(3) 464\n 1991 SCC  (1)\t 1\t  JT 1990 (4)\t702\n 1990 SCALE  (2)1198\n\n\nACT:\n    Civil  Procedure  Code, 1908:  Section  100\t  Concurrent\nfinding\t of facts--Ignoring of in Second  appeal--Issue\t not\nraised or argued before Courts below  Acceptance of--Whether\njustified.\n    West  Bengal Estates Acquisition Act, 1953:\t Under-Raiy-\nats--Sale    of\t   their    rights--Approval\tof    higher\nauthorities--Whether required.\n\n\n\nHEADNOTE:\n    The appellant purchased the suit land from Bauries,\t the\nunder  Raiyats by way of sale deeds, after the\tcoming\tinto\nforce  of the West Bengal Estates Acquisition Act, 1953.  It\nwas  stated  that  defendants 1 and 2  accompanied  by\tsome\nPolicemen  had\tdisturbed the possession of  the  appellant-\nplaintiff  by  destroying  the standing\t crop  and  planting\ngamagrass seedlings in the land. Hence the appellant  insti-\ntuted a suit for declaration of title and possession of\t the\nsuit land. The trial Court decreed the suit in favour of the\nappellant-plaintiff.\n    On\tan appeal filed by the Defendants, the First  Appel-\nlate Court affirmed the findings of the trial Court.\n    Aggrieved, Defendant No. 1 filed a Second appeal  before\nthe  High Court. Reaching a finding that the actual date  of\ndispossession  was not specifically mentioned in the  plaint\nand  unless  the same was pleaded and proved, the  suit\t for\npossession  was\t not competent, the High Court\tallowed\t the\nappeal and set aside the judgments of the Courts below.\n    The\t appellant-plaintiff has preferred the\tpresent\t ap-\npeal, by special leave, against the High Court judgment.\nAllowing the appeal, this Court,\n    HELD: 1. The High Court fell into error in ignoring\t the\nconcurrent  findings of the Courts below and  accepting\t the\nappeal\ton  an\tissue which was neither\t raised\t nor  argued\nbefore\tthe Courts below. The High Court misread the  plead-\nings and the evidence on the record. [467B-D]\n465\n    2.\tIn the face of clear pleadings and the\tevidence  on\nrecord\tthe High Court was wrong in reaching the  conclusion\nthat there was no pleadings and evidence regarding disposes-\nsion.  Even  otherwise\tin the face of the  finding  of\t the\nCourts\tbelow  that the appellant-plaintiff had\t proved\t her\ntitle it was not necessary for the High Court to go into the\nquestion of ascertaining the date of dispossession. [468A-B]\n    3.\tThere is nothing on record to show that the  Baaries\ncould  not  sell their rights as under-Raiyats\twithout\t the\napproval  of the higher authorities. Neither there  are\t any\npleadings on this point nor any evidence was led before\t the\ntrial Court.
