Justice S.S.SATHEESACHANDRAN\n\n Dated :10\/03\/2010\n\n O R D E R\n                S.S.SATHEESACHANDRAN, J.\n                   -------------------------------\n             C.R.P.NOS.573 &amp; 594 OF 2008 ()\n                 -----------------------------------\n          Dated this the 10th day of March, 2010\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">     These revisions are filed against the orders passed by the<\/p>\n<p>Additional District Judge, Kottayam awarding enhanced<\/p>\n<p>compensation in O.P.(EA).No.107 of 2000 and O.P.(EA).<\/p>\n<p>No.108 of 2000, both filed under <a href=\"\/doc\/1805445\/\" id=\"a_1\">Section 42<\/a> of the Indian<\/p>\n<p>Electricity Supply Act and Sub <a href=\"\/doc\/1866179\/\" id=\"a_1\">sections 10<\/a> and <a href=\"\/doc\/100648\/\" id=\"a_2\">16<\/a> of the<\/p>\n<p>Indian Telegraph Act read with <a href=\"\/doc\/333264\/\" id=\"a_3\">Section 51<\/a> of the Indian<\/p>\n<p>Electricity Act.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">     2. C.R.P.No.573 of 2008 is filed against the order in O.P.<\/p>\n<p>(EA).No.107 of 2000 and C.R.P.No.594 of 2008 against the<\/p>\n<p>order in O.P. (EA).No.108 of 2000.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">     3. Previously, the enhanced compensation awarded by<\/p>\n<p>the court below in the two original petitions earlier had been<\/p>\n<p>set aside by this Court in revisions remitting the cases for<\/p>\n<p>fresh consideration with some directions. Pursuant to such<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRP.573\/08 &amp; 594\/08            2<\/span><\/p>\n<p>remission, complying with the directions given in the remand<\/p>\n<p>order, the impugned orders have been passed. At the time of<\/p>\n<p>hearing, it is submitted that this Court while remitting the<\/p>\n<p>cases earlier had directed the court below to reassess the<\/p>\n<p>compensation following the guidelines given in Kumba<\/p>\n<p>Amma v. K.S.E.B. (2000 (1) KLT 542 (FB)). So far as the<\/p>\n<p>tree cutting compensation awarded in the present case, there<\/p>\n<p>is no dispute that the assessment had been made strictly in<\/p>\n<p>accordance with the directions given in the remand order. So<\/p>\n<p>much so, that part of the enhanced compensation awarded by<\/p>\n<p>the court below does not arise for scrutiny in these revisions.<\/p>\n<p id=\"p_5\">      4. The only challenge canvassed in these revisions is<\/p>\n<p>that the court below in fixing the compensation towards the<\/p>\n<p>area for putting up towers and also the claim for diminution<\/p>\n<p>of land value canvassed by the claimants has fixed the centage<\/p>\n<p>value and also the percentage of injurious affection on a<\/p>\n<p>higher side without sufficient data. The claims have arisen on<\/p>\n<p>account of loss and damages caused by the drawing of 220 KV<\/p>\n<p>lines through the properties of the claimant. When that be so,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRP.573\/08 &amp; 594\/08            3<\/span><\/p>\n<p>it has to be taken note that the land underneath the lines and<\/p>\n<p>also that of the clearing area cannot be profitably used by the<\/p>\n<p>land owners as it was done earlier. Such clearing area for 220<\/p>\n<p>KV lines, needless to point out, is essential to avoid any<\/p>\n<p>mishap and to ensure free flow of energy without any<\/p>\n<p>obstruction. Clearance made in the property of the claimants<\/p>\n<p>was for drawing 220 KV electric lines has to be taken note in<\/p>\n<p>examining the challenge against the compensation given for<\/p>\n<p>diminution of land value. In O.P.(EA).No.107 of 2000, the<\/p>\n<p>court has fixed the centage value at Rs.8000\/-. On the basis of<\/p>\n<p>the materials produced in the case, the court below awarded a<\/p>\n<p>sum of Rs.32,000\/- for the four cents of land taken for putting<\/p>\n<p>up a tower, and towards diminution of land value by the<\/p>\n<p>drawing of lines, the area of which was determined as eight<\/p>\n<p>cents, on the above centage value as above and fixing 20% as<\/p>\n<p>the injury suffered, the court has awarded Rs.12,800\/-. I find<\/p>\n<p>that the assessment made by the court is just and reasonable<\/p>\n<p>and no interference is called for.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">     5. In the other case, O.P.(EA).No.108 of 2000, adopting<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">CRP.573\/08 &amp; 594\/08             4<\/span><\/p>\n<p>the same centage value and percentage of injury, the court<\/p>\n<p>has awarded a sum of Rs.27,200\/- for the affected area of 17<\/p>\n<p>cents, and that can only be considered as just and proper. I<\/p>\n<p>find no interference with the orders passed by the court below<\/p>\n<p>awarding the enhanced compensation as fixed in such orders<\/p>\n<p>is called for.
