DAVE\n\t\t\n\t\n\n \n\nDate\n: 02\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Leave<br \/>\n\tto amend.\n<\/p>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tII-C.R. No.43\/2011 with Makarpura<br \/>\n\tPolice Station, Vadodara for the offences punishable under<br \/>\n\t<a href=\"\/doc\/1663045\/\" id=\"a_1\">Sections 8(C)<\/a>, (B), 20(B) and 29 of the <a href=\"\/doc\/1727139\/\" id=\"a_2\">NDPS Act<\/a>, 1985.\n<\/p>\n<p id=\"p_2\">Heard<br \/>\n\tlearned Counsels for the parties and perused the record.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tfollowing facts are taken into consideration:-\n<\/p>\n<p id=\"p_4\">(i)<br \/>\n\t\tIt is submitted that &#8216;muddamal&#8217;<br \/>\n\tarticle &#8211; Ganja weighing around 2 Kgs. and 700 grams worth<br \/>\n\tRs.16,200\/= was seized;\n<\/p>\n<p id=\"p_5\">(ii)<br \/>\n\tVide Notification S.O. 1055(E) dated 19.10.2001, published in<br \/>\n\tthe Gazette of India, dated 19.10.2001, issued by the Department of<br \/>\n\tRevenue, Ministry of Finance, Central Government, under the<br \/>\n\tprovisions of the <a href=\"\/doc\/1727139\/\" id=\"a_3\">NDPS Act<\/a>, Sr. No.55, Ganja, prescribes commercial<br \/>\n\tquantity as 20 Kg;\n<\/p>\n<p id=\"p_6\">(iii)<br \/>\n\tthe quantity in the present case is below the commercial quantity<br \/>\n\tprescribed;\n<\/p>\n<p id=\"p_7\">(iv)<br \/>\n\tthe punishment prescribed may extend upto 10 years and fine upto<br \/>\n\tRs.1,00,000\/=;\n<\/p>\n<p id=\"p_8\">(v)<br \/>\n\trigour of <a href=\"\/doc\/496325\/\" id=\"a_4\">Section 37<\/a> of the NDPS Act may not be applicable;\n<\/p>\n<p id=\"p_9\">(vi)<br \/>\n\tthere are no past antecedents,<\/p>\n<p>Considering<br \/>\n\tthe above, without discussing the evidence in detail, prima facie<br \/>\n\tthis Court is of the opinion that this is a fit case to exercise the<br \/>\n\tdiscretion to enlarge the applicant on bail.\n<\/p>\n<p id=\"p_10\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as II-C.R. No.43\/2011<br \/>\n\twith Makarpura Police Station, Vadodara on executing a bond<br \/>\n\tof Rs.5,000\/- (Rupees Five Thousand Only) with one surety of the<br \/>\n\tlike amount to the satisfaction of the Trial Court and subject to<br \/>\n\tthe conditions that he shall;\n<\/p>\n<p id=\"p_11\">a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_12\">b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_13\">c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_14\">d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p id=\"p_15\">e)<br \/>\n\tmark presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of every English Calendar month between<br \/>\n\t11.00 a.m. to 2.00 p.m. for three months only;\n<\/p>\n<p id=\"p_16\">f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_17\">The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_18\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_19\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_20\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_21\">Rule<br \/>\n\tmade absolute.
