{"id":256510,"date":"2011-07-20T00:00:00","date_gmt":"2011-07-19T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/d-vs-state-on-20-july-2011"},"modified":"2019-02-27T21:12:03","modified_gmt":"2019-02-27T15:42:03","slug":"d-vs-state-on-20-july-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/d-vs-state-on-20-july-2011","title":{"rendered":"D vs State on 20 July, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">D vs State on 20 July, 2011<\/div>\n<div class=\"doc_author\">Author: H.K.Rathod,<\/div>\n<pre id=\"pre_1\">  \n Gujarat High Court Case Information System \n    \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/8798\/2011\t 3\/ 3\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 8798 of 2011\n \n\n \n \n=========================================================\n\n \n\nD\nL SHAH - Petitioner(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT &amp; 3 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nRAMKRISHNA B DAVE for\nPetitioner(s) : 1, \nNone for Respondent(s) : 1 -\n4. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Heard<br \/>\n\tlearned Advocate Mr. RB Dave for petitioner  and learned AGP Mr.<br \/>\n\tMaulik Nanavati for respondents.\n<\/p>\n<p id=\"p_1\">This<br \/>\n\tCourt has passed following order in Special Civil Application No.<br \/>\n\t9265 of 2008 dated 29th September, 2009:\n<\/p>\n<p id=\"p_2\">&#8220;1.\tBy<br \/>\n\tway of this petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India<br \/>\n\tthe petitioner has prayed for an appropriate writ, order or<br \/>\n\tdirection quashing and setting aside the action of the respondents<br \/>\n\tin not accepting the application of the petitioner for voluntary<br \/>\n\tretirement by not taking any decision.\n<\/p>\n<p id=\"p_3\">2.\tShri<br \/>\n\tDave, learned advocate appearing on behalf of the petitioner has<br \/>\n\tsubmitted that from the affidavit-in-reply it appears that the<br \/>\n\tapplication of the petitioner for voluntary retirement was not<br \/>\n\tprocessed at the relevant time though the petitioner had attained<br \/>\n\tthe qualifying service for voluntary retirement.<br \/>\n\t It is submitted by him that as per the certificate issued by the<br \/>\n\tDeputy Director, Pension and Provident Fund, Gandhinagar dated<br \/>\n\t2-5\/05\/2009, the petitioner has already completed 20 years of<br \/>\n\tservice, which is the qualifying period.\n<\/p>\n<p id=\"p_4\">\t3.\tShri Shivang Shukla,<br \/>\n\tlearned AGP has submitted that the application of the petitioner for<br \/>\n\tvoluntary retirement is to be considered and appropriate decision is<br \/>\n\tto be taken by the State Government i.e. the Secretary, Port and<br \/>\n\tTransport Department, State of Gujarat.\n<\/p>\n<p id=\"p_5\">\t4.\tIn view of the above,<br \/>\n\tlet the petitioner submit an appropriate application alongwith the<br \/>\n\tcertificate issued by the Deputy Director, Pension and Provident<br \/>\n\tFund, Gandhinagar dated 2-5\/05\/2009 on the basis of which it is<br \/>\n\tcontended by the petitioner that the petitioner has completed the<br \/>\n\tqualifying period.  The petitioner to make an appropriate<br \/>\n\tapplication alongwith the aforesaid document with a request to the<br \/>\n\tSecretary, Port and Transport Department to take final decision on<br \/>\n\tthe application submitted by the petitioner for voluntary retirement<br \/>\n\twithin a period of two weeks from today and on receipt of such an<br \/>\n\tapplication, Secretary, Port and Transport Department to take an<br \/>\n\tappropriate final decision on the application submitted by the<br \/>\n\tpetitioner for voluntary retirement within  a period of four weeks<br \/>\n\tthereafter and communicate the outcome of the same to the<br \/>\n\tpetitioner.  If the application of the petitioner for voluntary<br \/>\n\tretirement is accepted, in that case, the petitioner shall be paid<br \/>\n\tall the consequential benefits available to the petitioner on<br \/>\n\tvoluntary retirement at the earliest.\n<\/p>\n<p id=\"p_6\">With<br \/>\n\tthis, the present Special Civil Application is disposed of at this<br \/>\n\tstage.&#8221;\n<\/p>\n<p id=\"p_7\">Thereafter,<br \/>\n\tin view of aforesaid order passed by this court,  respondent has<br \/>\n\tpassed order page 17 annexure E dated 21.9.2009 accepting voluntary<br \/>\n\tretirement of petitioner with effect from 31.10.2005. Now,<br \/>\n\tcontention is raised by petitioner that he is entitled to have<br \/>\n\tvoluntary retirement with effect from extra-ordinary leave 1st<br \/>\n\tApril, 2003 and claiming all consequential benefits from respondents<br \/>\n\taccordingly. Learned Advocate Mr. Dave also submitted that GPF<br \/>\n\tAmount has been paid not in time but it was paid belatedly but for<br \/>\n\tthat, no interest amount is paid subsequent to 2008 though order of<br \/>\n\tretirement has been passed on 21.9.2009 accepting voluntary<br \/>\n\tretirement of petitioner with effect from 31.10.2005.\n<\/p>\n<p id=\"p_8\">If<br \/>\n\tthat be so, let petitioner may make detailed representation claiming<br \/>\n\taforesaid benefits from respondents within one month from date of<br \/>\n\treceiving copy of present order.\n<\/p>\n<p id=\"p_9\">As<br \/>\n\tand when such representation made by petitioner is received by<br \/>\n\trespondents, it is directed to respondents to reconsider and examine<br \/>\n\tgrievance of petitioner on both counts, whether petitioner is<br \/>\n\tentitled to have voluntary retirement in class II with effect from<br \/>\n\t1st April, 2003 or not and also to consider whether<br \/>\n\tpetitioner is entitled for interest upon amount of GPF subsequent to<br \/>\n\t2008 or not and then to pass appropriate reasoned order within three<br \/>\n\tmonths from date of receiving such representation from petitioner<br \/>\n\tand communicate decision to petitioner immediately thereafter.\n<\/p>\n<p id=\"p_10\">In<br \/>\n\tview of these observations and directions, this petition is disposed<br \/>\n\tof by this court without expressing any opinion on merits.
