Justice K.T.SANKARAN\n\n Dated :16\/09\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 5216 OF 2009\n             ------------------------------------------------------\n            Dated this the 16th day of September, 2009\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">       This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of<\/p>\n<p>the Code of Criminal Procedure. Petitioners are accused Nos.2 and<\/p>\n<p>3 in Crime No.2225 of 2009 of Aluva Police Station.<\/p>\n<p id=\"p_1\">       2.   The offence alleged against the petitioners are under<\/p>\n<p><a href=\"\/doc\/538436\/\" id=\"a_1\">Section 498A<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">       3.   Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor and perused the case diary.<\/p>\n<p id=\"p_3\">       4.  Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of the<\/p>\n<p>view that anticipatory bail can be granted to the petitioners. There<\/p>\n<p>will be a direction that in the event of the arrest of the petitioners, the<\/p>\n<p>officer in charge of the police station shall release them on bail on<\/p>\n<p>their executing bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>B.A. NO. 5216 OF 2009<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p id=\"p_4\">for the like amount to the satisfaction of the officer concerned,<\/p>\n<p>subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>      a)     The petitioners shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      b)     The petitioners shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      c)     The petitioners shall not commit any offence or indulge<br \/>\n             in any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      d)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p id=\"p_5\">\n<p id=\"p_6\">                                                   (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.M.
