Bajaj, DGM &amp; CPIO, OBC\n       (iv)      Shri D.K. Gupta, DCM, OB\n\n       The case in brief is as under.\n\n<\/pre>\n<p id=\"p_1\">       The Complainant had written to the CPIO in the Department of Economic<br \/>\nAffairs, Finance Ministry, Government of India on 10 March 2008 seeking a few<br \/>\ninformation regarding the ownership of the State Bank of India(SBI) and the<br \/>\nOriental Bank of Commerce(OBC). Claiming that he did not receive any reply<br \/>\nwithin the stipulated period, he complained to the CIC.\n<\/p>\n<p id=\"p_1\">2.     During the hearing the Complainant was not present. Instead, he has sent<br \/>\na communication by fax in which he has stated that now the information he had<br \/>\nsought a year back has become irrelevant for him. The Respondent was not<br \/>\npresent in spite of notice. Instead, the representatives of the SBI and the OBC<br \/>\nwere present on the direction of the Government of India, though the<br \/>\ninformation sought largely fell in the Government&#8217;s domain. It was noted that<br \/>\nthe Complainant&#8217;s application had been transferred to the Department of<br \/>\nPersonnel and Training (DOPT) and the CPIO of that Department had given some<br \/>\nclarification about the public-sector status of the SBI and the RBI in his letter<br \/>\ndated 8 April 2008.\n<\/p>\n<p id=\"p_2\">3.     We carefully examined the contents of the Complainant&#8217;s application.<br \/>\nBasically, he wanted to know if some of these Banks were owned by the<br \/>\nGovernment of India. Such information is already available in the public domain.\n<\/p>\n<p id=\"p_3\">CIC\/PB\/C\/2008\/00656-SM<br \/>\n The websites of the Banks clearly mention about their ownership pattern.<br \/>\nTherefore, there is hardly any need for any citizen to ask the CPIO of either the<br \/>\nGovernment or the Banks to clarify about the ownership of the Banks. The other<br \/>\nitem of information sought was regarding the application of the benefits of pay<br \/>\nprotection etc to the employees of the nationalised Banks including the SBI and<br \/>\nthe RBI joining the Central Government as direct recruits. The DOPT Office<br \/>\nMemorandum dated 8 June 1993 which the Complainant had himself referred to<br \/>\nin his own application gives adequate clarification on this. This OM clearly states<br \/>\nthat the Government orders applicable to candidates from Public Sector<br \/>\nUndertakings joining the Central Government would also apply to such<br \/>\nemployees of the nationalised Banks including the SBI and RBI joining the<br \/>\nCentral Government as direct recruits. In fact, all the information that the<br \/>\nComplainant had sought was already available in the public domain through the<br \/>\nwebsites of the respective Banks or it was already available to him through the<br \/>\nDOPT OM he had himself quoted in his application.\n<\/p>\n<p id=\"p_4\">4.     Since the Complainant himself is no longer interested in this information,<br \/>\nwe shall give no direction to the CPIO to provide any further information.<br \/>\nHowever, we would like the CPIO in the Finance Ministry, Department of<br \/>\nEconomic Affairs to explain why penalty under <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> of the Right to<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_2\">Information (RTI) Act<\/a> should not be imposed on him for not providing the<br \/>\ndesired information to the Complainant within the stipulated period. If we do<br \/>\nnot hear from him within 10 working days from the receipt of this order, we will<br \/>\nproceed to decide on the penalty ex parte.\n<\/p>\n<p id=\"p_5\">4.     With the above direction, the complaint is disposed off.\n<\/p>\n<p id=\"p_6\">5.
