Therefore, the rule was issued and<br \/>\n\treport was called for.\n<\/p>\n<p id=\"p_1\">In<br \/>\n\tpursuance of issuance of rule, learned A.P.P. has appeared and<br \/>\n\tproduced the report of the Vejalpur Police Station, which confirms<br \/>\n\tabout the cause and the operation.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tcounsel, Mr.Imran Pathan appearing for the original complainant has<br \/>\n\traised apprehension about the securing presence of the applicant as<br \/>\n\tother co-accused has absconded after he was granted temporary bail<br \/>\n\tand was involved into other offence.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\theard learned counsel for the applicant, Ms.Mishra, learned A.P.P.,<br \/>\n\tMs.Nair for the respondent-State and learned counsel, Mr.Imran<br \/>\n\tPathan for the original complainant and having considered the report<br \/>\n\twith regard to medical ground mentioned in the application, the<br \/>\n\tpresent application deserves to be allowed on humanitarian<br \/>\n\tconsideration. Therefore, the present application deserves to be<br \/>\n\tallowed.\n<\/p>\n<p id=\"p_4\">For<br \/>\n\tthe foregoing reasons, the application succeeds in part.<br \/>\n\tAccordingly, it is partly allowed. The applicant-convict<br \/>\n\tprisoner is ordered to be released on temporary bail for a period of<br \/>\n\t 10 (Ten) Days from the date of his actual release on<br \/>\n\texecuting a personal bond of Rs.5,000\/- before the jail authority on<br \/>\n\tusual terms and conditions.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tapplicant shall surrender to the jail authority on completion of 10<br \/>\n\tdays from the date of his release without fail.\n<\/p>\n<p id=\"p_6\">During<br \/>\n\tthe period of temporary bail, the applicant shall not abuse the<br \/>\n\tliberty granted to him and shall maintain law and order.\n<\/p>\n<p id=\"p_7\">Rule<br \/>\n\tis made absolute accordingly to the aforesaid extent.
