Respondents\n\n\n\nCoram: Hon'ble Mr. Justice Ashutosh Mohunta\n       Hon'ble Mr. Justice Rajan Gupta\n\n\nPresent:       Mr. M.K.Bhatnagar, Advocate for\n               Mr. B.N.Sehgal, Advocate\n               for the petitioner.\n\n                Mr. B.S.Chahal, DAG, Punjab,\n                for the respondents.\n\n                                         ....\n\nASHUTOSH MOHUNTA, J.\n<\/pre>\n<p id=\"p_1\">                The petitioner has prayed that directions be issued to the<\/p>\n<p>respondents to release his retiral dues including DCRG (Gratuity), leave<\/p>\n<p>encashment, pension and GIS after counting his entire service along with<\/p>\n<p>arrears and interest.\n<\/p>\n<p id=\"p_1\">                The petitioner who was working as Senior Assistant in the<\/p>\n<p>Revenue Department sought voluntary retirement with effect from<\/p>\n<p>31.1.2007. He was allowed to retire voluntarily. The petitioner was paid his<\/p>\n<p>General Provident Fund after his retirement. Now the petitioner has prayed<\/p>\n<p>that he has not been paid the leave encashment, pension and gratuity.<\/p>\n<p id=\"p_2\">                Reply has been filed on behalf of the respondents wherein it<\/p>\n<p>has been averred that the respondents have been requesting the petitioner<br \/>\n                                                                  [ 2 ]<\/p>\n<p>                           C.W.P. No. 9275 of 2008<\/p>\n<p>to submit the necessary papers and complete the formalities but he is not<\/p>\n<p>co-operating with the answering respondents. Learned counsel submits that<\/p>\n<p>in case the petitioner goes to the office of respondent No.4 and completes<\/p>\n<p>all the necessary formalities then his retiral dues shall be released to him<\/p>\n<p>within a period of three months from the date of completion of the<\/p>\n<p>formalities.\n<\/p>\n<p id=\"p_3\">               In view of the reply filed by the respondents, we dispose of the<\/p>\n<p>writ petition with a direction that the petitioner may attend the office of<\/p>\n<p>respondent No.4 and complete all the formalities. On completion of the<\/p>\n<p>formalities, the case of the petitioner shall be processed and his retiral dues<\/p>\n<p>shall be paid to him within three months from the date of completion of the<\/p>\n<p>formalities.
