Justice V.GIRI\n\n Dated :29\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">07\/2009\n\n O R D E R\n                            V.GIRI,J.\n                     -------------------------\n                W.P ( C) No<\/a>.18667 of 2009\n                     --------------------------\n               Dated this the 29th July,2009\n\n                       J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The sand being transported in the petitioner&#8217;s<\/p>\n<p>vehicle bearing Reg.No TN 43-B-8303 was seized on<\/p>\n<p>17.7.2009. Petitioner claims to be the power of attorney<\/p>\n<p>holder of the registered owner of the vehicle. According<\/p>\n<p>to the petitioner, the sand was purchased from an<\/p>\n<p>authorized dealer in Tamil Nadu, as evidenced by Ext.P5<\/p>\n<p>and therefore there was no justification for seizure of the<\/p>\n<p>vehicle.\n<\/p>\n<p id=\"p_1\">     2.   Learned Government Pleader, on instructions,<\/p>\n<p>submits that the sand in question is a river sand and it<\/p>\n<p>was being transported unauthorisedly. It is suspected<\/p>\n<p>that the receipt pass through the         check post is also<\/p>\n<p>bogus.   The issue is to be considered by the District<\/p>\n<p>Collector.\n<\/p>\n<p id=\"p_2\">     3.
