As<br \/>\n\tper the information given to the petitioner copy whereof is produced<br \/>\n\tat annexure C with the Civil Application, it is also apparent that<br \/>\n\tthe fresh advertisement has been issued by Mamlatdar, Limbdi for<br \/>\n\tgiving licence of stamp vendor and as per the petitioner, he has<br \/>\n\tapplied for such licence.\n<\/p>\n<p id=\"p_1\">Under<br \/>\n\tthese circumstances, the cause of the petitioner, so far as it<br \/>\n\trelates to subject matter of main Special Civil Application No.<br \/>\n\t17657 of 2003 would not survive and the main Special Civil<br \/>\n\tApplication can be said as having become infructuous.\n<\/p>\n<p id=\"p_2\">Mr.\n<\/p>\n<p id=\"p_3\">\tDastoor learned Counsel appearing for the petitioner however,<br \/>\n\tsubmitted that the petitioner has applied for the licence and<br \/>\n\tpursuant to the advertisement, copy whereof is produced at annexure<br \/>\n\tD, page 9 of the compilation of the Civil Application and he<br \/>\n\tsubmitted that this Court may direct for consideration of the<br \/>\n\tapplication of the petitioner.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tmy view it is an independent aspect and even otherwise also the<br \/>\n\tauthority would be required to consider the application of all<br \/>\n\teligible candidates together with the application of the petitioner<br \/>\n\tif made. Further, the decision is yet to be taken by the authority<br \/>\n\tfor grant of licence pursuant to the fresh advertisement. Therefore,<br \/>\n\tat this stage any direction may prejudice the rights of other<br \/>\n\tcandidates, who may be similarly situated. After the decision is<br \/>\n\ttaken by the Mamlatdar, in the event the petitioner is aggrieved,<br \/>\n\tand if law permits, the petitioner may challenge such decision in<br \/>\n\taccordance with law.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tview of the above, subject to the aforesaid observation, the<br \/>\n\tpetition is disposed of as having become infructuous.\n<\/p>\n<p id=\"p_6\">Rights<br \/>\n\tof the petitioner shall also stand governed, as per the observation<br \/>\n\tmade hereinabove and hence, the Civil Application would not survive,<br \/>\n\tand shall stand disposed of accordingly.\n<\/p>\n<p id=\"p_7\">  (JAYANT PATEL, J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Arvindbhai vs State on 8 July, 2008 Author: Jayant Patel,&amp;Nbsp;
