BASANT, J.\n\n               -------------------------------------------------\n\n                      CRL.M.C.NO. 496 OF  2007\n\n               -------------------------------------------------\n\n              Dated this the 29th day of March, 2007\n\n\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">       The   petitioner   faces     indictment   in   a   prosecution   under<\/p>\n<p>Sec.138 of the N.I. Act.    The petitioner has come before this<\/p>\n<p>Court   with   the   grievance   that   cognizance   has   been   taken<\/p>\n<p>without legal authority  inasmuch as the petition  is barred  by<\/p>\n<p>limitation.    Cognizance was taken on the basis of a complaint<\/p>\n<p>dated 14\/4\/04.   Notice of demand was  served on 9\/2\/04.   The<\/p>\n<p>petitioner contended that the payment must have  been made<\/p>\n<p>within   15   days   of   receipt   of   the   notice   i.e.,   9\/2\/2004.       The<\/p>\n<p>cause   of   action   arises   after   15   days   and   the   complaint   must<\/p>\n<p>have been within one month.     In any view of the matter, the<\/p>\n<p>complaint must have been filed by 24\/3\/04     (i.e., 9\/2\/04 + 15<\/p>\n<p>days + one month).\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.       Notice   was   given   to   the   respondent\/complainant.<\/p>\n<p>The respondent\/complainant has entered appearance through<\/p>\n<p>counsel.   Report of the learned Magistrate was also called for.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.M.C.NO. 496 OF  2007  -: 2 :-<\/span><\/p>\n<p>The   report   of   the   learned   Magistrate   shows   that   an   order   has<\/p>\n<p>been   passed   condoning   the   delay   of     26   days   in   filing   the<\/p>\n<p>complaint.     A copy of the order has also been furnished.     The<\/p>\n<p>order dated 12\/7\/04 in C.M.P.No.1895\/04 shows that the delay of<\/p>\n<p>26   days   in   filing   the   complaint   was   condoned   by   the   learned<\/p>\n<p>Magistrate   without   notice   to   the   accused\/the   petitioner   herein.<\/p>\n<p>The   report   of  the   learned  Magistrate   also  shows  that  the   delay<\/p>\n<p>was condoned without and before giving notice to the accused to<\/p>\n<p>raise his objections against the prayer for condonation of delay.<\/p>\n<p id=\"p_3\">       3.   Obviously and transparently, the procedure adopted by<\/p>\n<p>the learned Magistrate is not correct.     The complaint is barred<\/p>\n<p>by   limitation.       Of   course,   the   delay   can   be   condoned   by   the<\/p>\n<p>learned   Magistrate   now.     But   before   condonation   of   delay,   the<\/p>\n<p>accused  is  certainly  entitled  to  be   heard.       There  is  no  specific<\/p>\n<p>provision under Sec.142(b) of the <a href=\"\/doc\/1132672\/\" id=\"a_1\">N.I. Act<\/a> to order notice to the<\/p>\n<p>accused   before   the   delay   is   condoned.       But,   it   is   by   now   trite<\/p>\n<p>that   the   right   to   be   heard   before   the   delay   is   condoned   is   an<\/p>\n<p>incident   of   the   principles   of   natural   justice   and   even   when   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.M.C.NO. 496 OF  2007  -: 3 :-<\/span><\/p>\n<p>Statute is silent, all interstitial  spaces must be filled and rule of<\/p>\n<p>natural justice must be read into all statutes.    So reckoned, the<\/p>\n<p>order   dated   12\/7\/04   in   C.M.P.No.1895\/04   is   obviously<\/p>\n<p>unsustainable.   The same deserves to be set aside.<\/p>\n<p id=\"p_4\">      4.   In the result:\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      (a)  This Crl.M.C. is allowed in part.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">      (b)     The   order   dated   12\/7\/04   in   C.M.P.No.1895\/04   passed<\/p>\n<p>by the learned Magistrate and the consequent cognizance taken<\/p>\n<p>are set aside.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">      (c)   But   it   is   directed   that   the   learned   Magistrate   must<\/p>\n<p>dispose   of   C.M.P.No.1895\/04   afresh   after   giving   the   petitioner<\/p>\n<p>herein an opportunity to be heard.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">      (d) The parties shall  appear before the learned Magistrate<\/p>\n<p>without   waiting   for   any   further   notice   from   the   learned<\/p>\n<p>Magistrate on 16\/4\/07 to continue the proceedings.   The learned<\/p>\n<p>Magistrate   shall,   after   hearing   both   sides,   pass   appropriate<\/p>\n<p>orders afresh in C.M.P.No.1895\/04 and take appropriate decision<\/p>\n<p>on the question of cognizance.\n<\/p>\n<p id=\"p_13\">\n<span class=\"hidden_text\" id=\"span_2\">CRL.M.C.NO. 496 OF  2007  -: 4 :-<\/span><\/p>\n<p id=\"p_14\">        5.     I   may   hasten   to   observe   that   I   have   not   intended   to<\/p>\n<p>express any opinion on merits on the acceptability of the claim of<\/p>\n<p>the complainant to get the delay condoned or on the question of<\/p>\n<p>cognizance   being   taken.       The   learned   Magistrate   must   take<\/p>\n<p>appropriate decisions on merits.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">                                                                      Sd\/-\n<\/p>\n<p id=\"p_17\">\n                                                        (R.
