    Defacto complainant, who is the injured and<\/p>\n
examined as PW2 in S.C.No.89\/1996 on the file of I<\/p>\n
Additional  Assistant  Sessions   Court,  Thrissur,<\/p>\n
filed  this  revision  challenging  the   order  of<\/p>\n
acquittal  passed  by  learned  Sessions  Judge  in<\/p>\n
Crl.A.No.146\/1998. The contention raised in the<\/p>\n
revision is that learned Sessions Judge has no<\/p>\n
power to entertain an appeal involving a sentence<\/p>\n
of imprisonment for more than seven years and<\/p>\n
therefore, the order of acquittal is illegal. It is<\/p>\n
also contended that learned Sessions Judge did not<\/p>\n
consider  the  prosecution   case  in   the  proper<\/p>\n
perspective and re-appreciation of evidence was not<\/p>\n
proper and on the evidence, learned Sessions Judge<\/p>\n
should not have interfered with the conviction.<\/p>\n
    2. Prosecution case is that the eleven accused<\/p>\n
formed themselves into an unlawful assembly on<\/p>\n
CRRP 981\/00              2<\/span><\/p>\n
18.1.1995 at about 1.15 p.m. and in furtherance of<\/p>\n
their common object, trespassed into the house of<\/p>\n
PW2, armed with dangerous weapons like iron rod and<\/p>\n
wooden stick and with the intention to cause the<\/p>\n
death of PW2, first petitioner inflicted a blow on<\/p>\n
the head of PW2 with MO1 iron rod and second<\/p>\n
petitioner hit him with MO2 wooden stick and the<\/p>\n
other accused threw stones at the house of PW2 and<\/p>\n
caused damage to the house and also caused injuries<\/p>\n
to   PW3,   a relative and  thereby  committed  the<\/p>\n
offences under Sections 143, 147, 148, 452, 324 and<\/p>\n
304 read with Section 149<\/a> of Indian Penal Code.<\/p>\n
Accused pleaded not guilty.\n<\/p>\n
     2. Learned Assistant Sessions Judge, on the<\/p>\n
evidence of PWs 1 to 13, Exhibits P1 to P13 and Mos<\/p>\n
1 and 2 and DWs 1 to 3 and Exhibits D1 to D6, on<\/p>\n
the side of the defence, convicted accused 1 to 3,<\/p>\n
6 to 8 and 11, except the accused, who were<\/p>\n
absconding, for the offences under Sections 143<\/a>,<\/p>\n
147<\/a>, 148<\/a>, 452<\/a>, 324<\/a> and 307<\/a> read with Section 149 of<\/p>\n
CRRP 981\/00              3<\/span><\/p>\n
Indian Penal Code<\/a>. They were sentenced to rigorous<\/p>\n
imprisonment   for  seven years   and  a  fine  of<\/p>\n
Rs.5,000\/- each and in default, simple imprisonment<\/p>\n
for one year for the offence under Section 307<\/a> read<\/p>\n
with Section 149<\/a> of Indian Penal Code. No separate<\/p>\n
sentence    was awarded  for  the  offences   under<\/p>\n
Sections 143<\/a> and 147<\/a> of Indian penal Code. They<\/p>\n
were   sentenced to  simple  imprisonment for   six<\/p>\n
months each for the offence under Section 452<\/a> read<\/p>\n
with Section 149<\/a> of Indian Penal Code, simple<\/p>\n
imprisonment for six months each for the offence<\/p>\n
under Section 148<\/a> of Indian Penal Code and simple<\/p>\n
imprisonment for one year each for the offence<\/p>\n
under Section 324<\/a> read with Section 149<\/a> of Indian<\/p>\n
Penal Code. The substantive sentences were directed<\/p>\n
to be run concurrently.\n<\/p>\n
     3.    The first  contention  raised   by   the<\/p>\n
petitioners is that as the sentence is seven years<\/p>\n
for the offence under Section 307<\/a> of Indian Penal<\/p>\n
Code and one year for the offence under Section 324<\/p>\n
CRRP 981\/00              4<\/span><\/p>\n
of Indian Penal Code<\/a>, no appeal will lie before the<\/p>\n
Sessions Court. Section 374<\/a> of Code of Criminal<\/p>\n
Procedure provides appeals from convictions. Sub-<\/p>\n
section (2) of Section 374<\/a> provides that any person<\/p>\n
convicted on a trial held by a Sessions Judge or an<\/p>\n
Additional Sessions Judge or on a trial held by any<\/p>\n
other Court in which a sentence of imprisonment for<\/p>\n
more than seven years may appeal to the High Court.<\/p>\n
Sub-section    (3) provides that save as otherwise<\/p>\n
provided in sub-section (2), any person convicted<\/p>\n
on   a    trial by a   Metropolitan Magistrate   or<\/p>\n
Assistant Sessions Judge or Magistrate of the first<\/p>\n
class or of the second class, may appeal to the<\/p>\n
Court of Session. Therefore, Sessions Judge is<\/p>\n
competent to entertain an appeal filed against the<\/p>\n
conviction    and sentence  by  Assistant  Sessions<\/p>\n
Judge, provided, the sentence is imprisonment for<\/p>\n
not more than seven years. An appeal will lie<\/p>\n
before the High Court against the conviction of a<\/p>\n
Assistant Sessions Judge only if the sentence of<\/p>\n
CRRP 981\/00              5<\/span><\/p>\n
imprisonment is for more than seven years or less.<\/p>\n
If the sentence is seven years, an appeal will lie<\/p>\n
before the Sessions Court and if the sentence is<\/p>\n
more than seven years, an appeal will lie only<\/p>\n
before the High Court. It is not aggregate of the<\/p>\n
sentence for the different offences convicted that<\/p>\n
matters, but the maximum sentence for any of the<\/p>\n
offences.   Therefore,  the   contention   of   the<\/p>\n
petitioner that no appeal will lie before the<\/p>\n
Sessions Court and Crl.A.No.13\/1998 should not have<\/p>\n
been entertained by the Sessions Court cannot be<\/p>\n
accepted,   as the  maximum  sentence  awarded  was<\/p>\n
imprisonment for seven years for the offence under<\/p>\n
Section 307<\/a> of Indian Penal Code. An appeal is<\/p>\n
perfectly maintainable.\n<\/p>\n
     4. Learned counsel would argue that learned<\/p>\n
Sessions Judge did not consider the evidence in the<\/p>\n
proper perspective and on the evidence, conviction<\/p>\n
should not have been interfered. A reading of the<\/p>\n
judgment of the learned Sessions Judge shows that<\/p>\n

the    learned   Sessions  Judge  has   elaborately<\/p>\n
considered the evidence and appreciated each item<\/p>\n
of evidence in the proper perspective. Learned<\/p>\n
Sessions    Judge found  that  in respect  of   the<\/p>\n
incidents that occurred on that fateful day, three<\/p>\n
crimes were registered, i.e., Crime Nos.11\/1995,<\/p>\n
12\/1995 and 13\/1995 of Vadakkekad Police Station.<\/p>\n
Final report submitted in this case, which was<\/p>\n
taken cognizance was in Crime No.12\/1995. Crime<\/p>\n
No.13\/1995 relates to an incident which occurred in<\/p>\n
front of the house of PW2. Crime No.11\/1995 relates<\/p>\n
to an incident, which took place at the Primary<\/p>\n
Health Centre, where some of the accused were<\/p>\n
admitted. Parties of the prosecution witnesses in<\/p>\n
this case are accused in the other two crimes.<\/p>\n
Learned Sessions Judge found that though refer<\/p>\n
reports    were  filed  in  Crime Nos.11\/1995   and<\/p>\n
13\/1995, on the facts and circumstances of the<\/p>\n
case, prosecution is bound to produce the F.I.<\/p>\n
Statements, the scene mahazar and the final reports<\/p>\n
CRRP 981\/00              7<\/span><\/p>\n
in all the crimes, so that court can evaluate the<\/p>\n
materials and decide whether prosecution case is<\/p>\n
true or the defence case is true. Learned Sessions<\/p>\n
Judge, on analysing the evidence of PWs 1 to 3, the<\/p>\n
injured and the eye witnesses, found that according<\/p>\n
to the prosecution, entire incident in this case<\/p>\n
occurred inside the house of PW2. Based on the<\/p>\n
evidence, learned Sessions Judge found that if such<\/p>\n
injuries were sustained inside the house of PW2,<\/p>\n
there should be some traces of blood in the house,<\/p>\n
in view of the injuries sustained, but none was<\/p>\n
found. Learned Sessions Judge also found that blood<\/p>\n
stains were found in the courtyard of the house of<\/p>\n
PW2, probabilising the case of the defence that<\/p>\n
injuries sustained were not inside the house but<\/p>\n
from outside the house. Learned Sessions Judge also<\/p>\n
found that the defence case that when accused 3 to<\/p>\n
5 were passing through the road, they were attacked<\/p>\n
by PW2 and party and to prevent the attack, the<\/p>\n
accused persons had thrown stones at the house of<\/p>\n

PW2 which caused the damage. The fact that damage<\/p>\n
was caused to the house of PW2 is admitted by the<\/p>\n
prosecution.   Learned  Sessions  Judge,   on   re-<\/p>\n
appreciation of the entire evidence, found that it<\/p>\n
is improbable to cause such damage if some among<\/p>\n
the accused had gone into the house and inflicted<\/p>\n
the injuries, while, the remaining accused threw<\/p>\n
stones at the house of PW2, which would have<\/p>\n
injured    the accused also. It  is   after  proper<\/p>\n
appreciation of evidence, learned Sessions Judge<\/p>\n
found that prosecution case cannot be true and PWs<\/p>\n
1 and 3 could have sustained injuries not from the<\/p>\n
house of PW2, as claimed by the prosecution, but in<\/p>\n
the incident which took place either outside the<\/p>\n
house of PW2 or at the Primary Health Centre, where<\/p>\n
the accused were attacked. Considering the entire<\/p>\n
evidence and reasonings of the learned Sessions<\/p>\n
Judge, it cannot be said that learned Sessions<\/p>\n
Judge did not properly appreciate the evidence or<\/p>\n
the conclusions arrived at by the learned Sessions<\/p>\n
CRRP 981\/00               9<\/span><\/p>\n
Judge are not valid and reasonable conclusions that<\/p>\n
could be taken on a proper appreciation of the<\/p>\n
evidence. In any case, appreciation of evidence<\/p>\n
cannot be said to be perverse. When the view taken<\/p>\n
by    the   learned   Sessions   Judge   was   after<\/p>\n
appreciation of evidence and it is a reasonable<\/p>\n
view,     no interference  is   warranted  in   this<\/p>\n
revision.\n<\/p>\n
     Revision fails and is dismissed.<\/p>\n
