{"id":256624,"date":"2010-04-26T00:00:00","date_gmt":"2010-04-25T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/manwati-vs-secretary-the-state-of-madhya-on-26-april-2010"},"modified":"2016-06-01T19:15:09","modified_gmt":"2016-06-01T13:45:09","slug":"manwati-vs-secretary-the-state-of-madhya-on-26-april-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/manwati-vs-secretary-the-state-of-madhya-on-26-april-2010","title":{"rendered":"Manwati vs Secretary The State Of Madhya &#8230; on 26 April, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Manwati vs Secretary The State Of Madhya &#8230; on 26 April, 2010<\/div>\n<pre id=\"pre_1\">                         Writ Petition No.2433\/2010\n26.4.2010\n        Shri Kamal Singh Rajput, counsel for the petitioner.\n        Shri Samdarshi Tiwari, Government Advocate for the State.\n        By this petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution the\npetitioner has prayed for quashing of the Revenue Recovery\nCertificate dated 3.9.2009 Annexure P5, issued against her in RRC\nCase No.30A76\/08-09 under section 92 of the Madhya Pradesh\nPanchayat Raj Avam Gram Swaraj Adhiniyam, 1993 (in short \"the\nAdhiniyam\").\n        The case of petitioner is that she as Sarpanch of Gram\nPanchayat Dar under Janpad Panchayat Chitrangi, District Singrauli\nhas spent public funds while implementing Government schemes for\nthe benefit of gram panchayats and the Tahsildar (respondent no.5)<\/pre>\n<p id=\"p_1\">without giving any opportunity of hearing to her has issued the<br \/>\nimpugned Revenue Recovery Certificate alleging misuse of funds.<br \/>\nThe petitioner has submitted that since the Revenue Recovery<br \/>\nCertificate has been issued in utter violation of section 92(4) of the<br \/>\nAdhiniyam, the same is liable to be quashed.\n<\/p>\n<p id=\"p_1\">        The State Government in its return, filed        in similar writ<br \/>\npetition No.13607\/2009 (which was adopted in other identical writ<br \/>\npetitions) stated that on complaints regarding misuse of public<br \/>\nfunds by the Sarpanch of gram panchayats, a Scrutiny Committee<br \/>\nwas constituted for enquiry which found gross misuse of public<br \/>\nfunds by the Sarpanch of as many as 103 gram panchayats under<br \/>\nJanpad Panchayat, Chitrangi. In the return it was also stated that<br \/>\nmore than two crore was found to have been spent without there<br \/>\nbeing    any   account   and   technical   assistance   and,   therefore,<br \/>\nCollector, Singrauli passed an order dated 8.5.2009 directing the<br \/>\nSub-Divisional Officer, Chitrangi to initiate proceedings for recovery<br \/>\nof money from the Sarpanch in accordance with the provisions of<br \/>\nthe Adhiniyam.     The State Government, however, admitted in the<br \/>\nreturn that before issuing the Revenue Recovery Certificate against<br \/>\nthe Sarpanch of different gram panchayats, no opportunity of<br \/>\n hearing as required under section 92(4) of the Adhiniyam was given<br \/>\nand, therefore, prayed for permission to withdraw the Revenue<br \/>\nRecovery Certificates issued with a liberty to proceed afresh after<br \/>\ncomplying with the provisions of section 92(4) of the Adhiniyam.\n<\/p>\n<p id=\"p_2\">      In view of the said return, the State Government was<br \/>\npermitted to withdraw all the Revenue Recovery Certificates issued<br \/>\nagainst Sarpanch of different gram panchayats under Janpad<br \/>\nPanchayat Chitrangi with a liberty to initiate recovery proceedings<br \/>\nagainst them afresh.\n<\/p>\n<p id=\"p_3\">      The stand taken by the State Government in the present<br \/>\npetition is same as it was in W.P.No.13607\/2009. Accordingly, the<br \/>\nState Government is permitted to withdraw the Revenue Recovery<br \/>\nCertificate issued against the petitioner with a liberty to initiate<br \/>\nrecovery proceedings against her afresh in accordance with the<br \/>\nprovisions   of   section   92   of   the   Adhiniyam.
