-by'—-.the Tribunal, is inadequate and requires<\/p>\n
it  by modifying the judgment and award of<\/p>\n
t.he~~lrib\ufb01nal.\n<\/p>\n
 The learned counsel for the appellants at the<\/p>\n
 “ouitset submitted that the Tribunal committed error in<\/p>\n
 taking the notional income of the deceased at<\/p>\n

Rs.E5.000\/- per annum, without taking into<\/p>\n
consideration the fact that he was a student  in<\/p>\n
the 3″‘ year Diploma in Mechanical <\/p>\n
was on the fag end of the Diploma in <\/p>\n
couple of months or after Coinp1.etion,ff”hVe<\/p>\n
earned not less than –A}’3er moIith._faI1d’V:wou1dfi<\/p>\n
have taken care ofghis gagedg’-iiarentstj*~Therefore. he
\nsubmits that the ‘i’ribuna1.i7′ taken the<\/p>\n
monthly     Rs.5,000\/– and<\/p>\n
qua:ntified” Further, he submits
\nthat Committed error in not awarding<\/p>\n
ju_s’t~ and.’ reasonable compensation towards loss of<\/p>\n
  gtransportation of dead body and funeral<\/p>\n
 ‘e:q:ievn.fseVs ffa..1*1d also erred in not awarding any<\/p>\n
oomperisation towards loss of love and affection.<\/p>\n
 A. Therefore, he sought for modifying the judgment and<\/p>\n
 ‘award of the Tribunal by awarding just and reasonable<\/p>\n
‘ compensation.\n<\/p>\n

5. Per contra, the learned counsel for the second<\/p>\n
respondent \u00abM\u00bb Insurance Company substantiated’ the<\/p>\n
judgment and award passed by the ‘l’ribiin_a’_l”a’s <\/p>\n
reasonable and contended that the sarriie”is.:’pasise’d  <\/p>\n
due consideration of the Ii*iater’ial 0._r1’~ lreccfdp ‘and .<\/p>\n
therefore, it does not callfor-. .interfere11ce’bjI:itl1i.smCourt.–dc L’<\/p>\n
6. We have heard  lV’:lea1’ned l\u00e9otiriselii appearing<\/p>\n
on both sides.\n<\/p>\n
 7.  _careful’vcvonsidelration of the submissions
\nof “o1’1. both sides and after thorough<\/p>\n
evaluation the ori\u00e9inai records available on file, the<\/p>\n
 \u00ab .por1l_V”p:oint\u00abcthat arise for our consideration is,<\/p>\n
iAV.ivWI1ether the compensation awarded by<\/p>\n
 ‘ribumizl isjust and reasonable?<\/p>\n
it  The undisputed facts of the case are that on<\/p>\n
lghaccount of the injuries sustained in the accident,<\/p>\n
 deceased Laxman son of the appeliants herein<\/p>\n
succumbed to the same enroute to the Hospital. On<\/p>\n

perusal of the original records. it is noticed that the<\/p>\n
deceased Laxman was studying in the 3″‘ yea1=.\u00a7)\u00ab\u00a7_,i_)’loma<\/p>\n
in Mechanical Engineering and within a s_l’\u00a3ortAlperiod——he.g<\/p>\n
would have started earning. T _here_fore’,  .re,gari;\u00a5_to’ _ it<\/p>\n
educational qualification of   <\/p>\n
age, We deem it fit to accepivtihe income  t’h’e”‘de’ceasedl<\/p>\n
at Rs.4,000\/– per month.Afl’he’g_:deCe_ased\\,v,:2.s,,,; bachelor.
\nTherefore, out of Rs,4l,QOOo,\/<ll1',,:if fdeld-uct 50% towards<\/p>\n
personal e:x:.peri-Sesi, of t\u00a7rie..,Vd~e'c.eVase:d, the net income<\/p>\n
corries  Having regard to the
\nage  the'  the younger parent, the<\/p>\n
agipropriate-.Vrriultiiaiier applicable is 'l3'. Therefore, we<\/p>\n
  R-:..,,s.i2,ooo\/\u00bb (Rs.2,000\/~ x 12 x 13) towards<\/p>\n
  as against Rs.l,95,000\/– awarded<\/p>\n
by th_e'Tribunal.\n<\/p>\n
 Further, the Tribunal has committed error in<\/p>\n
 ‘awarding only Rs. 10,000\/- towards loss_ of estate, which<\/p>\n
is on the lower side. Therefore, we award Rs.20,000\/\u00ab<\/p>\n

by the Tribunal.\n<\/p>\n
10. The Tribunal has further <\/p>\n
not awarding any compensation towards Io_ss_ of.io_Ve..A and 7<\/p>\n
affection. Having regard ,to.__the  that’the.’:4ap};i};31iantsi,<\/p>\n
have lost their son, we deedrriit fit to  10,000\/~–
\ntowards loss of love  _
\nll. TheA—error in awarding<\/p>\n
oniyi  transportation of dead body
\nand Aftineral  is on the lower side.<\/p>\n
Ha’v’ving regard “‘to”exTpenses, we deem it fit to award<\/p>\n
 ~ towards transportation of dead body and<\/p>\n
   as against Rs.5,000\/~ awarded by the<\/p>\n

 For the foregoing reasons, the appeal is<\/p>\n
dalljowed in part. The impugned judgment and dated<\/p>\n
T 13.1.2008 passed in M.V.C.No.1608\/2004 on the fiie of<\/p>\n
the Member. Motor Accident Claims ‘I’ribuna1–IV,<\/p>\n

Bangalore is hereby modified by awarding compensation
\nof Rs.3,52,000\/– as against Rs.2,10,000\/~ awai+;ie.d by<\/p>\n
the Tribunal. The enhanced cornpenlsatien<\/p>\n
Rs.1,-42,000\/– shall carry int_ere,st at”l6<3\/a:'_'per'i <\/p>\n
from the date of petition till  of <\/p>\n
