SIRI JAGAN, J.\n                ------------------------------------\n                   W.P.(C)No.16755 OF 2008\n              ----------------------------------------\n                 Dated this the 17th day of July, 2008\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The    petitioner   challenges     proceedings    under     the<\/p>\n<p>Securitisation and Reconstruction of           Financial Assets and<\/p>\n<p><a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a> 2002.            The petitioner<\/p>\n<p>submits that they are prepared to pay the entire defaulted<\/p>\n<p>instalments with interest and costs and they are prepared to<\/p>\n<p>undertake to pay the future instalments as per the loan<\/p>\n<p>agreement without default on the due dates.<\/p>\n<p id=\"p_1\">      2.   This is stoutly opposed by the learned Standing<\/p>\n<p>Counsel for the respondents.        He would point out that once<\/p>\n<p>account is declared as NPA, the entire amount becomes due as a<\/p>\n<p>whole and the bank cannot permit the petitioner to pay the<\/p>\n<p>instalments as per original loan agreement, by regularising the<\/p>\n<p>account on payment of defaulted instalments.<\/p>\n<p id=\"p_2\">      3.   I have considered the rival contentions in detail. At<\/p>\n<p>the time of admission, I had directed the petitioner to pay an<\/p>\n<p>amount of Rs.25 lakhs within one month.            The petitioner has<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(c)No.16755\/08                2<\/span><\/p>\n<p>promptly paid the same.\n<\/p>\n<p id=\"p_3\">      In the above circumstances, I am inclined to direct the<\/p>\n<p>respondents to grant some indulgence to the petitioner in the<\/p>\n<p>matter of regularisation of their loan account and payment of<\/p>\n<p>future instalments as per the loan agreement.         Accordingly,<\/p>\n<p>this writ petition is disposed of with the following directions.<\/p>\n<p id=\"p_4\">      If the petitioner pays the balance amounts, if any due<\/p>\n<p>after adjusting the Rs.25 lakhs for paying off the defaulted<\/p>\n<p>instalments with interest and costs within one month, the<\/p>\n<p>respondents shall regulrise the loan accounts of the petitioner.<\/p>\n<p>The petitioner shall thereafter pay the future instalments as<\/p>\n<p>per the loan agreement on the due dates mentioned in the<\/p>\n<p>loan agreement without fail. If the petitioner complies with<\/p>\n<p>the above direction, further proceedings shall be kept in<\/p>\n<p>abeyance. However, if the petitioner fails to pay the amount,<\/p>\n<p>if any, required to regularise the loan account or any of the<\/p>\n<p>future instalments on the due date, it would be open to the<\/p>\n<p>respondents to continue proceedings as now initiated without<\/p>\n<p>having to issue any fresh notice or proceedings in that regard.<\/p>\n<p>I further make it clear that if the Rs.25 lakhs paid by the<\/p>\n<p>petitioner is more than the amounts required to regularise the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(c)No.16755\/08             3<\/span><\/p>\n<p>loan account as directed above, the balance shall be adjusted<\/p>\n<p>against the future instalments.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                     S.
