Misc. no. 23418 of 2009 ( Ramdev Mandal<\/p>\n<p>                  and Ors. Vs. State of Bihar). By the aforesaid order the petitioners<\/p>\n<p>                  were granted privilege of anticipatory bail and were directed to<\/p>\n<p>                  surrender within 04 weeks and to furnish bail bond(s). Four<\/p>\n<p>                  petitioners of the said case surrendered and got the privilege of bail as<\/p>\n<p>                  per order dated 15.09.2009. The petitioner did not surrender within<\/p>\n<p>                  the stipulated time. After expiry of close to 02 years the present<\/p>\n<p>                  application has been filed for extension of time for surrender of the<\/p>\n<p>                  petitioner no.1, namely, Ram Deo Mandal in order to reap the benefit<\/p>\n<p>                  of order dated 15.09.2009.\n<\/p>\n<p id=\"p_2\">                              Mr. Jagnnath Singh, learned counsel for the petitioner,<\/p>\n<p>                  submits that the petitioner, during the relevant time, was working on<\/p>\n<p>                  contract basis in Sharjah. He, therefore, could not come to India and<\/p>\n<p>                  appear in Court in accord the order dated 15.09.2009. It is also<\/p>\n<p>                  contended that petitioner undertakes not to leave India till conclusion<\/p>\n<p>                  of the trial. This Court, on going through the pleadings made in the<\/p>\n<p>                  application and after hearing learned counsel for the parties, does not<\/p>\n<p>                  find that any diligent effort was made to obtain extension of the<\/p>\n<p>                  period for surrender of the petitioner as per order dated 15.09.2009.<\/p>\n<p>                  This Court is satisfied that explanations offered by the petitioner are<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>      not adequate for allowing the prayer made in the application.<\/p>\n<p id=\"p_3\">                  Let petitioner surrender before the Court below and apply<\/p>\n<p>      for bail and raise all issues including the fact that other co-accuseds,<\/p>\n<p>      similarly placed, have already been released on bail under orders of<\/p>\n<p>      this Court. Once such application is filed within a reasonable time<\/p>\n<p>      from today learned trial Court shall consider and dispose of the same<\/p>\n<p>      in accordance with law uninfluenced by the present order.<\/p>\n<p id=\"p_4\">                  The application stands disposed of.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">Sym                                       ( Kishore K.
