Om Prakash Mishra @ Om Prakash Pandey, Son of Krishna Bihari Mishra, Resident of\n     Village - Daldali Bazar, P.S. - Chapra Town, District - Chapra.       .....Respondent.\n     For the Appellant                    : Mr. Shatrughna Pandey, Advocate.\n     For the Respondent                   : APP.\n                                          -----------\n<\/pre>\n<p id=\"p_1\">06\/   06.07.2011                       Heard       learned     Counsel       for     the<\/p>\n<p>                          appellant, Counsel for the State and Counsel<\/p>\n<p>                          for the private respondents.\n<\/p>\n<p id=\"p_1\">                                       The    appellant       has    challenged      the<\/p>\n<p>                          judgment dated 01.07.2010 passed by the 3rd<\/p>\n<p>                          Additional Sessions Judge, Chapra in Sessions<\/p>\n<p>                          Trial      No.     235     of      1994,     whereby       the<\/p>\n<p>                          accused\/respondent nos. 2 and 3                   have been<\/p>\n<p>                          acquitted on the ground that no witness has<\/p>\n<p>                          turn up for examination.\n<\/p>\n<p id=\"p_2\">                                       Learned      Counsel    for    the    appellant<\/p>\n<p>                          has submitted that the purpose of law has<\/p>\n<p>                          been defeated in this case by the trial court<\/p>\n<p>                          because there was no summons to any witness<\/p>\n<p>                          including the informant and on account of the<\/p>\n<p>                          non-service of summons neither informant nor<\/p>\n<p>                          any witness could appear and the prosecution<\/p>\n<p>                          case was closed. It has also been submitted<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>that on this ground alone that summons were<\/p>\n<p>not served the judgment appears to be mala<\/p>\n<p>fide.\n<\/p>\n<p id=\"p_3\">              We have perused the judgment, the<\/p>\n<p>occurrence is of 24.04.1992. According to the<\/p>\n<p>prosecution case, the fardbeyan was given by<\/p>\n<p>this     appellant         Shankar       Pandey     in        Sadar<\/p>\n<p>Hospital,      Chapra        and   it    was   alleged        that<\/p>\n<p>after       taking     meal    on       24.04.1992       he     was<\/p>\n<p>sleeping at his door. His father and deceased<\/p>\n<p>Uma Shankar were also sleeping adjacent to<\/p>\n<p>him when he woke up his brother Uma Shankar<\/p>\n<p>was    on    the     door,    meanwhile,       he   heard       the<\/p>\n<p>sound of firing and proceeded                     towards his<\/p>\n<p>door     and       found      that      his    brother         was<\/p>\n<p>scuffling. The blood was coming out from his<\/p>\n<p>head. The informant could not                     witness any<\/p>\n<p>person and his father being an old man could<\/p>\n<p>not     understand         anything.       Thereafter,          the<\/p>\n<p>informant took his brother to hospital and<\/p>\n<p>during course of treatment his brother died<\/p>\n<p>within five minutes. On the basis of above<\/p>\n<p>fardbeyan Daudpur P.S. Case No. 23 of 1992<\/p>\n<p>was registered. In course of investigation,<\/p>\n<p>name of the accused persons transpires. One<\/p>\n<p>of the accused namely, Ashok Kumar Chaubey<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     3<\/span><\/p>\n<p>absconded       whose       trial      was     separated.      The<\/p>\n<p>First     Information            Report       was     registered<\/p>\n<p>against unknown. There was enough time for<\/p>\n<p>the informant to get information regarding<\/p>\n<p>the occurrence. None naming of any of the<\/p>\n<p>accused       in    the        First    Information          Report<\/p>\n<p>itself is an indication that the implication<\/p>\n<p>was later on. However without expressing any<\/p>\n<p>opinion    on       merit       of   the     case,    even    after<\/p>\n<p>summons or bailable warrants were ordered to<\/p>\n<p>issue on different occasions, show cause and<\/p>\n<p>demi-official letters were also issued for<\/p>\n<p>production of witnesses. Therefore, this is<\/p>\n<p>not a case in which no process was issued<\/p>\n<p>rather process were issued and the court has<\/p>\n<p>done    its    duty       by    issuance       of    the   process<\/p>\n<p>which are required for bringing the witnesses<\/p>\n<p>to the box.             Even non-bailable            warrants to<\/p>\n<p>witnesses       were      issued       but    the     prosecution<\/p>\n<p>failed to bring any witness. The court issued<\/p>\n<p>bailable and non-bailable warrants. Not only<\/p>\n<p>that demi-official letters were also issued.<\/p>\n<p>The court has done its best to see that it<\/p>\n<p>gets assistance from the prosecution but it<\/p>\n<p>failed.       The       court    has       complied    with    the<\/p>\n<p>required procedure.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                             4<\/span><\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                     This court has finds no merit in<\/p>\n<p>            this   appeal       against   acquittal.
