Of Pensions &amp; Pensioner&#8217;s Welfare<br \/>\nseeking the following information:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8216;1.    That I had requested Ms. Rajni Rajdan (sic), Secretary<br \/>\n             Pension &amp; Pensioner Welfare and AR&amp;PG Ministry of<br \/>\n             Personnel, Public grievances and pensions, Department<br \/>\n             of pension &amp; Pensioner Welfare Lok Nayak Bhawan Khan<br \/>\n             Market New Delhi-110003, vide my letter dated 25.9.2008<br \/>\n             (copy enclosed) requesting her to inform that at what<br \/>\n             stage, Govt. decision for applying multiplication factor of<br \/>\n             1.86 (on basic pension +dearness pension) where<br \/>\n             applicable &amp; dearness relief of 24% as on 1.1.2006 was<br \/>\n             dropped &amp; fitment benefit equal to 40% of the pension<br \/>\n             excluding effect of merger of 50% dearness allowance\/<br \/>\n             dearness relief on pension as recommended by 6th pay<br \/>\n             commission was ordered to be given effect as per<br \/>\n             resolution dated 29.8.2008 on the recommendation of 6th<br \/>\n             pay commission. My letter was delivered in the office of<br \/>\n             Ms. Rajni Rajdan on 26.9.2008.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2.     That I have submitted two reminders on 31.10.2008 &amp;<br \/>\n             11.12.2008. My reminder dated 11.12.2008 was received<br \/>\n             in the office on 12.12.2008.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      3.     I, humbly, request that information asked for by me may<br \/>\n             please be arranged to be supplied to me along with a<br \/>\n             copy of the decisions thereof.<\/p><\/blockquote>\n<p id=\"p_1\">      To this, appellant Shri Balwant Singh received a response on 10.2.2009<br \/>\nfrom CPIO Shri Harjit Singh, Under Secretary informing him as follows:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>        &#8220;There was no decision of the Government for applying<br \/>\n      multiplication factor of 1.86 &#8216;on basic pension +dearness<br \/>\n      pension and dearness relief of 24% as on 1.1.2006&#8217;. Therefore,<br \/>\n      there is no question of dropping any such decision. The Pay<br \/>\n      commission recommended that &#8216;all past pensioners should be<br \/>\n      allowed fitment benefit equal to 40% of the pension excluding<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      1<\/span><br \/>\n        the effect of merger of 50% dearness allowance\/ dearness relief<br \/>\n       as pension 9in respect of pensioners retiring on or after<br \/>\n       1.4.2004) and dearness pension (for other pensioners)<br \/>\n       respectively. The increase will be allowed by subsuming the<br \/>\n       effect of conversion of 50% of dearness relief\/ dearness<br \/>\n       allowance as dearness pension\/ dearness pay. Consequently,<br \/>\n       dearness relief at the rate of 74% on pension (excluding the<br \/>\n       effect of merger) has been taken for the purpose of computing<br \/>\n       revised pension as on 1.1.2006&#8242;. This recommendation was<br \/>\n       accepted by the government with the modification that fixation<br \/>\n       pension shall be based on a multiplication factor of 1.86 i.e.<br \/>\n       basic pension + dearness pension (wherever applicable) +<br \/>\n       dearness relief of 24% as on 1.1.2006, instead of 1.74 the<br \/>\n       manner of revision of pension of pre-2006 pensioners in the OM<br \/>\n       dated 1.9.2008 is in consonance with the decision of the<br \/>\n       government in the recommendation of the 6th Central Pay<br \/>\n       Commission, as contained in the Resolution dated 29.8.2008.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>       Aggrieved, however, Shri Balwant Singh moved an appeal before Shri M.\n<\/p><\/blockquote>\n<p id=\"p_2\">P. Singh, Director (PP), Department of Pensios &amp; Pensioners&#8217; Welfare pleading<br \/>\nas follows: &#8211;\n<\/p>\n<blockquote id=\"blockquote_5\"><p>       &#8220;The reply received on the subject is confusing as contents of<br \/>\n       Pension sentence and closing sentence of Para 2 are quite<br \/>\n       contradictive (sic).&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">       Upon this, Shri Balwant Singh received a response from Director (PP)<br \/>\nShri M. P. Singh dated 23.3.2009 dismissing the appeal as below: &#8211;\n<\/p>\n<blockquote id=\"blockquote_6\"><p>       &#8220;There is no contradiction in the reply given by the CPIO on<br \/>\n       10.2.2009. The matter for revision of pension as given in Para<br \/>\n       4.1 of the OM is in consonance with the decision of the<br \/>\n       government on the recommendations of the Sixth Pay<br \/>\n       commission. The figures of revised pension given in the ready<br \/>\n       reckoner (Annexure-I to the OM dated 1.9.2008) are based on<br \/>\n       the formula given in Para 4.1 of that OM. While arriving at the<br \/>\n       figure of revised pension in the ready reckoner, the elements of<br \/>\n       Dearness Pay, Dearness Relief and fitment benefit have been<br \/>\n       rounded off to the next higher rupee.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">       Appellant Shri Balwant Singh has then moved a second appeal before us<br \/>\nwith the following prayer: &#8211;\n<\/p>\n<blockquote id=\"blockquote_7\"><p>       &#8220;I may please be informed whether the modification of the<br \/>\n       Govt. against item 12 of pay commission report have been<br \/>\n       withdrawn\/withheld\/ ignored while faming rule 4.1<br \/>\n       prescribed regulation of fixation of revised pension of<br \/>\n       existing pensioners (office memorandum dated 1.9.2009<br \/>\n       under no. F.38\/37\/08 P&amp;PW (A) dated 1.9.2008). A copy of<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><br \/>\n       the authority for withdrawing\/ withholding the approval of<br \/>\n      govt. modification may please be supplied to me.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>      If rule 4.1 has been revised at some later date giving effect of<br \/>\n      Govt. approved modification against item 12 of pay<br \/>\n      commission recommendations, a copy of the revised rule 4.1<br \/>\n      (ibid) is supplied to me.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>      The appeal was heard on 7-7-2010. Only the following are present.<\/p><\/blockquote>\n<p id=\"p_5\">      Respondents<br \/>\n      Ms. Tripti P. Ghosh, Director<br \/>\n      Shri Harjit Singh, Under Secretary<\/p>\n<p>      Although informed of the date of hearing through our letter of 1.7.2010<br \/>\nappellant Shri Balwant Singh opted not to be present.\n<\/p>\n<p id=\"p_6\">                              DECISION NOTICE<\/p>\n<p>      The question of appellant Shri Balwant Singh in his initial application of<br \/>\n23.1.2009 seeking information on the stage at which the application of the<br \/>\nmultiplication factor was ordered to be given effect to has been clearly<br \/>\nanswered by CPIO Shri Harjit Singh informing Shri Balwant Singh that at no<br \/>\nstage was such a decision taken. What then Shri Balwant Singh has sought<br \/>\nthereafter, was a clarification of the rules made by Government, which he finds<br \/>\ncontradictory. This is not a role for the CPIO or the Appellate Authority under<br \/>\nthe <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a> to perform. Shri Balwant Singh has, as can be seen raised new<br \/>\nquestions at the level of the second appeal asking for copies of documents that<br \/>\nhe had not sought earlier. The role of this Commission is only to ensure that<br \/>\nsuch information as is held by or under the control of a public authority is<br \/>\nprovided by the CPIO when asked for. It does not extend to ordering disclosure<br \/>\nor supply of information that has not been asked for. For this purpose a citizen<br \/>\nrequires to approach the CPIO u\/s 6(1). In the present case, therefore, this<br \/>\nappeal is without merit under the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a> and is hereby dismissed.\n<\/p>\n<p id=\"p_7\">      Nevertheless, appellant Shri Balwant Singh is informed that should he<br \/>\nbe aggrieved by a perceived contradiction in the government stand on the<br \/>\nquestion of a multiplication factor, he is free to approach the grievance<br \/>\nredress machinery of Government accessible at www.pgportal.gov.in<br \/>\nadministered by the Centralized Public Grievance Redress and Monitoring<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                      3<\/span><br \/>\n System (CPGRSMS) under the Department of Administrative Reforms and<br \/>\nPublic Grievances.\n<\/p>\n<p id=\"p_8\">       Announced in the hearing.
