JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nApplication under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the Limitation Act is filed by the<br \/>\nappellant for condonation of delay of 718 days occurred in filing the<br \/>\nabove Letters Patent Appeal.\n<\/p>\n<p id=\"p_1\">\tThe<br \/>\nimpugned judgment was delivered by the learned Single Judge on 4th<br \/>\nFebruary 2008. On 21st January 2009, the appellant applied<br \/>\nfor certified copy of the judgment. It was notified on 31st<br \/>\nJanuary 2009. The appellant took the delivery on 20th<br \/>\nFebruary 2009. The Appeal was filed on 18th February 2010.\n<\/p>\n<p id=\"p_2\">\tIt<br \/>\nis the case of the appellant that while dismissing the writ petition,<br \/>\nthe learned Single Judge did observe that the appellant may approach<br \/>\nthe concerned authority to retain promotion on the post of senior<br \/>\nclerk. The appellant, therefore, first approached the concerned<br \/>\nauthority to retain his promotion. After the said representation was<br \/>\nrejected on 19th September 2008, the appellant took steps<br \/>\nfor filing the Appeal. Some time was spent for arranging for the<br \/>\nfees, for receipt of the certified copy of the judgment, for transfer<br \/>\nof papers and for preparation of the appeal memo.\n<\/p>\n<p id=\"p_3\">\tWe<br \/>\nare not at all satisfied. First, the appellant, having availed of the<br \/>\nbenefit of the observations made by the learned Single Judge in<br \/>\nrespect of the promotion of the appellant as senior clerk, filing of<br \/>\nthe Appeal is an afterthought. Besides, after the rejection of the<br \/>\nrepresentation in the month of September 2008, the Appeal was not<br \/>\nfiled for another 16 months until the month of February 2010. The<br \/>\nsaid delay of 16 months is not explained.\n<\/p>\n<p id=\"p_4\">\tLearned<br \/>\nadvocate Mr.Thakar has addressed the Court also on merits. Mr.Thakar<br \/>\nhas submitted that the appellant was promoted as Deputy Chitnis in<br \/>\nthe office of the Development Commissioner in the year 1980. Having<br \/>\ncontinued as Deputy Chitnis for more than 14 years, he was called<br \/>\nupon to pass the departmental examination as envisaged by the Deputy<br \/>\nChitnis (Departmental Examination) Rules, 1994 (hereinafter referred<br \/>\nto as  the Rules of 1994 )<br \/>\n. He has submitted that the Rules of 1994 cannot govern the<br \/>\nservice condition of the appellant who had already been promoted as<br \/>\nDeputy Chitnis. The Rules of 1994 are prospective in nature. They<br \/>\napply to the persons who were yet to be appointed as Deputy Chitnis.<br \/>\n\tHe has also submitted that the appellant did take the departmental<br \/>\nexamination twice but could not clear the examination.\n<\/p>\n<p id=\"p_5\">\tPrima<br \/>\nfacie, we do not agree with Mr.Thakar. Sub rule (3) of rule 1 of the<br \/>\nRules of 1994 make the rules specifically applicable  &#8230;to the<br \/>\npersons appointed as Deputy Chitnis (State Service) in the<br \/>\noffice of the Development Commissioner and as Deputy Chitnis in the<br \/>\noffice of the Gujarat Panchayat Service Selection Board.<br \/>\nFurther, the learned Single Judge has also noted that the appellant<br \/>\nwas promoted as Deputy Chitnis on adhoc basis  subject to<br \/>\npassing of the examination which is prescribed&#8230;. such promotions<br \/>\nare to be governed by condition of passing the departmental<br \/>\nexamination.  Learned<br \/>\nadvocate Mr.Thakar has not been able to refute the conditions of the<br \/>\npromotion of the appellant.\n<\/p>\n<p id=\"p_6\">\tIn<br \/>\nanswer to the representation made by the appellant, the Development<br \/>\nCommissioner has observed that the appellant had been granted<br \/>\npromotion as Deputy Chitnis from the post of Gujarati Typist on<br \/>\ncondition that the appellant had to pass the departmental examination<br \/>\nfor promotion to the post of Deputy Chitnis. Admittedly, the<br \/>\nappellant failed to pass the departmental examination for promotion<br \/>\nto the post of Deputy Chitnis.\n<\/p>\n<p id=\"p_7\">\tOn<br \/>\nmerits also, we agree with the learned Single Judge that the<br \/>\nappellant was required to pass the departmental<br \/>\nexamination for promotion to the post of Deputy Chitnis as envisaged<br \/>\nby the Rules of 1994.\n<\/p>\n<p id=\"p_8\">\tAs<br \/>\nthe appellant has failed to explain the delay satisfactorily and also<br \/>\nto make out a prima facie case on merits, this Application is<br \/>\nrejected. Rule is discharged.
