SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">As<br \/>\n\tcommon question of\u00a0law and facts arise in this group of<br \/>\n\tpetition, they are being disposed of by this common judgement and<br \/>\n\torder.\n<\/p>\n<p id=\"p_1\">In<br \/>\n\tall these petitions, the common petitioner   Gujarat State Road<br \/>\n\tTransport Corporation has prayed for appropriate writ, order and\/or<br \/>\n\tdirection quashing and setting aside the impugned judgement and<br \/>\n\tawards dtd.21\/12\/2002,  passed by the Industrial Tribunal, Nadiad in<br \/>\n\tReference (ITN) Nos.33 of 1998, 37 of 1998 and 9 of 1998,<br \/>\n\trespectively,  by which the Industrial Tribunal has quashed and set<br \/>\n\taside the order of punishment withholding 3 increments without<br \/>\n\tfuture effect, imposed by the disciplinary authority and allowed the<br \/>\n\trespective reference. That departmental inquiries were initiated<br \/>\n\tagainst the respective workman for temporary misappropriation,<br \/>\n\talleging  inter-alia that each workman took Rs.9000=00 (Rupees Nine<br \/>\n\tThousand only) by way of advance travelling allowance and after<br \/>\n\treturning, they were supposed to submit T.A. Bill and deposit the<br \/>\n\tbalance amount which was not utilised \/ spent. In the departmental<br \/>\n\tinquiry the respective workman admitted the default, however, their<br \/>\n\tcontention was that they were not award about the rules of returning<br \/>\n\tthe amount. Having found the charge and misconduct, the disciplinary<br \/>\n\tauthority imposed punishment of withholding of three increments<br \/>\n\twithout future effect. Being aggrieved by and dissatisfied with the<br \/>\n\torders passed by the disciplinary authority  in imposing the<br \/>\n\tpunishment of withholding three increments without future effect,<br \/>\n\tthe respective respondent &#8211; workman raised respective industrial<br \/>\n\tdisputes which were referred to the Industrial Tribunal being<br \/>\n\tReference (ITN) No.33, 37 and 9  of 1998 and by the impugned<br \/>\n\tjudgement and awards the Industrial Tribunal, Nadiad allowed all the<br \/>\n\taforesaid references  and quashed and set aside the respective<br \/>\n\torders passed by the disciplinary authority imposing punishment of<br \/>\n\twithholding 3 increments without future effect.\n<\/p>\n<p id=\"p_2\">Though<br \/>\n\tserved, nobody appears on behalf of the respondents workmen.\n<\/p>\n<p id=\"p_3\">Ms.Roopal<br \/>\n\tPatel, learned<br \/>\n\tadvocate appearing on behalf of the respective petitioner   GSRTC<br \/>\n\thas vehemently submitted that hen the respective workman admitted<br \/>\n\ttheir default of not submitting TA Bill and not depositing the<br \/>\n\tbalance amount which was not spent, the Industrial Tribunal  has<br \/>\n\tmaterially erred in interfering the order of punishment passed by<br \/>\n\tthe disciplinary authority imposing punishment of withholding of 3<br \/>\n\tincrements without future effect. She has relied upon the decision<br \/>\n\tof the Hon&#8217;ble Supreme Court  in the case of State<br \/>\n\tof Orissa and Others, Versus Kshetrabasi Mohanti and Others,<br \/>\n\treported in (1997) 11 SCC 664 in support of her submission<br \/>\n\tthat as held by the<br \/>\n\tHon&#8217;ble Supreme Court, in a case of temporary<br \/>\n\tmisappropriation, Labour Court ought not to have interfered with the<br \/>\n\torder of punishment passed by the disciplinary authority.<br \/>\n\tSubmitting accordingly, it is requested to allow all the petitions.\n<\/p>\n<p id=\"p_4\">Having<br \/>\n\theard Ms.Roopal Patel, learned<br \/>\n\tadvocate appearing on behalf of the petitioner<br \/>\n\tGSRTC and considering the impugned judgement and awards passed by<br \/>\n\tthe tribunal and considering the fact that the charge and misconduct<br \/>\n\tof temporary misappropriation and not submitting T.A. Bill and not<br \/>\n\tdepositing the balance amount of Travelling Allowance which was not<br \/>\n\tspent\/utilised have been proved, and  when the punishment  of<br \/>\n\twithholding of 3 increments that too without future effect was<br \/>\n\timposed, it appears that the learned Tribunal has  committed an<br \/>\n\terror in interfering with the punishment and allowing the said<br \/>\n\treferences and quashing and setting aside the orders of punishment<br \/>\n\timposed by the disciplinary authority, as the case of temporary<br \/>\n\tmisappropriation was already established and proved. When the<br \/>\n\tconcerned workmen took advance of travelling allowance and was aware<br \/>\n\tabout the rule of obtaining travelling allowance in advance, it is<br \/>\n\tnot believable that they were not aware about the rule of depositing<br \/>\n\tthe balance amount on returning from the journey.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tview of the above and for the reasons stated above, all these<br \/>\n\tpetitions succeed.  The  impugned judgement and awards<br \/>\n\tdtd.21\/12\/2002,  passed by the Industrial Tribunal, Nadiad in<br \/>\n\tReference (ITN) Nos.33 of 1998, 37 of 1998 and 9 of 1998,<br \/>\n\trespectively, are hereby quashed and set aside. Rule is made<br \/>\n\tabsolute to the aforesaid extent in each of the  petitions.
