Justice P.Q.BARKATH ALI\n\n Dated :14\/07\/2009\n\n O R D E R\n          PIUS.C.KURIAKOSE &amp; P.Q.BARKATH ALI, JJ.\n                       ------------------------\n                    W.P.C.No.18635 OF 2009\n                       ------------------------\n\n               Dated this the 14th day of July, 2009\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">Pius C.Kuriakose, J.\n<\/p>\n<p id=\"p_1\">      This is a writ petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution<\/p>\n<p>filed by the landlord.      The respondents are respectively the<\/p>\n<p>Accommodation Controller, Tirur and the tenant. The tenant filed<\/p>\n<p>a petition purporting to be under Section 13 of the Act 2 of<\/p>\n<p>1965 before the first respondent Accommodation Controller<\/p>\n<p>alleging that the writ petitioner landlord has started demolishing<\/p>\n<p>the other portions of the larger building, of which the building<\/p>\n<p>occupied by the tenant is also a part, and seeking a direction<\/p>\n<p>that the landlord be restrained from demolishing and removing<\/p>\n<p>the other portions of the larger building. On entertaining the<\/p>\n<p>above petition, a copy of which was placed before us by Sri.M.K.<\/p>\n<p>Chandramohan Das learned counsel for the second respondent<\/p>\n<p>tenant, the    first respondent Accommodation Controller issued<\/p>\n<p>Ext.P3. Ext.P3 styled as a notice, directs the writ petitioner to<\/p>\n<p>appear and submit objection to the ACP filed by the second<\/p>\n<p>respondent tenant. Ext.P3      also directs the writ petitioner to<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.No. 18635\/2009               2<\/span><\/p>\n<p>refrain from demolishing the other rooms in the building. Ext.P3<\/p>\n<p>is impugned in this     writ petition     on the various grounds<\/p>\n<p>including    the ground that the ACP filed by the second<\/p>\n<p>respondent, upon which Ext.P3 is issued, is not maintainable in<\/p>\n<p>law. Ext.P4 affidavit is filed by the writ petitioner undertaking<\/p>\n<p>that he will not cause any damage at all to the building occupied<\/p>\n<p>by the second respondent tenant by his demolition of the other<\/p>\n<p>rooms belonging to him.      Ext.P2 interim order issued by the<\/p>\n<p>Munsiff Court, Parappanangadi at the instance of the second<\/p>\n<p>respondent against the writ petitioner is also relied on by the writ<\/p>\n<p>petitioner to show that the regular civil court is already in seizin<\/p>\n<p>of the same issue.\n<\/p>\n<p id=\"p_2\">      2. We have heard the submissions of Sri.Harish R.Menon,<\/p>\n<p>learned    counsel  for  the   writ  petitioner    and   those   of<\/p>\n<p>Sri.M.K.Chandramohan Das, learned counsel for the second<\/p>\n<p>respondent tenant.    We have also heard the submissions of<\/p>\n<p>Smt.Latha.T.Thankappan, learned senior Government Pleader for<\/p>\n<p>the the first respondent Accommodation Controller.<\/p>\n<p id=\"p_3\">      3. Our attention was drawn by the learned counsel for the<\/p>\n<p>writ petitioner to Sections 13 and 17 of the Act 2 of 1965. It<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.No. 18635\/2009                 3<\/span><\/p>\n<p>was argued by Sri.Harish R.Menon that the main ACP filed by the<\/p>\n<p>second respondent is not maintainable in law since no amenity,<\/p>\n<p>which was being enjoyed by the second respondent tenant, has<\/p>\n<p>been cut off.   Only when amenity is cut off by the landlord with<\/p>\n<p>the intention of        compelling the tenant to vacate, the<\/p>\n<p>Accommodation Controller gets jurisdiction under Section 13 of<\/p>\n<p>the Act 2 of 1965 and the ACP becomes maintainable in law,<\/p>\n<p>according to the learned counsel.\n<\/p>\n<p id=\"p_4\">     3.    Sri.M.K.Chandramohan Das, the learned counsel for the<\/p>\n<p>second respondent would argue that Ext.P3 is only an interim<\/p>\n<p>order.    The writ petitioner has been directed by a statutory<\/p>\n<p>authority to appear before the same       court to show cause why<\/p>\n<p>the interim order should not be made absolute.        This court will<\/p>\n<p>not be justified in interfering with the interim order Ext.P3 passed<\/p>\n<p>by the statutory authority -first respondent since that order<\/p>\n<p>cannot be said to be passed without jurisdiction. It is open to the<\/p>\n<p>writ petitioner to appraise the first respondent of the<\/p>\n<p>jurisdictional aspect of the matter and get the interim order<\/p>\n<p>Ext.P3 varied by the first respondent himself.<\/p>\n<p id=\"p_5\">     4. We have anxiously considered the rival submissions<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC.No. 18635\/2009               4<\/span><\/p>\n<p>addressed at the Bar and we have carefully gone through the<\/p>\n<p>copy of ACP dated 26\/6\/2009 filed by the second respondent.<\/p>\n<p>We have kept in mind Sections 13 and 17 of the Act 2 of 1965,<\/p>\n<p>the two provisions         which confer jurisdiction upon the<\/p>\n<p>Accommodation Controller.     Having gone through the ACP filed<\/p>\n<p>by the second respondent, we do not find any specific allegation<\/p>\n<p>to the effect that any amenity, which was being enjoyed by the<\/p>\n<p>second respondent, has been cut off by the writ petitioner<\/p>\n<p>landlord with the objective of compelling the tenant the second<\/p>\n<p>respondent to vacate the building.         On the contrary, the<\/p>\n<p>allegations raised in the ACP are only to the effect that the other<\/p>\n<p>rooms in the larger building, of which the building occupied by<\/p>\n<p>the second respondent tenant is a part, are being demolished by<\/p>\n<p>the writ petitioner. It is doubtful whether the issue raised by the<\/p>\n<p>second respondent in the ACP falls within the powers of the<\/p>\n<p>Accommodation Controller under Section 13. We also notice that<\/p>\n<p>the regular Civil Court has already been moved by the second<\/p>\n<p>respondent. That is a circumstance which supports the argument<\/p>\n<p>of Harish R.Menon that the remedy of the second respondent,<\/p>\n<p>even if he has genuine grievance, lies before the Civil Court and<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">WPC.No. 18635\/2009                5<\/span><\/p>\n<p>not before the Accommodation Controller.         However, since the<\/p>\n<p>Accommodation Controller is yet to dispose of the main petition,<\/p>\n<p>we do not propose to decide the issue finally. We dispose of this<\/p>\n<p>writ petition issuing the following directions ;<\/p>\n<blockquote id=\"blockquote_1\"><p>                   i). Ext.P3 to the extent it directs the<\/p>\n<p>             writ petitioner to refrain from demolishing<\/p>\n<p>             the rooms other than the room which is<\/p>\n<p>             subject matter of the lease in favour of<\/p>\n<p>             the second respondent, will stand stayed.<\/p>\n<p>             We record the undertaking given by the<\/p>\n<p>             writ petitioner in Ext.P4 to this court and<\/p>\n<p>             we also notice Ext.P2 interim order<\/p>\n<p>             passed by the Civil Court in the above<\/p>\n<p>             context.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                   ii). The first respondent is directed<\/p>\n<p>             to take up the main ACP dated 26\/6\/2009<\/p>\n<p>             filed by the second respondent, hear both<\/p>\n<p>             sides regarding the maintainability of that<\/p>\n<p>             ACP and take an early decision on that<\/p>\n<p>             issue.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p><span class=\"hidden_text\" id=\"span_4\">WPC.No. 18635\/2009               6<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                    iii).   Decision     regarding   the<\/p>\n<p>             maintainability of the ACP filed by the<\/p>\n<p>             second respondent will be taken by the<\/p>\n<p>             first respondent    early and at any rate<\/p>\n<p>             within 10 days of receiving a copy of this<\/p>\n<p>             judgment.<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">     It is recorded that the writ petitioner has been served with a<\/p>\n<p>copy of the ACP filed by the second respondent.
