RAMACHANDRAN NAIR, J.\n               ---------------------------------------\n                   W.P.(C) No.3068 OF 2010\n               ---------------------------------------\n           Dated this the 30th day of January, 2010.\n\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is engaged in the business of stock and sale<\/p>\n<p>of ordinary sand. He intends to conduct business for the stock<\/p>\n<p>and sale of ordinary sand in the property having an extent of 16<\/p>\n<p>cents situated in survey No.673\/2 in Eriyad village, Kodungallur<\/p>\n<p>Taluk in Thrissur District.\n<\/p>\n<p id=\"p_1\">      2. For getting licence, the petitioner submitted an<\/p>\n<p>application before the 2nd respondent as per Exhibit P1 along with<\/p>\n<p>all the required documents.      The 2nd respondent forwarded the<\/p>\n<p>application to the 3rd and 5th respondents. It is pointed out that<\/p>\n<p>the agriculture officer and the village officer have sent reports in<\/p>\n<p>favour of the petitioner after inspection. Exhibit P2 is the copy of<\/p>\n<p>the certificate issued by the Principal Agriculture Officer to the<\/p>\n<p>Geologist.     But, the 3rd respondent Revenue Divisional Officer<\/p>\n<p>rejected the application of the petitioner as per Exhibit P3. The<\/p>\n<p>petitioner filed Exhibit P4 application before the District Collector<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C) No.3068\/2010                2<\/span><\/p>\n<p>in the matter.\n<\/p>\n<p id=\"p_2\">       3. Learned Government Pleader on instructions submitted<\/p>\n<p>that the competent authority is the District Collector in the light<\/p>\n<p>of the amended Rule 57 of the Kerala Minor Mineral Concession<\/p>\n<p>Rules.\n<\/p>\n<p id=\"p_3\">       There will be a direction to the 4th respondent to take a<\/p>\n<p>decision on Exhibit P4, after assessing various materials produced<\/p>\n<p>by the petitioner and the reports furnished by other statutory<\/p>\n<p>authorities, within a period of two months from the date of<\/p>\n<p>production of a copy of this judgment.           The petitioner will<\/p>\n<p>produce a copy of this judgment along with copy of the writ<\/p>\n<p>petition for compliance.\n<\/p>\n<p id=\"p_4\">       This writ petition is disposed of as above.<\/p>\n<p id=\"p_5\">                                   T.R.
