       The appellant is the claimant in         OP(MV) 1702\/2000 on the<\/p>\n
file of the    Motor Accidents Claims Tribunal, Muvattupuzha.            He<\/p>\n
sustained the following injuries when the car           bearing registration<\/p>\n
No.KL-7\/AA 6767 in which he was travelling hit against an electric post<\/p>\n
on the side of the road and capsized on Kurikunnam – Piravathanam<\/p>\n
road on November 19, 2000 at about 8.30 p.m.:\n<\/p>\n
      “Lacerated wound on the left frontal region extending to the mid<\/p>\n
      line.\n<\/p><\/blockquote>\n
      Multiple lacerations over the face.<\/p>\n
      Lacerated wound over the left wrist 8×2 cm.<\/p>\n
      Lacerated wound left hand extending from the wrist to the root<\/p>\n
      of the finger.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
Claiming a compensation of Rs.3 lakhs the claimant filed the OP before<\/p>\n
the Tribunal under Sec.166 of the Motor Vehicles Act alleging<\/p>\n
negligence against the 1st      respondent, who was the owner-cum-<\/p>\n
driver of the offending vehicle.\n<\/p>\n
      2.    Respondent No.1 in his written statement admitted the<\/p>\n

accident, but denied the liability.  The 2nd respondent, insurer of the<\/p>\n
offending vehicle, filed a written statement admitting the policy.<\/p>\n
       3.   This OP was jointly tried along with another OP filed by<\/p>\n
another injured person in the accident and a common award was<\/p>\n
passed.       PWs.1 and 2 were examined and       Exts.A1 to A20 were<\/p>\n
marked on the side of the claimant before the Tribunal.      Ext.B1 was<\/p>\n
marked on the side of the        respondents.    On an appreciation of<\/p>\n
evidence the Tribunal found that the accident occurred due to the<\/p>\n
negligence of the 1st respondent and awarded a total compensation<\/p>\n
of Rs.64000\/- with interest @ 6% per annum from the date of petition<\/p>\n
till realisation. The claimant has now come up in appeal challenging<\/p>\n
the quantum of compensation awarded by the Tribunal.<\/p>\n
       4.     Heard the counsel for the    appellant\/claimant and the<\/p>\n
counsel for the Insurance Company.\n<\/p>\n
       5.    The accident is not disputed.   The finding of the Tribunal<\/p>\n
that the accident occurred due to the negligence on the part of the 1st<\/p>\n
respondent is not challenged in this appeal.        Therefore the only<\/p>\n
question which arises for consideration is whether the claimant is<\/p>\n
entitled to any enhanced compensation.\n<\/p>\n
       6.      The break up of the compensation amount awarded is as<\/p>\n
under:<\/p>\n
\n\nM.A.C.A. 1423 of 2005\n                                   3<\/span>\n\nloss of earning                Rs.6000\/-\n\ntransportation                    2500\/-\n\ndamage to clothing                 500\/-\n\nextra nourishment                 1000\/-\n\ntreatment expenses               39000\/-\n\nattendant's expenses              1000\/-\n\npain and suffering                 8000\/-\n\nloss of amenities                  6000\/-\n\n\n\n       7.   Counsel for the claimant sought     compensation for the\n\n<\/pre>\n
disability caused and enhancement of the compensation for the pain<\/p>\n
and suffering endured by the claimant.          No compensation was<\/p>\n
awarded by the Tribunal for the disability caused to the claimant. The<\/p>\n
claimant suffered a permanent disability of 10% as seen from Ext.A12<\/p>\n
certificate issued from the hospital. Ext.A12 shows that “FDS tendon<\/p>\n
to little finger was severed and there was partial injury to FDS of<\/p>\n
middle finger and partial injury to median nerve and that the injured<\/p>\n
tendons were repaired”.     Therefore we feel that   the percentage of<\/p>\n
disability suffered by the claimant can be taken as 5%.    The Tribunal<\/p>\n
took the monthly income of the claimant as Rs.1500\/-. According to<\/p>\n
the claimant he was a           dental mechanic in A.J.Dental Lab,<\/p>\n
Koothattukulam, earning Rs.4000\/- per month. Ext.A16 is the copy of<\/p>\n
registration as dental mechanic issued by Tamil Nadu Dental Council.<\/p>\n

Ext.A17 shows that the claimant has undergone two year dental<\/p>\n
mechanic course at Sankarachariyar Dental College, Salem. Ext.A18 is<\/p>\n
the salary certificate.  Taking into consideration all these aspects, we<\/p>\n
feel that his monthly income can be reasonably fixed at Rs.3000\/-. A<\/p>\n
multiplier of 17 would be reasonable in this case as he was aged 24 at<\/p>\n
the time of the accident. Thus calculated, for the disability caused the<\/p>\n
claimant is entitled to a compensation of Rs.30600\/- (5% of 1500 x 12<\/p>\n
x 17).\n<\/p>\n
      8. The Tribunal      awarded Rs.8000\/- as the compensation for<\/p>\n
the pain and suffering endured by the claimant which appears to be<\/p>\n
very low.      Taking into consideration the nature of the injuries<\/p>\n
sustained,    we feel that   a compensation of Rs.10,000\/- would be<\/p>\n
reasonable on this count.      As regards the compensation awarded<\/p>\n
under other heads, we find the same to be reasonable and therefore<\/p>\n
we are not disturbing the same.\n<\/p>\n
      9. Thus the claimant is entitled to an additional compensation of<\/p>\n
Rs.32,600\/-.       The Tribunal awarded interest only at the rate of 6%<\/p>\n
per annum, which appears to be very low. He is entitled to interest @<\/p>\n
7.5% per annum for the compensation already awarded and for the<\/p>\n
enhanced compensation from the date of petition till realisation and<\/p>\n
proportionate cost.    The 2nd    respondent being the insurer of the<\/p>\n

\n                                  5<\/span><\/p>\n
offending vehicle shall deposit the amount before the Tribunal within<\/p>\n
two months from the date of receipt of a copy of this judgment. The<\/p>\n
award of the Tribunal is modified to the above extent.<\/p>\n
      The appeal is disposed of as found above.\n<\/p>\n
