     This miscellaneous petition has been filed against the<\/p>\n
order dated 14.01.2015 passed by the learned District &<\/p>\n
Sessions Judge, Jodhpur District dismissing the Criminal<\/p>\n
Revision Petition No.52\/2014 preferred against the order<\/p>\n
dated 18.12.2014 passed by the learned Chief Judicial<\/p>\n
Magistrate, Jodhpur District in Criminal Case No.68\/2011<\/p>\n
whereby the application filed by the petitioner under<\/p>\n
Section 311<\/a> Cr.P.C. for calling Shri Dalbir Bharti, DCP<\/p>\n
Headquarter and District Magsitrate, Mumbai as defence<\/p>\n
witness was dismissed.\n<\/p>\n
     The brief facts of the case are that on 15.10.1998,<\/p>\n
one Shri Lalit Bora filed a report at P.S. Luni, Jodhpur<\/p>\n
against the petitioner stating that the petitioner hunted<\/p>\n
two black bucks by using illegal fire arms in the mid-night
\n                                {2}<\/p>\n
of 1-2 October, 1998 at Village Kakani. On the basis of the<\/p>\n
above report, an FIR was registered against the petitioner<\/p>\n
for the offences under Sections 3<\/a>\/25<\/a> and 27<\/a> of the Arms<\/p>\n
Act. After investigation, charge-sheet was filed and charges<\/p>\n
were   framed.     After   examination   of   16     prosecution<\/p>\n
witnesses, the statements of petitioner-accused were<\/p>\n
recorded under Section 313<\/a> Cr.P.C. and after examination<\/p>\n
of one Berisal Singh (DW-1) as defence witness, the<\/p>\n
defence evidence was closed and the matter was fixed for<\/p>\n
16.12.2014   for   final   arguments,    on   that    date,   an<\/p>\n
application under Section 311<\/a> Cr.P.C. was moved on behalf<\/p>\n
of the petitioner before the learned trial court stating<\/p>\n
therein that on 29.09.1999, the licensing authority issued<\/p>\n
show cause notice to the petitioner to the effect as to why<\/p>\n
his Arm License No.MU-926\/August\/96 should not be<\/p>\n
cancelled to which the petitioner filed reply. It was<\/p>\n
submitted that as per the notice, the license of the<\/p>\n
petitioner was valid till 29.09.1999 and was in force. Thus,<\/p>\n
it was prayed that the said authority, viz., Shri Dalbir<\/p>\n
Bharti, DCP, Police HQ and District Magistrate, Mumbai be<\/p>\n
called as defence witness. The said application was<\/p>\n
dismissed and revision petition was also dismissed. Hence,<\/p>\n
this miscellaneous petition.\n<\/p>\n

     I have heard the learned counsel for the petitioner<\/p>\n
and the learned Public Prosecutor.\n<\/p>\n
     Learned counsel for the petitioner submits that the<\/p>\n
charges against the petitioner are that he kept in<\/p>\n
possession and used unlicensed fire arms, therefore, to<\/p>\n
prove that the license was effective on the date of<\/p>\n
offence, it is necessary in the interest of justice that notice<\/p>\n
issued by the licensing authority be proved before the<\/p>\n
learned trial court after calling Shri Dalbir Bharti, DCP,<\/p>\n
Police HQ and District Magistrate, Mumbai. Both the<\/p>\n
learned    courts   below   have     wrongly    dismissed   the<\/p>\n
application. In absence of examination of the said witness,<\/p>\n
it is not possible for the petitioner to defend himself.<\/p>\n
Therefore, this miscellaneous petition may be allowed.<\/p>\n
     In the alternative, the learned counsel for the<\/p>\n
petitioner submits that if the prosecution admits the<\/p>\n
genuineness of the notice and the trial court considers the<\/p>\n
same during final arguments, then this miscellaneous<\/p>\n
petition may be decided accordingly.\n<\/p>\n
     The     learned   Public      Prosecutor   opposed     this<\/p>\n
miscellaneous petition and submitted that so far as the<\/p>\n
genuineness of notice is concerned, he does not dispute it
\n                                {4}<\/p>\n
and also submitted that if the trial court considers the<\/p>\n
notice during final arguments with the provisions of the<\/p>\n
Arms Act<\/a> and the Arms Rules, then State has no objection<\/p>\n
and   the      miscellaneous   petition   may   be   decided<\/p>\n
accordingly.\n<\/p>\n
      Having considered the above, since the notice was<\/p>\n
said to be issued in the year 1999 and the matter is pending<\/p>\n
since 2000 and after a lape of about 15 years, the address<\/p>\n
of the said witness Shri Dalbir Bharti was given of the place<\/p>\n
when he was posted at the time of issuing notice in the<\/p>\n
year 1999, therefore, a prudent person can take a clear<\/p>\n
notice that the officer, who was posted before 16 years on<\/p>\n
the above post, may not be continuing on the same post<\/p>\n
and it seems that the whereabouts of that witness is even<\/p>\n
not known or traced by the petitioner himself and allowing<\/p>\n
the application for calling such a witness on the given<\/p>\n
address will be futile exercise. Hence, both the courts<\/p>\n
below have rightly dismissed the application under section<\/p>\n
311<\/a> Cr.P.C., which does not require any interference by<\/p>\n
this court.\n<\/p>\n
      But, since the learned Public Prosecutor did not<\/p>\n
dispute the genuineness of the notice issued by the DCP,<\/p>\n
Police HQ and District Magistrate, Mumbai and it relates to
\n                                   {5}<\/p>\n
the license of the petitioner-accused and the offence is<\/p>\n
related to the arm license itself and the learned Public<\/p>\n
Prosecutor also did not dispute for considering the same at<\/p>\n
the time of final arguments, therefore, without calling the<\/p>\n
witness, the trial court may, after marking the notice as<\/p>\n
exhibit, as its genuineness was not disputed, consider it at<\/p>\n
the time of final arguments. However, it is made clear that<\/p>\n
it is the domain of the learned trial court to decide, after<\/p>\n
considering the notice, that whether on the date of offence<\/p>\n
the license was in force or not without prejudice by this<\/p>\n
court.\n<\/p>\n
           This   miscellaneous   petition   stands   disposed   of<\/p>\n
accordingly.\n<\/p>\n
