Yadav, Panel Lawyer.\n............................................................................................................\n                                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">                  (Delivered on this 18th day of November, 2010)<br \/>\n                The appellant has preferred this appeal against the judgment<br \/>\ndated 16.8.2010, passed by First Additional Sessions Judge, Jabalpur in<br \/>\nS.T. No.208\/2009, by which he was convicted for offence punishable<br \/>\nunder <a href=\"\/doc\/329571\/\" id=\"a_1\">Section 392<\/a> of I.P.C. and inflicted with the sentence of rigorous<br \/>\nimprisonment for three years with fine of Rs.1000\/-; in default                                          of<br \/>\npayment of fine he was to undergo additional rigorous imprisonment for<br \/>\none month.\n<\/p>\n<p id=\"p_1\">2.      The prosecution story in short is that, on 23.11.2008 the<br \/>\ncomplainant Shashi Jain had visited Jain Temple at Shiv Nagar with her<br \/>\ndaughter Rekha Jain.               At about 6.30 p.m when she was returning back<br \/>\nfrom the temple to her house situated at Hanumantal, someone snatched<br \/>\nher golden chain from her neck.                     Chain was snatched by three persons<br \/>\nriding on a motor cycle. The complainant lodged an FIR in Police Station,<br \/>\nGohalpur.        After due investigation, police had arrested the appellant and<br \/>\nrecovered a golden chain from him.                       The appellant was duly identified by<br \/>\nthe complainant in the test identification parade. After due investigation a<br \/>\ncharge sheet for offence punishable under <a href=\"\/doc\/329571\/\" id=\"a_1\">Section 392<\/a> of I.P.C was<br \/>\nsubmitted before the committal Court against the appellant and one co-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><\/p>\n<p id=\"p_2\">accused Chhiki alias Vikas Jat.\n<\/p>\n<p id=\"p_3\">3.   The appellant abjured his guilt.          He did not take any specific<br \/>\ndefence but, he stated before the trial Court that he was falsely implicated<br \/>\nby the Police. However, he did not adduce any evidence from his side.\n<\/p>\n<p id=\"p_4\">4.   On considering the evidence adduced by the prosecution, learned<br \/>\nAdditional Sessions Judge, Jabalpur      has     convicted the appellant for<br \/>\noffence punishable under <a href=\"\/doc\/329571\/\" id=\"a_2\">Section 392<\/a> of I.P.C and inflicted the aforesaid<br \/>\nsentence whereas the co-accused Chikki alias Vikas Jat was acquitted.\n<\/p>\n<p id=\"p_5\">5.   I have heard the learned counsel for the parties.\n<\/p>\n<p id=\"p_6\">6.   Learned counsel for the appellant submits that the appellant does<br \/>\nnot want to challenge the conviction directed by the trial Court but, since<br \/>\nthe appellant is a young youth of 21 years of age, who has no criminal<br \/>\npast and who is in custody since 15.12.2008 i.e, he has undergone in<br \/>\ncustody for two years approximately and therefore, that custody period<br \/>\nwould be the appropriate sentence.       On the other hand learned Panel<br \/>\nLawyer for the State has submitted that he has filed a copy of the various<br \/>\ncases pending against the appellant in the various Court to show his<br \/>\ncriminal background.\n<\/p>\n<p id=\"p_7\">7.   Learned Panel Lawyer has submitted a short description of the cases<br \/>\npending against the appellant.    Except this appeal there are three cases<br \/>\npending against the appellant.     Out of that one case is registered for<br \/>\noffence punishable under <a href=\"\/doc\/399026\/\" id=\"a_3\">Sections 399<\/a>, <a href=\"\/doc\/1784492\/\" id=\"a_4\">402<\/a> of I.P.C and another Sessions<br \/>\nTrial is pending for offence punishable under <a href=\"\/doc\/455468\/\" id=\"a_5\">Section 307<\/a> of I.P.C.     The<br \/>\nthird case is pending for offence punishable under <a href=\"\/doc\/329571\/\" id=\"a_6\">Section 392<\/a> of I.P.C.<br \/>\nSince these three cases are pending before the trial Court it cannot be<br \/>\nsaid that these were the previous cases of the appellant. These cases<br \/>\nmay be subsequent events and therefore, for the purpose of consideration<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                 3<\/span><\/p>\n<p>       of sentence in the present appeal, it cannot be said that the appellant has<br \/>\n       criminal past or he is a convicted person in another case.        It is true that<br \/>\n       appellant has committed robbery in the broad day light but, looking to his<br \/>\n       age and the property which was robbed, jail sentence of              23 months<br \/>\n       seems to be sufficient against the appellant.         He has completed his age<br \/>\n       of 21 years at the time of crime therefore, he is not entitled to get any<br \/>\n       advantage of <a href=\"\/doc\/167447\/\" id=\"a_7\">Probation of Offenders Act<\/a> due to his age.         There is no any<br \/>\n       other ground by which he may be given an advantage of <a href=\"\/doc\/167447\/\" id=\"a_8\">Probation of<br \/>\n       Offenders Act<\/a>.    Offence is grave and therefore, it would not be proper to<br \/>\n       release the appellant by imposing some fine upon him.              Since he has<br \/>\n       under gone the custody from 15.12.2008 which is almost of 23 months.<br \/>\n       Therefore, looking to the custody period there is no need to impose any<br \/>\n       fine in addition to his jail sentence.       The appellant has not deposited the<br \/>\n       fine imposed by the trial Court and therefore, if more fine is imposed then<br \/>\n       it will increase his custody period.\n<\/p>\n<p id=\"p_8\">       8.    Under these circumstances looking to the age and custody period of<br \/>\n       the appellant, it would be proper if he may be inflicted with a jail sentence<br \/>\n       which he has already under gone.\n<\/p>\n<p id=\"p_9\">       9.    On the basis of the aforesaid discussion, the appeal of the appellant<br \/>\n       is partly allowed. Conviction of the appellant for offence punishable under<br \/>\n       <a href=\"\/doc\/329571\/\" id=\"a_9\">Section 392<\/a> of I.P.C. is hereby maintained but, jail sentence imposed on<br \/>\n       the appellant is hereby reduced to the period which he has already<br \/>\n       undergone in custody. Sentence of fine imposed against the appellant is<br \/>\n       hereby quashed.\n<\/p>\n<p id=\"p_10\">       10.
