PARTY.\n\n                   For the Petitioner        : Mr. N.K.Agrawal, Sr. Advocate.\n                   For the Opp.Party         : Mr. Niraj Kumar, Advocate.\n                   For the State             : Mr. Jharkhandi Upadhyaya, APP\n                                                        -----------\n<\/pre>\n<p id=\"p_1\">04.   01.07.2010                     Heard learned counsel for the petitioner, informant and<\/p>\n<p>                       State.\n<\/p>\n<p id=\"p_1\">                                     Rule confined to question of sentence only.\n<\/p>\n<p id=\"p_2\">                                     Learned A.P.P. waives notice on behalf of the State of<\/p>\n<p>                       Bihar.\n<\/p>\n<p id=\"p_3\">                                     With the consent of the parties, the present revision<\/p>\n<p>                       application is being disposed of at this stage itself.<\/p>\n<p id=\"p_4\">                                     Petitioner herein is the husband. He has been charged<\/p>\n<p>                       for having committed an offence punishable under <a href=\"\/doc\/538436\/\" id=\"a_1\">Section 498A<\/a><\/p>\n<p>                       and <a href=\"\/doc\/1101188\/\" id=\"a_1\">379<\/a> of the Penal Code. Let it be recorded that the father,<\/p>\n<p>                       mother and two sisters of the petitioner were also charged under<\/p>\n<p>                       the same Sections.\n<\/p>\n<p id=\"p_5\">                                     According to the prosecution case lodged by the<\/p>\n<p>                       victim Nazmun Praveen, she was married with the petitioner 10<\/p>\n<p>                       years ago as per Muslim rites and rituals. Several gifts were given<\/p>\n<p>                       to her at the time of marriage. At the \u201eSasural\u201f she was tortured for<\/p>\n<p>                       non-fulfillment of certain demands. An attempt was subsequently<\/p>\n<p>                       made     to      do    away    with   her    life.   Father   of   the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                       2<\/span><\/p>\n<p>complainant\/informant ultimately retrieved her from \u201eSasural\u201f.<\/p>\n<p>Her jewellery and other belongings were illegally retained by the<\/p>\n<p>accused persons. At the trial prosecution seems to have examined<\/p>\n<p>as many as 07 witnesses. On appraisal of their testimony, the<\/p>\n<p>learned trial Court found and held that the charge(s) under <a href=\"\/doc\/1101188\/\" id=\"a_2\">Section<\/p>\n<p>379<\/a> of the Penal Code have not been proved against the petitioner<\/p>\n<p>and other accused persons standing the trial. They were, however,<\/p>\n<p>found guilty under <a href=\"\/doc\/538436\/\" id=\"a_3\">Section 498A<\/a> of the Penal Code, and<\/p>\n<p>accordingly sentenced to undergo R.I. for 03 years. This is what<\/p>\n<p>the learned trial Court has held:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;&#8230;thus in final prosecution successfully<br \/>\n      passed the charge of 498A <a href=\"\/doc\/1569253\/\" id=\"a_4\">IPC<\/a> against Afgan Khan,<br \/>\n      Subejaan Khan, Khairoon Nisha, Genis Khatton and<br \/>\n      Sairun Nishan beyond all reasonable doubts.<br \/>\n      Accordingly they are held guilty for the charge of<br \/>\n      498A <a href=\"\/doc\/1569253\/\" id=\"a_5\">IPC<\/a> and so convicted thereunder&#8230;&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">     Aggrieved by the aforesaid judgment and order of conviction<\/p>\n<p>recorded by the learned trial Court, the petitioner herein and other<\/p>\n<p>co-convicts filed appeal being Criminal Appeal no. 63 of 2002,<\/p>\n<p>which was considered and disposed of by the learned Additional<\/p>\n<p>District and Sessions Judge-I, Nawadah by order dated<\/p>\n<p>25.11.2009. On a reappraisal of the evidence adduced on behalf of<\/p>\n<p>the prosecution it was found that so far as the other members of the<\/p>\n<p>husband (in-law\u201fs of the complainant) are concerned, the material<\/p>\n<p>on record were general and vague not inspiring confidence. So far<\/p>\n<p>as the petitioner is concerned, it was found that physical cruelty<\/p>\n<p>and harassment to the complainant\/informant at the hands of the<\/p>\n<p>petitioner for non-fulfillment of certain demands has been proved<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                       3<\/span><\/p>\n<p>to the hilt. Accordingly, while acquitting other convicts, the<\/p>\n<p>conviction and sentence recorded against the petitioner was<\/p>\n<p>maintained.\n<\/p>\n<p id=\"p_8\">     Learned counsel for the petitioner submits that the occurrence<\/p>\n<p>in the present case had taken place sometimes in the year 1997.<\/p>\n<p>The trial of the petitioner consumed more than five years.<\/p>\n<p>Admittedly the allegation pertains to demand of certain amounts<\/p>\n<p>for running business. It is next contended that trial Court as well as<\/p>\n<p>the learned lower appellate Court has not considered the provision<\/p>\n<p>contained under <a href=\"\/doc\/755395\/\" id=\"a_6\">Section 360<\/a> and <a href=\"\/doc\/1559838\/\" id=\"a_7\">361<\/a> of the Code of Criminal<\/p>\n<p>Procedure (for short \u201eThe Code\u201f).\n<\/p>\n<p id=\"p_9\">     Learned counsel appearing on behalf of the informant and<\/p>\n<p>State, however, supported the impugned judgments. It is submitted<\/p>\n<p>that there is concurrent finding(s) of guilt recorded against the<\/p>\n<p>petitioner. The appellate Court, on a reappraisal of the evidence on<\/p>\n<p>record, found that the evidence of the prosecution witnesses were<\/p>\n<p>trustworthy. Accordingly conviction of the petitioner has been<\/p>\n<p>maintained. In view of the concurrent finding recorded by the two<\/p>\n<p>courts below, this Court should refrain from interfering with the<\/p>\n<p>findings so recorded by them. It is next contended that cruelty and<\/p>\n<p>torture, at the hands of the husband, has become rampant. In that<\/p>\n<p>view of the matter, petitioner is not entitled to consideration under<\/p>\n<p><a href=\"\/doc\/755395\/\" id=\"a_8\">Sections 360<\/a> and <a href=\"\/doc\/1559838\/\" id=\"a_9\">361<\/a> of the Code of Criminal Procedure.<\/p>\n<p id=\"p_10\">     Having considered the submissions made at the Bar and after<\/p>\n<p>going through the entire material reflected from the two impugned<\/p>\n<p>judgments, this Court is of the view that in the particular facts of<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                            4<\/span><\/p>\n<p>      the case a lenient view, in so far as the imposition of sentence is<\/p>\n<p>      concerned, shall sub serve the cause of justice. Admittedly<\/p>\n<p>      petitioner laboured under the threat of being punished for over five<\/p>\n<p>      years. This is a relevant consideration to be kept in mind while<\/p>\n<p>      imposing sentence for the guilt proved against the petitioner.<\/p>\n<p id=\"p_11\">           In the circumstances, this Court is satisfied that a sentence of<\/p>\n<p>      02 years R.I. under <a href=\"\/doc\/538436\/\" id=\"a_10\">Section 498A<\/a> of the Penal Code shall sub serve<\/p>\n<p>      the cause of justice. Accordingly, the sentence awarded under<\/p>\n<p>      <a href=\"\/doc\/538436\/\" id=\"a_11\">Section 498A<\/a> of the Penal Code is reduced to 02 years R.I.<\/p>\n<p id=\"p_12\">                  With this modification in sentence(s), the application<\/p>\n<p>      is dismissed.\n<\/p>\n<p id=\"p_13\">\n<pre id=\"pre_1\">Sym                                         ( Kishore K.
