Whether the judgment should be reported in the Digest?\n\n\nKANWALJIT SINGH AHLUWALIA, J.\n<\/pre>\n<p>             Cancer Peerat Kissan (farmers) Committee has filed present<\/p>\n<p>writ petition projecting misery, which has befallen upon farmers of<\/p>\n<p>Mukatsar and Bathinda Districts of Punjab.\n<\/p>\n<p>             With science and technology having become an inseparable<\/p>\n<p>part of the daily life, the creation of scientific awareness among the<\/p>\n<p>masses has become all the more important now than ever before.<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                     2<\/span><\/p>\n<p>Therefore, present writ petition raises an important question of human<\/p>\n<p>concern regarding excessive use of pesticides. There is no doubt that<\/p>\n<p>pesticides have hazardous health effects and though beneficial to the<\/p>\n<p>agriculture sector and in vector bone disease control, pesticides can be<\/p>\n<p>source of many diseases and deterioration of human health.<\/p>\n<p>              By way of present writ petition, in the form of public interest<\/p>\n<p>litigation, we have been called upon to issue directions to the State of<\/p>\n<p>Punjab to take effective preventive steps to save the ruralities of Bathinda<\/p>\n<p>and Muktsar districts from affliction of deadly disease of cancer and<\/p>\n<p>provide necessary medical treatment, amenities and care to the suffering<\/p>\n<p>families. Petitioner, Cancer Peerat Kissan Committee has urged that<\/p>\n<p>residents of various villages of Muktsar and Bathinda Divisions are<\/p>\n<p>suffering from deadly disease of cancer, which has taken a heavy toll of<\/p>\n<p>human lives. It is stated that the ground water in the area is having high<\/p>\n<p>fluoride and selenium contents and has contributed to rise of cancer<\/p>\n<p>disease and has caused agony and trauma. A grievance has been made<\/p>\n<p>that State of Punjab has not taken effective steps to alleviate the suffering<\/p>\n<p>of farmers and there is lack of necessary medical expertise and facilities to<\/p>\n<p>cope up with effects of the dreaded disease. It is depicted in the writ<\/p>\n<p>petition that there are no facilities available in the area for treatment of<\/p>\n<p>cancer.\n<\/p>\n<p>              In the written statement filed by the Additional Director, Health<\/p>\n<p>and Family Welfare Department, Punjab on behalf of the Govt. of Punjab,<\/p>\n<p>it has been stated that in order to curb and check the growing incidents of<\/p>\n<p>incurable disease like cancer, a High Powered Committee was constituted<\/p>\n<p>for implementation of necessary measures and to review and monitor the<\/p>\n<p>grave situation from time to time. In the reply, it is averred that a special<\/p>\n<p>campaign was launched to impart knowledge to people about the early<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                    3<\/span><\/p>\n<p>symptoms, preventive measures and treatment of cancer disease by<\/p>\n<p>holding rallies with the participation of school children at Block, Tehsil and<\/p>\n<p>District level. A study was also undertaken by expert group under the<\/p>\n<p>Chairmanship of eminent agriculture scientist and medical specialist, Dr.<\/p>\n<p>S.S.Johl, Vice Chairman, Punjab State Planning Board and Dr.<\/p>\n<p>K.K.Talwar, Director PGIMER, Chandigarh. Punjab Agricultural University<\/p>\n<p>carried investigative study on contamination of drinking water, soil and<\/p>\n<p>plants with poisonous heavy metals and pesticides as a potential cause of<\/p>\n<p>abnormally     high   incidence     of   cancer   in   south-western   Punjab.<\/p>\n<p>Furthermore, an epidemiological study of cancer cases reported from the<\/p>\n<p>villages of Talwandi Sabo Block in District Bathinda and Chamkaur Sahib<\/p>\n<p>Block of District Ropar was conducted by Department of Community<\/p>\n<p>Medicine, PGIMER, Chandigarh. Centre for Science and Environment,<\/p>\n<p>New Delhi undertook analysis of pesticide residues in blood samples in<\/p>\n<p>State of Punjab. Directorate of Health Services and Family Welfare<\/p>\n<p>launched a study regarding pesticides prevalence in human blood and<\/p>\n<p>urine in Punjab. Furthermore, a survey of cancer patients was also<\/p>\n<p>conducted by the Department in four districts of Punjab, Mansa, Muktsar,<\/p>\n<p>Bathinda and Faridkot. Some of the findings of these committees can be<\/p>\n<p>summed up as under:\n<\/p>\n<blockquote><p>       (a) Excessive use of pesticides in the area of cotton crop was<\/p>\n<p>           considered as one possibility but the study concluded that the<\/p>\n<p>           sample size of the study was too small to make any definite<\/p>\n<p>           conclusion.<\/p>\n<blockquote><p>       (b) In the shallow hand pumps, contents of arsenic was found more<\/p>\n<p>           than the permissible limit, a possible cause, due to disposal of<\/p>\n<p>           industrial waste was not ruled out.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                         4<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>       (c) The study taken by PGIMER, Chandigarh revealed that higher<\/p>\n<p>              prevalence of cancer was due to residues of pesticides found in<\/p>\n<p>              the drinking water.\n<\/p><\/blockquote>\n<blockquote><p>       (d) The study conducted by Centre for Science and Environment,<\/p>\n<p>              New Delhi showed that the level of pesticides in the blood of<\/p>\n<p>              people from rural Punjab was very high and was further<\/p>\n<p>              contaminated with newer OP pesticides. It was noted by one of<\/p>\n<p>              the committees that the prevalence of cancer in the Districts of<\/p>\n<p>              Muktsar and Bathinda is higher than national average.<\/p>\n<\/blockquote>\n<p>Following recommendations were made by the committee:<\/p>\n<blockquote><p>      (i)              In depth study to know the exact causes and incidents<\/p>\n<p>                       of cancer, specifically in relation to the use of pesticides<\/p>\n<p>                       be undertaken.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)             Subsidized Medi-claim Policy to the extent of 50% of<\/p>\n<p>                       the premium should be made available for the cancer<\/p>\n<p>                       patients below poverty line and other poor people.<\/p>\n<\/blockquote>\n<blockquote><p>      (iii)            Educational and informative campaigns should be<\/p>\n<p>                       initiated to make people aware for taking necessary<\/p>\n<p>                       precautions and protective measures, i.e. use of Mask<\/p>\n<p>                       and Gloves etc. while spraying the pesticides.<\/p><\/blockquote>\n<p>                Arguments of this case were heard at length on December<\/p>\n<p>12, 2008. Taking into consideration the arguments advanced by counsel<\/p>\n<p>for the parties, this Court formulated a view that in order to provide<\/p>\n<p>immediate relief and to ameliorate the cause of sufferers, to provide care<\/p>\n<p>to the cancer patients, following preventive and remedial measures ought<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                         5<\/span><\/p>\n<p>to be taken by the State Govt. Thus, the order dated December 12, 2008<\/p>\n<p>read as under:\n<\/p>\n<blockquote><p>              &#8220;Mr. Amol Rattan Singh has filed an additional affidavit<br \/>\n       sworn by the Joint Director (Health), Government of Punjab,<br \/>\n       Chandigarh. A reading of the said affidavit shows that a<br \/>\n       number of steps are being taken to grapple with the problem<br \/>\n       arising out of wide spread of cancer presumably on account of<br \/>\n       underground pollution caused by use of pesticides. Details of<br \/>\n       the steps allegedly taken however need to be verified as the<br \/>\n       same have not been set out in the affidavit. We, therefore,<br \/>\n       direct the Government of Punjab to place on record:-\n<\/p><\/blockquote>\n<blockquote><p>              (i)     the steps that have been taken by Punjab<br \/>\n                      Infrastructure Development Board (PIDB) so far in<br \/>\n                      regard to the setting up of Super Specialty<br \/>\n                      Cancer Centre at Bhatinda under the proposed<br \/>\n                      public private partnership and the time frame<br \/>\n                      within which the proposed Super Specialty<br \/>\n                      Hospital will come up at Bhatinda;\n<\/p><\/blockquote>\n<blockquote><p>              (ii)    the government shall also indicate the reasons<br \/>\n                      why the supply of the machine meant for the<br \/>\n                      proposed Mammography Unit in the Mobile<br \/>\n                      Medical Unit at Bhatinda District Hospital is being<br \/>\n                      delayed and what action has been taken to<br \/>\n                      expedite the said supply;\n<\/p><\/blockquote>\n<blockquote><p>              (iii)   the government shall indicate as to what norms<br \/>\n                      have been framed for declaring the patients<br \/>\n                      below the poverty line to be able to take financial<br \/>\n                      assistance    under      the   State   Illness   Fund<br \/>\n                      established by it;\n<\/p><\/blockquote>\n<blockquote><p>              (iv)    The State Public Health Laboratory, Chandigarh<br \/>\n                      shall file a report as to the number of tests<br \/>\n                      conducted in respect of Water Quality to detect<br \/>\n                      poisons like Arsenic, Copper, Cyanide and<br \/>\n                      Chromium in different regions of the State and the<br \/>\n                      results of such tests;\n<\/p><\/blockquote>\n<blockquote><p>              (v)     report of the team of experts constituted by the<br \/>\n                      Government of India for setting up of a Regional<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                       6<\/span><\/p>\n<p>                      Cancer Centre at Government Medical College,<br \/>\n                      Amritsar shall be placed on the record;\n<\/p><\/blockquote>\n<blockquote><p>              (vi)    The Principal, Government Medical College,<br \/>\n                      Amritsar shall submit a status report as regards<br \/>\n                      the construction of the Regional Cancer Centre<br \/>\n                      Building at Amritsar and the process undertaken<br \/>\n                      for purchase of equipment which according to the<br \/>\n                      affidavit was started in May\/June, 2008. The<br \/>\n                      delay if any in the purchase of equipment shall<br \/>\n                      also be indicated together with the time frame<br \/>\n                      within which the equipment shall be installed;\n<\/p><\/blockquote>\n<blockquote><p>              (vii)   The Principal, Government Medical College,<br \/>\n                      Patiala shall report whether the Brachy Therapy<br \/>\n                      Machine has been installed and is functional. If it<br \/>\n                      is not the reason why the machine has not been<br \/>\n                      made functional shall be indicated. The process<br \/>\n                      for the purchase of Simulator and Mammography<br \/>\n                      Unit is said to have been started. The reasons for<br \/>\n                      the delay if any in the completion of that process<br \/>\n                      shall also be indicated; and\n<\/p><\/blockquote>\n<blockquote><p>              (viii) The Principal, Government Medical College,<br \/>\n                      Faridkot shall report whether the construction of<br \/>\n                      the building and purchase of equipment has<br \/>\n                      started? If the same has not been started, the<br \/>\n                      reasons for the same shall also be indicated.\n<\/p><\/blockquote>\n<blockquote><p>              (ix)    Similarly, the Principal of Shri Guru Ram Dass<br \/>\n                      Institute of Medical Sciences and Research,<br \/>\n                      Amritsar shall report whether Cobalt Radioactive<br \/>\n                      Source has been delivered by the supplier? If not,<br \/>\n                      the reasons for the delay together with the time<br \/>\n                      frame within which the machine shall be received<br \/>\n                      and installed, shall be given;\n<\/p><\/blockquote>\n<blockquote><p>              (x)     Director, PGI, Chandigarh shall report whether<br \/>\n                      the regional cancer centre for Punjab in the PGI,<br \/>\n                      is functioning satisfactorily and if there are any<br \/>\n                      deficiencies, the nature of such deficiencies and<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                    7<\/span><\/p>\n<p>                     the need if any for augmentation of the man<br \/>\n                     power and machinery required shall be identified.<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              The needful shall be done in terms of the above<br \/>\n       expeditiously but not later than six weeks from today.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>              In compliance with the order dated December 12, 2008,<\/p>\n<p>additional affidavit has been filed by the Joint Director, Office of Health<\/p>\n<p>Services, Punjab on behalf of State of Punjab and the Director, Health<\/p>\n<p>Services, Punjab, Chandigarh. It enumerates following steps taken by the<\/p>\n<p>Department to combat the menace of cancer:\n<\/p><\/blockquote>\n<blockquote><p>       1)            Govt. has taken effective steps and has signed an<\/p>\n<p>                     agreement with M\/s Max Lifecare for establishing<\/p>\n<p>                     Greenfield Super Specialty Hospitals at Bathinda and<\/p>\n<p>                     Mohali. To facilitate setting up of such hospitals,<\/p>\n<p>                     necessary paper work has been executed and<\/p>\n<p>                     concessions have been also granted to the operator of<\/p>\n<p>                     the hospitals, besides appointment of M\/s IL&amp;FS IDC<\/p>\n<p>                     as Project Developers.\n<\/p><\/blockquote>\n<blockquote><p>       2)            It was stated that Mobile Medical Unit having<\/p>\n<p>                     Mammography Unit at Bathinda was not feasible but a<\/p>\n<p>                     Mammography Unit has been set up at Civil Hospital,<\/p>\n<p>                     Bathinda and same is currently operational.<\/p>\n<\/blockquote>\n<blockquote><p>       3)            Through     the    aegis   of   Punjab   Health   System<\/p>\n<p>                     Corporation, the State Illness Fund Scheme has been<\/p>\n<p>                     implemented to provide assistance to the below<\/p>\n<p>                     poverty line families. The beneficiaries also include<\/p>\n<p>                     persons who, on the basis of survey conducted by the<\/p>\n<p>                     Department of Panchayati Raj and Rural Development<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                            8<\/span><\/p>\n<p>                     and State Urban Development Authority under Local<\/p>\n<p>                     Govt., have been issued Yellow Cards.<\/p>\n<\/blockquote>\n<blockquote><p>       4)            The State Laboratory has been performing qualitative<\/p>\n<p>                     testing of potable water and testing kits for the<\/p>\n<p>                     quantitative testing, of water samples regarding<\/p>\n<p>                     presence of Arsenic, Copper, Cyanide and Chromium,<\/p>\n<p>                     were issued. Some of the samples of potable water<\/p>\n<p>                     had failed and efforts are being made that the potable<\/p>\n<p>                     water available is within the permissible limits as per IS<\/p>\n<\/blockquote>\n<blockquote><p>                     &#8211; 10500: Drinking Water Specifications 1991.<\/p>\n<\/blockquote>\n<blockquote><p>       5)            For establishing Regional Cancer Centre at Govt.<\/p>\n<\/blockquote>\n<blockquote><p>                     Medical     College,      Amritsar,   Govt.   of    India   had<\/p>\n<p>                     constituted a team of expert Doctors, which opined that<\/p>\n<p>                     establishment of Regional Cancer Centre at Govt.<\/p>\n<p>                     Medical College, Amritsar is technically and realistically<\/p>\n<p>                     possible.\n<\/p><\/blockquote>\n<blockquote><p>       6)            That the building for Regional Cancer Centre is under<\/p>\n<p>                     construction       at   Guru    Nanak   Hospital,     Amritsar.<\/p>\n<p>                     Machinery and equipment for the treatment of cancer<\/p>\n<p>                     patients is in the process of being purchased.<\/p>\n<\/blockquote>\n<blockquote><p>       7)            That the Brachy Therapy Machine has been installed at<\/p>\n<p>                     Govt. Medical College, Patiala on 14th December,<\/p>\n<p>                     2007      and      same    is   functioning   properly      and<\/p>\n<p>                     satisfactorily. Furthermore, Govt. of India has released<\/p>\n<p>                     central assistance to the tune of Rs.2.00 crores for<\/p>\n<p>                     purchase of simulator and treatment planning system.<\/p>\n<p>                     Process is on to purchase simulator and treatment<\/p>\n<p>                     planning system. Furthermore, active steps have been<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                  9<\/span><\/p>\n<p>                     taken for purchase of Mammography Unit for Medical<\/p>\n<p>                     College, Patiala.\n<\/p><\/blockquote>\n<blockquote><p>       8)            A sum of Rs.47.00 lakhs has been released by PWD<\/p>\n<p>                     authorities at Faridkot for construction of building of<\/p>\n<p>                     Radiotherapy Block at Govt. Medical College, Faridkot<\/p>\n<p>                     and purchase order for procuring Cobalt Unit has been<\/p>\n<p>                     placed with the supplier.\n<\/p><\/blockquote>\n<blockquote><p>       9)            Sri Guru Ram Das Rotary Cancer Hospital, Amritsar<\/p>\n<p>                     has placed an order for purchase of Cobalt Source to<\/p>\n<p>                     BRIT (Board of Radiation and Isotope Technology) and<\/p>\n<p>                     an advance amount has been also sent to the<\/p>\n<p>                     manufacturer.\n<\/p><\/blockquote>\n<blockquote><p>       10)           PGIMER, Chandigarh was recognized as Regional<\/p>\n<p>                     Cancer Centre in March 2005 by Ministry of Health and<\/p>\n<p>                     Family Welfare, Govt. of India to cater to UT,<\/p>\n<p>                     Chandigarh and the State of Punjab.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              In the affidavit so filed, it has been further stated that the<\/p>\n<p>Department is conscious of certain deficiencies and requirements for<\/p>\n<p>achieving an ideal set up. It further states that subject to availability of<\/p>\n<p>funds from the Govt. or from National Cancer Control Programme,<\/p>\n<p>necessary facilities will be upgraded and augmented from time to time and<\/p>\n<p>the Department shall continue to work to overcome the deficiencies or<\/p>\n<p>cure the shortcomings for providing service to the cancer patients.<\/p><\/blockquote>\n<p>              Since, nobody had appeared for the petitioner, Mr.Amit<\/p>\n<p>Jhanjhi was appointed as Amicus Curiae. Mr. Amit Jhanjhi has expressed<\/p>\n<p>satisfaction over the steps taken by the State Government to improve the<\/p>\n<p>necessary medical care to the patients of cancer.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Writ Petition No. 11425 of 2005                                    10<\/span><\/p>\n<p>              Mr. Rupinder Khosla appearing for the State has also assured<\/p>\n<p>that the State Govt. is concerned regarding the growing incidents of<\/p>\n<p>incurable disease like cancer and its effects, therefore, from time to time<\/p>\n<p>future action plan and strategies shall be drawn to check the incidents of<\/p>\n<p>cancer disease and provide better medical care to the sufferers of the<\/p>\n<p>disease.\n<\/p>\n<p>              Taking into consideration the steps taken by the Govt. of<\/p>\n<p>Punjab, satisfaction expressed by the Amicus Curiae and assurance given<\/p>\n<p>by the State Counsel, we are of the view that further monitoring by this<\/p>\n<p>Court is not required and the present writ petition can be disposed of with<\/p>\n<p>the direction to the State Govt. to continue with its endeavour to take<\/p>\n<p>preventive measures to contain re-occurrence of cancer disease and<\/p>\n<p>educate and make people at large aware regarding ill effects of over-use<\/p>\n<p>of pesticides. We are conscious of the fact that prevention and remedial<\/p>\n<p>measures are an on-going process. Therefore, as and when the need<\/p>\n<p>arises, this Court can be approached for further directions by filing a<\/p>\n<p>separate writ petition detailing ground realities. The petition is accordingly<\/p>\n<p>disposed of with the above observation leaving the parties to bear their<\/p>\n<p>own costs.<\/p>\n<pre>\n\n\n\n    [T. S.
