SANKARAN, J.\n\n             ---------------------------------\n\n                   CRL.R.P.NO. 4284 OF 2006\n\n          ---------------------------------\n\n        Dated this the 7th day of December,2006\n\n\n\n                                 O R D E R\n<\/pre>\n<p>     The   petitioner   filed   a   complaint   against   the<\/p>\n<p>first respondent alleging offence under Section 138<\/p>\n<p>of   the   Negotiable   Instruments   Act.     By   the   order<\/p>\n<p>dated   11th  August,   2006,   the   court   below   dismissed<\/p>\n<p>the   complaint   under   Section   204(4)   of   the   Code   of<\/p>\n<p>Criminal   Procedure   on   the   ground   that   the   postage<\/p>\n<p>for   issue   of   summons   was   not   paid.     That   order   is<\/p>\n<p>impugned in this Revision.\n<\/p>\n<p>     2.        It   is   stated   in   paragraph   2   of   the<\/p>\n<p>statement of facts in the Revision thus:\n<\/p>\n<blockquote><p>             &#8220;..   As   the   accused   was   not   responded<\/p>\n<p>     to the summons, the Hon&#8217;ble Magistrate was<\/p>\n<p>     pleased   to   issue   a   warrant   to   the   accused<\/p>\n<p>     through   the   Chavakad   Police   Station.     But<\/p>\n<p>     the   Police   of   Chavakad   Police   station   has<\/p>\n<p>     failed to arrest the accused or return the<\/p>\n<p>     warrant.                    Therefore,         the         Hon&#8217;ble<\/p>\n<p>     Magistrate was pleased to issue summons to<\/p>\n<p>     the   Head   Constable   of   the   Police   Station<\/p>\n<p>     and the matter posted to 11\/8\/2006.&#8221;<\/p>\n<\/blockquote>\n<p>CRL.R.P. NO.4284 OF 2006<\/p>\n<p>                                 ::  2  ::\n<\/p>\n<p>It   is   also   stated   in   the   Memorandum   of   Revision<\/p>\n<p>that the process fee was paid on 17.7.2006.\n<\/p>\n<p>        In   the   facts   and   circumstances   of   the   case,   I<\/p>\n<p>am of the view that an opportunity should be given<\/p>\n<p>to the petitioner to pay the process fee, if he has<\/p>\n<p>not   already   paid   the   same,   and   take   all   necessary<\/p>\n<p>steps   which   are   required   under   law.       The   order<\/p>\n<p>impugned   is   set   aside.
