Justice M.L.JOSEPH FRANCIS\n\n Dated :01\/07\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n         ------------------------------------------------------\n                 W.P.(C) No.18251 of 2010-F\n            ----------------------------------------------\n              Dated, this the Ist day of July, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">K.M.Joseph, J.\n<\/p>\n<p id=\"p_1\">               Petitioner has approached this Court complaining<\/p>\n<p>harassment by respondents 2 and 3 police officers.<\/p>\n<p id=\"p_2\">             2. The prayers sought in the writ petition are as<\/p>\n<p>follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>    &#8220;i. to issue a writ of mandamus or any other writ, order or<\/p>\n<p>    direction restraining respondents 2 and 3 from harassing<\/p>\n<p>    and threatening the petitioner stating that the petitioner is<\/p>\n<p>    the 12th accused in Crime No.423 of 2009 of Ezhukone<\/p>\n<p>    Police Station, which after investigation has ended up in a<\/p>\n<p>    Final Report taken on file by the Judicial Magistrate of the<\/p>\n<p>    Ist Class-I, Kottarakkara as C.P.No.45\/2010.<\/p>\n<p>    ii. to declare that the petitioner is not the 12th accused in<\/p>\n<p>    the Final Report filed by the Ezhukone Police in Crime<\/p>\n<p>    No.423\/2009 pending on the file of the Judicial Magistrate<\/p>\n<p>    of the Ist Class-I Kottarakkara as C.P.No.45\/2010.&#8221;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             3. Briefly put, the case of the petitioner is as<\/p>\n<p>follows: Petitioner is residing in the address shown in the writ<\/p>\n<p>petition and is running a stationery shop for the last ten years.<\/p>\n<\/blockquote>\n<p id=\"p_3\">Petitioner opens his shop at 7 a.m and closes by around 10<\/p>\n<p>p.m. He has not so far been involved in any criminal cases.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 18251\/2010                               -2-<\/span><\/p>\n<p>On 10.5.2010, on instructions of the 3rd respondent a<\/p>\n<p>policeman came to the petitioner&#8217;s shop and told the petitioner<\/p>\n<p>that the petitioner is accused in Crime No.423\/2009 of<\/p>\n<p>Ezhukone Police Station.     According to the petitioner, the<\/p>\n<p>summons is addressed to the 12th accused who is one Kannan<\/p>\n<p>residing at Krishna Mandiram near Surabhi Auditorium,<\/p>\n<p>Nedumankavu Muri, Karipra Village.         Petitioner told the<\/p>\n<p>policeman that the name and address shown in the summons<\/p>\n<p>is not that of the petitioner and petitioner has no connection<\/p>\n<p>with any case. According to the petitioner, the policemen of<\/p>\n<p>the Ezhukone Police Station is harassing and threatening him<\/p>\n<p>stating that he is the 12th accused and he has to accept the<\/p>\n<p>summons issued to the 12th accused.        Petitioner preferred<\/p>\n<p>Ext.P1 petition before Superintendent of Police, Kollam.<\/p>\n<p id=\"p_4\">            4.   Petitioner has also filed Ext.P7 which is an<\/p>\n<p>affidavit sworn by the defacto complainant wherein it is stated<\/p>\n<p>that the deponent of the affidavit knows Sri.Adersh namely<\/p>\n<p>the petitioner for a very long time and if he was involved in<\/p>\n<p>the incident he would have definitely stated his name at the<\/p>\n<p>time of investigation. He also stated that the petitioner was<\/p>\n<p>not involved in the incident and he never told the name of 12th<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 18251\/2010                               -3-<\/span><\/p>\n<p>accused as Kannan.\n<\/p>\n<p id=\"p_5\">            5. Learned Government Pleader was asked to get<\/p>\n<p>instructions on this affidavit. Learned   Government Pleader<\/p>\n<p>would submit that apart from the deponent of Ext.P7 affidavit<\/p>\n<p>there are some others namely one Manoj and Binu and they<\/p>\n<p>have given statement. We do not think that this proceeding<\/p>\n<p>may be appropriate for rendering a judgment regarding the<\/p>\n<p>question relating to the mistaken identity in view of<\/p>\n<p>circumstance brought to our notice. In our view, it is for the<\/p>\n<p>petitioner to work out his remedies before the appropriate<\/p>\n<p>forum and establish his case.
