      This is an application for anticipatory bail under Section 438<\/a> of<\/p>\n
the Code of Criminal Procedure. The petitioner is the third accused<\/p>\n
in Crime No.331 of 2008           of Thalassery Police Station, Kannur<\/p>\n
District.\n<\/p>\n
\n
      2.   The offences alleged against the accused persons are<\/p>\n
under Sections 341<\/a>, 343<\/a>, 379<\/a>, 384<\/a>, 354<\/a>, 506(ii)<\/a>, 365<\/a> and 120B<\/a> read<\/p>\n
with Section 34<\/a> of the Indian Penal Code.<\/p>\n
      3.     When the Bail Application came up for hearing on<\/p>\n
8.10.2009, the following order was passed:<\/p>\n
              After having heard the learned counsel for the<\/p>\n
       petitioner and the learned Public Prosecutor, I am of<\/p>\n
       the view that before disposing of the Bail Application,<\/p>\n
       an opportunity should be given to the petitioner to<\/p>\n
       appear before the investigating officer. Accordingly,<\/p>\n
       there will be a direction to the petitioner to appear<\/p>\n
B.A. NO. 4652 OF 2009<\/p>\n
                                       :: 2 ::\n<\/p><\/blockquote>\n
       before the investigating officer at 9 AM on 15th and 16th<\/p>\n
       October, 2009.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
             Post on 22.10.2009.\n<\/p><\/blockquote>\n
             It is submitted by the learned Public Prosecutor that<\/p>\n
       the petitioner will not be arrested until further orders in<\/p>\n
       connection with Crime No.331 of 2008 of Thalassery<\/p>\n
       Police Station, Kannur.”<\/p><\/blockquote>\n
\n
      4. It is submitted by the learned counsel for the petitioner as well<\/p>\n
as the learned Public Prosecutor that the direction in the order dated<\/p>\n
8.10.2009 has been complied with by the petitioner.<\/p>\n
      5. Taking into account the facts and circumstances of the<\/p>\n
case, the nature of the offence and also taking note of the fact that<\/p>\n
the direction in the order dated 8.10.2009 has been complied with by<\/p>\n
the petitioner, I am of the view that anticipatory bail can be granted<\/p>\n
to the petitioner. There will be a direction that in the event of the<\/p>\n
arrest of the petitioner, the officer in charge of the police station shall<\/p>\n
release him on bail on his executing bond for Rs.25,000\/- with two<\/p>\n
solvent sureties for the like amount to the satisfaction of the officer<\/p>\n
concerned, subject to the following conditions:<\/p>\n

                                    :: 3 ::\n<\/p>\n
\n
      a)    The petitioner shall report before the investigating
\n            officer between 9 A.M.        and 11 A.M. on alternate
\n            Mondays, till the final report is filed or until further
\n            orders;\n<\/p>\n
      b)    The petitioner shall appear before the investigating
\n            officer for interrogation as and when required;<\/p>\n
      c)    The petitioner shall not try to influence the prosecution
\n            witnesses or tamper with the evidence;<\/p>\n
      d)    The petitioner shall not commit any offence or indulge in
\n            any prejudicial activity while on bail;<\/p>\n
      e)    In case of breach of any of the conditions mentioned
\n            above, the bail shall be liable to be cancelled.<\/p>\n
      The Bail Application is allowed to the extent indicated above.<\/p>\n
