Justice R.BASANT\n\n Dated :03\/02\/2009\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                      Crl.M.C.No.509 of 2009\n                    ----------------------------------------\n             Dated this the 3rd day of February 2009\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">      The petitioner, the alleged victim of a crime of rape, in<\/p>\n<p>respect of which incident crime No.335\/2007 of Kadavanthra<\/p>\n<p>police station has been registered has come to this court raising<\/p>\n<p>a grievance that no proper investigation is being conducted into<\/p>\n<p>that crime.    That crime was earlier investigated by the 2nd<\/p>\n<p>respondent.    The investigation is now entrusted with the 3rd<\/p>\n<p>respondent, a very senior officer of the Police. Investigation is in<\/p>\n<p>progress. Final report has not been filed. The accused in this<\/p>\n<p>case has come to this court with a prayer to quash the crime<\/p>\n<p>registered; but another Bench of this Court by Annexure A1<\/p>\n<p>order had turned down the said request and dismissed the said<\/p>\n<p>Crl.M.C.\n<\/p>\n<p id=\"p_1\">      2.   What is the direction that the petitioner now seeks<\/p>\n<p>from this court under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C? The learned counsel<\/p>\n<p>for the petitioner submits that there may be a direction to the<\/p>\n<p>present investigating officer, the 3rd respondent to submit the<\/p>\n<p>final report within a stipulated period of time.<\/p>\n<p id=\"p_2\">      3.   I am afraid that such a direction cannot now be issued<\/p>\n<p>by this court. After the decision in Sakiri Vasu v. State of U.P<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.509\/09                 2<\/span><\/p>\n<p>&amp; Others [2008 AIR SCW 309] as followed by this court in<\/p>\n<p><a href=\"\/doc\/1600550\/\" id=\"a_1\">Vasanthi Devi v. Sub Inspector of Police<\/a> [2008(1) KLT<\/p>\n<p>945] it is trite that a person having a grievance about the quality<\/p>\n<p>of investigation cannot rush to this court with applications under<\/p>\n<p><a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a> of the Constitution of India or under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a><\/p>\n<p>Cr.P.C.    I am unable to locate any special or sufficient reason to<\/p>\n<p>reckon the instant case as one to which the ordinary rule<\/p>\n<p>propounded in Sakiri Vasu (Supra) will not apply. Needless to<\/p>\n<p>say, every police officer must make attempt to complete the<\/p>\n<p>investigation as expeditiously as possible.
