KOSHY, Ag.C.J. &amp;\n                         V.GIRI, J.\n         -------------------------\n                    W.A.No.186 of 2009\n         -------------------------\n           Dated this the 3rd day of February, 2009.\n\n\n                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">Koshy, Ag.C.J.\n<\/p>\n<p id=\"p_1\">           The appellants\/petitioners are guarantors to the<\/p>\n<p>loan taken by the 5th respondent. When action was initiated<\/p>\n<p>against the appellants under the <a href=\"\/doc\/52229129\/\" id=\"a_1\">SARFAESI Act<\/a> and they<\/p>\n<p>were about to be physically dispossessed from the<\/p>\n<p>residential house, they approached this court.<\/p>\n<p id=\"p_2\">           2. Learned single Judge directed them to deposit<\/p>\n<p>an amount of Rs.15 lakhs within a period of two weeks from<\/p>\n<p>the date of that judgment and further ordered that if that<\/p>\n<p>amount is deposited, physical dispossession will stand<\/p>\n<p>deferred for a period of four months, so that the<\/p>\n<p>appellants\/petitioners can approach the Debt Recovery<\/p>\n<p>Tribunal within the said period.<\/p>\n<p id=\"p_3\">           3. The appellants approached the Debt Recovery<\/p>\n<p>Tribunal within four months. It is also stated that as per<\/p>\n<p>Ext.P5, the total amount due, as on 1.9.2007, was only<\/p>\n<p>Rs.15,55,201\/-.\n<\/p>\n<p id=\"p_4\">W.A.No.186 of 2009<\/p>\n<p>                              :: 2 ::\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">           4.    After the judgment, the bank proceeded<\/p>\n<p>against the 5th respondent and seized certain movable<\/p>\n<p>articles belonging to him, worth Rs.17 lakhs. If the amount<\/p>\n<p>can be realised from the 5th respondent, the appellants will<\/p>\n<p>not be liable to pay any amount.\n<\/p>\n<p id=\"p_7\">           5. All these contentions can be raised before the<\/p>\n<p>Debt Recovery Tribunal.       The bank also should consider<\/p>\n<p>whether the amount can be recovered from the 5th<\/p>\n<p>respondent himself including by way of sale of the movables<\/p>\n<p>seized from the 5th respondent.      Now, the Debt Recovery<\/p>\n<p>Tribunal has started sitting in Kochi.<\/p>\n<p id=\"p_8\">           6. It is now stated that the appellants have filed<\/p>\n<p>a petition, as S.A.No.216\/08, before the Debt Recovery<\/p>\n<p>Tribunal.   It is for the Debt Recovery Tribunal to decide<\/p>\n<p>whether the proceedings against the appellants should be<\/p>\n<p>continued or not, if the amount, as directed by this court,<\/p>\n<p>has been deposited by them. Those are all matters that can<\/p>\n<p>be decided in the petition filed before the Debt Recovery<\/p>\n<p>W.A.No.186 of 2009<\/p>\n<p>                            :: 3 ::\n<\/p>\n<p id=\"p_9\">\nTribunal. Therefore, the appellants can approach the Debt<\/p>\n<p>Recovery Tribunal. The Debt Recovery Tribunal is directed<\/p>\n<p>to dispose of the application within three weeks from today.<\/p>\n<p>Till the Debt Recovery Tribunal decides the matter, the<\/p>\n<p>proceedings against the appellants herein shall stand<\/p>\n<p>suspended.   The Debt Recovery Tribunal shall decide the<\/p>\n<p>matter untrammelled by the observations contained in the<\/p>\n<p>judgment of the learned single Judge.<\/p>\n<p id=\"p_10\">          Writ appeal is disposed of as above.<\/p>\n<p id=\"p_11\">                                              Sd\/-\n<\/p>\n<p id=\"p_12\">                                        (J.B.
