ORAL JUDGEMENT\n<\/p>\n
     1.The petitioner Dr.Maheshkumar Ramanlal Parikh,
\n     Assistant Director(Animal Husbandary) has filed this
\n     petition under Article 226<\/a> of the Constitution of India
\n     and prayed that the impugned Order at Annexure : A dated
\n     23.3.1989 passed by the respondent No.4 be quashed and
\n     set aside and the respondents be directed to allow the
\n     petitioner to resume training of Post-Graduate course of
\n     M.V.S.C. with respondent No.4 University in view of the
\n provisional admission given   to   him at Annexure :   E to
\nthis petition on 12.9.1988.\n<\/p>\n
2.At the out-set I must state that the learned
\nCounsel Shri K.S.Zaveri for the petitioner requested to
\nadjourn this matter on the ground that he was unable to
\ncontact his client as he was transferred to Kutch. He
\nrequested Shri Pujari, learned A.G.P. appearing in this
\nmatter on behalf of the State to give the information
\nabout the present posting of the petitioner so that he
\ncan contact him to which Shri Pujari stated at the bar,
\non the instruction received from Shri P.R.Oza, Senior
\nClerk,   from   the   respondent   Department, that the
\npetitioner was transferred from Kutch to Songadh some
\nwhere in March, 2000, but he has not joined and reported
\nto his duty at Songadh and therefore he is unable to give
\nhis present address.\n<\/p>\n
3.Under the circumstances the request made by Shri
\nZaveri to adjourn this matter is turned down in view of
\nthe latest decision of the Hon’ble Supreme Court for the
\ntwo reasons that this is a petition of 1989 and as per
\nthe endorsement made today it is listed for 28 time.\n<\/p>\n
4.Thereafter,   learned   Counsel    Shri    Zaveri
\nsubmitted on merit. He raised only one contention that
\nthe impugned order at Annexure : A was passed without
\nextending any opportunity of hearing. Therefore, it is in
\nviolation of principles of natural justice and liable to
\nbe quashed and set aside.\n<\/p>\n
5.Before appreciating the aforesaid contention I
\nmust    state    that   on   4.10.1989   the   petitioner
\nDr.Maheshkumar Parikh gave written undertaking to this
\nHon’ble Court to pay back the salary and other benefit
\nborne by the Government as may be directed by this Court
\nat the final disposal of this petition if he fails in
\nthis petition. It may be stated that on 4.10.1989learned
\nSingle Judge of this Court while issuing the Rule granted
\ninterim relief in terms of Para : 21(B) of the petition
\nwhereby the petitioner was allowed to go for the training
\non the Post Graduate Course of M.V.S.C. with          the
\nrespondent No.4 University on condition that he will pay
\nback the salary and other benefits borne         by   the
\nGovernment as may be directed by this Court. Thus, under
\nconditional interim order of the Court the petitioner
\nappeared, but he could not complete the course for which
\nthe Government had to incur the expenses of about
\nRs.1,38,000\/-. Thus, in my considered opinion the person
\nwho is not carrying out his subsequent order of transfer
\nin the year 2000 and not completing the course after
\n getting the interim order from this Court would not be
\nentitled for any discretionary relief from this Court
\nunder Article 226<\/a> of the Constitution of India. On merits
\nthe submission raised by Mr.Zaveri that without issuing
\nnotice the impugned order Annexure : A came to be passed
\nmay look attractive at first sight, but on the facts of
\nthis case I am fully convinced that when the Departmental
\nEnquiry is already pending against him then there would
\nnot have been any difficulty in cancelling the admission
\ngiven to the petitioner. The effect of initiation of
\nDepartmental Enquiry is not even disputed        by   the
\npetitioner. However, it was tried to be submitted by
\nMr.Zaveri for the petitioner that the said Departmental
\nEnquiry was initiated after giving him admission. This
\nwould not make any difference. When the enquiry is
\npending then the University would be at liberty to cancel
\nthe admission. If the enquiry was initiated earlier to
\nhis admission then obviously he would have been denied
\nthe admission. Time and again the Hon’ble Supreme Court
\nhas held that the Court should be slow in interfering
\nwith the educational matters and in such type of cases
\nwhen the University has passed the order then this Court
\nshould not interfere with such orders on the ground that
\nno opportunity of hearing was given to the petitioner.
\nAffording of opportunity of hearing would be nothing but
\na formality. Therefore, in such type of cases when no
\nprejudice is caused then only on this ground the impugned
\norder cannot be set aside.\n<\/p>\n
6.In view of above discussion this petition is
\nfailed and is hereby dismissed. However, there shall be
\nno order as to costs. Rule discharged. Interim relief
\nvacated.\n<\/p>\n
As per Undertaking given by the petitioner he
\nshall have to pay back the salary and other benefit borne
\nby the State Government within one month from today,
\nfailing which the respondent Government will be at
\nliberty to recover the same, including the deduction from
\nhis salary in instalment.\n<\/p>\n
